All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ny/nyfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Liz DuBois ddubois@sinclair.net October 19, 2010, 3:50 am Source: Orange County, Ny, Surrogate Court Records, Liber D, P.399+ Written: April 5, 1811 Recorded: April 18, 1811 Orange County, NY, Surrogate Court Records, Liber D, p.399+ The People of the State of New York by the Grace of God Free and Independent To All to who these presents shall come or may concern find Greeting Know Ye That at Goshen in the County of Orange on the Eighteenth day of April Instant before James Everett Esq Surrogate of our said County the last will and Testament of John Wisner deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed by [page 400] by w and the said deceased having whilst he lived and at the time of his death goods chattels or credits within this state by means where of the proving and registering the said will and the granting administration of all and singular the said goods chattels and credits and also the auditing allowing and final discharging the account thereof doth belong unto us the administration of all and singular the goods chattels and credits of the said deceased and anyway concerning his will is granted unto Robert Armstrong & William Carr Junior the Executors in the said will named they being first duly sworn well and faithfully to ad= minister the same and to make and exhibit a true and perfect In= ventory of all and singular the said Goods chattels and credits and also to render a just and true account thereof when thereunto re= =quired In Testimony whereof we have caused the seal of office of our said Surrogate to be hereunto affixed Witness James Everett Esquire Surrogate of the said County at Goshen the Twenty second day of April in the Year of our Lord one thousand eight hundred and Eleven and of our Independence the Thirty fifth --------- In the Name of God Amen I John Wisner of the Town of Warwick in the County of Orange and State of New York be= =ing weak in body but of sound disposing mind and memory blessed be God calling to mind the mortality of my body and know= =ing that it is appointed for all men once to die do make and publish this my last will and testament in manner and form following that is to say I will and assign my soul into the hands of God who gave it and my body to the earth to be buried in decent christian burial as the discretion of my Executors and as to such Worldly Estate as it hath pleased God to bestow upon me I will and dispose of in the following manner First will and order that my Executors shall pay all my past debts [p.401] and funeral expenses Secondly I will and order that all the lands and real estate of which I shall died lawfully seized shall be sold by my Executors at their discretion as to the time and manner of sale and for that purpose do fully authorize and empower my said Executors to sell all of my real estate and execute Deeds of Conveyance for the same and thirdly I will and bequeath unto my two daugh= =ters Clarissa and Eliza five hundred Dollars each; and fourthly I will and bequeath unto my four sons Asa John Mumford Henry and Robert five thousand Dollars All the legacies before mentioned to be paid to my said children when they shall respectively arrive at Lawful age if either of my said daughters Clarissa or Eliza should die before the arrive at Lawful age or have Lawful issue then the survivor to receive the share of the deceased and so in like manner with respect to my four sons before mentioned and further I will and bequeath to my well beloved wife Sarah all my household furniture and also I will and order that my Executors shall retain in their hands as much shall enable them to pay yearly and every year to my said well beloved wife Sarah a sum equal to what would be her right of Dower of all the estate I now possess and at the decease of my said wife I will and order that the surplus remain= =ing of my estate be divided among my six chil= =dren named in this will or the survivor or survivors of them or their legal representative I also will unto my said wife three cows to be chosen by her this Legacy to my wife is in consideration of her releasing her right of Dower and Lastly I do constitute and appoint my trusty friends Robert Armstrong Esquire and William Carr Junior Executors of this my last will and Testament whereof I have herewith set my hand and seal this fifth day of April one thousand and eight hundred and Eleven Published pronounced and declared to be the last will and Testament of the said John [p.402] Wisner in presence of us the words (five thousand) being interlined and a blank rasure under it before signing Jesse Jayne Wil= =liam Rayner Lewis Hall John Wisner Orange County S Be it remembered that on the Eighteenth day of April in the year of our Lord one thousand eight hundred and Eleven personally appeared before me James Everett Surrogate of the County of Orange Jesse Jayne and Lewis Hall and being duly sworn upon their oath declared that they did see John Wis= ner deceased sign and seal the written instrument then sworn unto them of which the preceeding is a true copy pur= porting to be the last will and testament of the said deceased bearing date the fifth day of April instant and heard him publish and declare the same as and for his last will and testament that at the time thereof he the said deceased was of a sound disposing mind and memory to the best of the know= =ledge and belief of them the deponents and that they together with William Rayner subscribed their names thereunto as Witness =es in the testators presence and in the presence of each other The preceeding is a true copy of the original will of John Wisner deceased of the certificate of the proof thereof and the letters Testamentary thereon by James Everett Surrogate Additional Comments: Will of John WISNER, son of John WISNER and Anne JAYNE;
