Will book Vol 24 page 239. At a Surrogate's Court, held at the Surrogate's Office, in Albion, in and for the County of Orleans, on the 24 day of July, 1893. Present, Hon. ISAAC S. SIGNOR, Surrogate. In the Matter of Proving the Will of Solomon G. Wright, Deceased. Satisfactory proof by affidavit having been made and filed of the due service of the citation heretofore issued in this matter, requiring the proper persons to appear in this Court on the 2 day of July A.D. 1892 at ten o'clock in the forenoon, and attend the Probate of the last Will and Testament of Solomon G. Wright, late of the town of Albion in the County of Orleans and State of New York, deceased, and Daniel G. Wright personally and by S. S. Sorncer Esq. his attorney having appeared in support of the proof of the said last Will and Testament and the matter being duly adjourned to this day and after hearing the proofs and allegations of the said parties so appearing and duly deliberating thereon: It is ORDERED, ADJUDGED AND DECREED that the said last Will and Testament was duly executed; that the same is genuine and valid, and that the said deceased, at the time of executing the same, was in all respects competent to make a last Will and Testament and to devise real estate, and was not under any restraint, and that the said last Will and Testament be admitted to Probate, and that the same be and hereby is established as a Will of real and personal estate. And this Court doth further Order and decree that the said last Will and testament be recorded. And the Probate of the same being not contested, it is further Ordered and Decreed that the proofs and examinations taken in respect to the same be recorded. And on reading and filing the oath of Daniel G Wright, the executor named in said Will, it is Ordered that Letters Testamentary issue to him purusant to the Statute, Isaac S. Signor, Surrogate. Will of Solomon G Wright. I Solomon G. Wright farmer of the town of Albion County of Orleans and State of New York do make publish and declare my last Will and Testament as follows. First. I give and bequeath to my present wife Emerilla S Wright and to her heirs and assigns forever all the use produce income interest, rents and profits of all my real estate and of all my personal estate to have and hold for her own benefit for and during her natural life. My Executor of this Will may sell of otherwise dispose of from time to time, such animals and articles of personal property as aught to be so disposed of to save the sum of my estate from loss and decay, investing the avails to be enjoyed by my said wife as aforesaid. And I charge the income and increase so to grow out my property during the life of my wife with the cost and expense and duty of paying taxes thereon and making necessary repairs theron to save the same from decay forbidding waste to be committed on my real estate and directing my personal proerty to be so managed far as may be as to perserve the value thereof as it was at my death, unmpaired to the death of my wife. Second. At the death of my said wife I give and devise and bequeath, all my real estate and all of my personal estate that shall then remain undisposed of as aforesaid to my children and heirs at law as follows. To my granddaughter Ella Batt otherwise called Ella Collins, daughter of my daughter Julia A. I give my best bedstead, bed, and bedding sufficient to make up such bed for use at all seasons of the year with change of sheets and pillow slips. All the remainder of my property I give to my daughters viz: Fanny A. Bugbee Lydia Haaoir, Julia A Collins, (formerly Julia A. Ball) and Sarah D. Martin, to my grandson Fernando C. Pierce, Son of my deceased daughter Mary; and to my son Silas L Wright to them and to their heirs and assigns, to be divided between them share and share alike; except that the sum of three hundred dollars shall be deducted from the portion to be given to my son Silas said three hundred dollars I give to said Fanny Lydia Julia Fernando Sarah D their heirs and assigns in equal portions to each. Third. I revoke all Wills by me heretofore made and I appoint Daniel G. Wright of the town of Albion to be sole executor of this my last Will and empower my exector to sell and dispose of my property both real and personal as may be necessary to carry this Will into execution and on any such sale to make execute and deliver to purchasers all such conveyances in writing as may be proper and according to law to carry good and sufficient title in each case. In Witness whereof I had hereunto set my hand and seal this 6th day of July 1877 Solomon G. Wright (L.S.) The foregoing instrument was on the day of the date thereof signed sealed published and declared by the testator Solomon G Wright as and for his last Will and Testament in presence of each ofus; and are at his request in his presence and in presence of each other subcribe our names hereto as witnesses. Upon the Application of the executor of the estate of said deaceased: Ordered, that Alack Z Mitchell and Alexander Carr, residents of said County, two disinterested persons, be, and there are hereby appointed Appraisers of the personal property of the said deceased, to estimate an apparise the same, on their taking and subscribing the oath required by law.
