At Surrogate's Court held at the Surrogates Office in Goshen in and for the County of Orange on the ninth day of October in the year one thousand eight hundred and thirty seven - Present John B. Booth Surrogate - On reading and filing the petition and application of John King one of the Executors named in the Last Will and testament of Charles Gillet late of the town of Mount Hope in the County of Orange, deceased, for the proof of said Will, as a Will of Real and personal estate. It is therefore hereby Ordered that the following Citation issue Viz: The people of the State of New York: To Sarah Gillet the widow, Isaac Gillet, Charles Gillet, Stephan Wiggins & Olive his Wife of the town of Mount Hope James Burt Jr. & Mary his Wife of the town of Warwick, William Hulet & Lucinda his Wife of the town of Newburgh, all of the County of Orange and State of New York, and David C. Swezey and Eliza Ann his wife of the town of Starkey County of Yates, and State aforesaid, the next of kin of Charles Gillet, late of the town of Mount Hope, in the County of Orange, deceased, Greetings: You are hereby cited to be and appear before the Surrogate of the County of Orange at his Office in Goshen, in said County, on the twenty seventh day of November neat, at Ten O'Clock in the forenoon of that day to attend the probate of a certain instrument in Meeting purporting to be the Last Will and Testament of said deceased bearing date the Tenth day of December, in the year of our Lord one thousand eight hundred and thirty four, on the application of John King claiming to be one of the Executors thereof which said Will relates to both Real and personal estate In Witness Whereof the Surrogate of the said County L.S. has hereunto affixed his Seal of Office the 20th day of October 1837 John B. Sweezy with the within Citation by delivering to him personally a Copy thereof, and at the same time showing him the Original Sworn this 28th day of October 1837 Alonzo Simmons Before E. Barnes Con. of Deeds Orange County: John King of the town of Hamptonburgh, in said County & Isaac Gillet of the town of Mount Hope, in the said County, being duly sworn depose and say and the said John King for himself says that he did more than eight days previous to the twenty seventh day of November personally serve the said Isaac Gillet Charles Gillet Stephen Wiggins and Olive his wife, and William Hulet named in the within Citation by delivering to each of them a Copy thereof and at the same time showing them the original. I the said Isaac Gillet for himself says that he did eight days previous to the twenty seventh day of November 1837 serve the within named Sarah Gillet and James Burt Jr. each with the within Citation by delivering to each of them a copy thereof and at the same time showing to each of them the Original Sworn & Examined this 27th day John King of November 1837 Before me John B. Booth Surrogate Isaac Jillet Orange Surrogate Court: In the matter of proving the Said, Will and Testament of Charles Gillet, deceased, both as a Will of Real and personal Estate State of New York: Orange County: Charles S. King of the town of Wallkill William L. Reeve of Mount Hope and John King of the town of Hamptonburgh, all of said County, being by the Surrogate of the County of orange, duly sworn and Examined, depose and say and each for himself say of that he was well acquainted with Charles Gillet, late of the town of Mount Hope, in said County, deceased. And the deponents Charles S. King and William L. Reeve further say, and each for himself says that he was present as a Witness and did see the said Charles Gillet, deceased, subscribe at the end thereof, the instrument now produced, and shown to the deponents, purporting to be the last Will and testament of the said Charles Gillet, deceased, bearing date the tenth day of December, in the year one thousand Eight hundred and thirty four: That such subscription was made by the said Testator, in the presence of these deponents, subscribing Witnesses to said Will: That the said Testator at the same time declared the instrument so subscribed by him to be his Last Will and Testament whereupon these deponents signed their names at the end of the Will at the request of the said Testator: and that the said Testator at the time of executing and publishing the said Last Will and testament was of full age, of sound mind and memory and not under any restraint. And the deponent John King for himself further says, that said Testator left said Will with deponent for safe keeping, that deponent safely kept the same from that time until by here delivered to said Surrogate for probate that said Will is the same now as when delivered to deponent as aforesaid Sworn & Examined 27th day of November 1837 Charles S. King Before me John B. Booth Surrogate William L. Reeve John King In the name of God Amen. I Charles Jillet of the town of Mount Hope County of Orange, and State of New York, being of Strong mind and good memory, Gods name be praised for the same, do make and publish this my Last Will and Testament in manner and form following Viz; In the first place I do give and bequeath to my wife Sarah the two south east rooms in my house, with the Bed room and so much of the Sellar and chamber as may be necessary for her convenience and comfort and that she has my carriage and harness and my bay mare: and that in case said bay mare should become unfit for use by age or otherwise then in such case she is to be provided with another good safe horse as long as she may live to want the same said horse to be kept on my farm, and said carriage and harness kept in a repair out of my property, provided that said horse is allowed to labour on my farm at such times as my wife does not want to use the same, and I do further give and bequeath to my wife Sarah ( ?? ) Jillet of two barrels of wheat flour three bushels of Rye three bushels of Buckwheat and two bushels of Corn, and one hundred and fifty pounds of pork, and fifty pounds of beef, and five pounds of Wool, and (ten or five) pounds of Flax, and one hundred pounds of Butter, fifteen pounds of Lard, twenty pounds of tallow together with a reasonable quantity of Potatoes and garden sauce that shall be raised on my farm and I do give to my wife Sarah a sufficient quantity of fire wood And I do hereby Order that she shall be supplied with a sufficient quantity of the same, to be of good quality and cut and piled convenient to the door, and brought to the fire if required, and that she be furnished with four gallons of Molasses, fourteen pounds of Sugar, and two pounds of Tea and Eight pounds of Tobacco and ten pounds of cheese, and I do order that my wife Sarah be furnished yearly with all the article above mentioned so far as they regard her living and support during her natural life. And I do further order that in case of sickness or disease, or old age, that (that) my wife Sarah be carefully nursed, provided with a physician, and all and every other living thing that may lend to make her comfortable shall be rendered, And I do further order that she shall be furnished with a sufficient quantity of Milk for her use at all times when required, And I do further Order that my wife Sarah be yearly furnished with five dollars if it is necessary and required for her contingent expenses. And I do further Order and require that all my personal estate be sold (causing) and (assessing) all my (house hold estate, my bay mare carriage and harness and one horse sleigh) and that the avails of the sale of said personal Estate be disposed of in the following manner Viz: In the first place I Order that all my honest debts be paid and in the next place I do give and bequeath to my Wife Sarah the residue of the above mentioned sum of money arising from said Sale, and every part thereof, And I do give and bequeath to my wife Sarah all my house hold furniture and at her request , his horse and carriage is to be put in readiness for her use, and I do give and bequeath to my wife Sarah as much (fuele or fruite) and cider as she wants for her use, And I do give and bequeath to my son Charles Jillet all my landed estate of every Kind and description with the appurtenances thereto belonging or in any ( ) belonging and to his heirs, assigns, Executors or administrators for ever provided that he the said Charles Jillet Jr. doth at all times comply with this my Last Will and Testament so far as regards the bequests. I have given to my wife Sarah with respect to her living and support, And I do nominate, constitute and appoint John King Lebbeus L. Harding and Isaac Jillet Executors to this my Last Will and Testament hereby revoking all other and former wills by me at any time heretofore made In Witness Whereof I have hereunto set my hand and Seal this Tenth day of December in the year of our Lord one thousand Eight hundred and thirty four Charles Jillet L.S.
