Salisbury and Adelle Bartlett both of Sandy Creek, NY being first duly sworn, in open court, upon their several corporal oaths, each for himself, doth depose and say, that they are subscribing witnesses to the last Will and Testament of Abram Schermerhorn late of the Town of Boylston in the County of Oswego, and State of New York, deceased. And these deponents do further say, that the said Abram Schermerhorn, deceased, did in the presence of each of these deponents, subscribe h is name at the end of the instrument in writing, which is now here shown to these deponents, and which purports to be the Last Will and Testament of the said deceased, and which bears date on the tenth day of March one thousand eight hundred and that the said deceased did, at the time of subscribing his name to the said instrument as aforesaid, declare the same to be his last will and Testament; and these deponents did thereupon subscribe their own respective names at the end of said instrument, as attesting witnesses to the execution thereof, each at the request of said deceased, and in his presence and in the presence of each other; that the said deceased, at the time of so subscribing his name to said instrument as aforesaid, and publishing said instrument as aforesaid, was upwards of twenty-one years of age, and a citizen of the United States; that he appeared to be, and deponent believe he was of sound mind, memory and understanding, and not under any restraint, and as deponents verily believe, in all respects competent to devise real estate; that each of these deponents saw the other sign his name to said instrument in the presence of the said deceased. OSWEGO COUNTY, ss It appearing upon the proofs taken in respect to the Last Will and Testament of Abram Schermerhorn late of the Town of Boylston in the County of Oswego, and the State of New York, deceased, that the said Will was duly executed, and that the said Abram Schermerhorn at the time he executed the same, was in all respects competent to devise real estate, and not under restraint, the last Will and Testament and the proofs and examinations are hereby recorded, signed and certified by me, pursuant tothe provision of the Revised Statutes, this 10th day of June A.D. 1890 F. David Surrogate In the Matter of Proving the Last Will and Testament of Abram Schermerhorn, Deceased Be it remembered, that heretofore, to-wit, on the 4th day of July in the year of our Lord, one thousand eight hundred and ninety four Alfred Schermerhorn Executor named in the Last Will and Testament of Abram Schermerhorn late of the Town of Boylston in the County of Oswego, deceased, appeared in open Court, before the Surrogate of the County of Oswego and made application to have the said Last Will and Testament which relates to both Real and Personal Estate proved ; and on such application, the said Surrogated did ascertain by satisfactory evidence who were the widow heirs at law, and next of kin of the said testator, and their respective residences all adults and said Surrogate did thereupon issue a Citation in due form of law, directed to the -widow- heirs at law and next of kin by their respective names, stating their respective places of residence requiring them to appear before said Surrogate at the Courthouse in the City of Oswego in the said County; on the 18th day of Oct. A.D. 1895 to attend the Probate of said Will, And afterwards to-wit: on the 20 day of June A.D. 1895, satisfactory evidence by affidavit was produced and presented to said Surrogate, of the due service of said Citation in the mode prescribed by law; and on that day no one appearing to oppose the Probate of such Will such proceedings was thereupon had in said Court afterwards, that the said Surrogate took the proofs of said Will hereinafter set forth, upon this 10 day of June A.D. 1895 and he thereupon adjudged the said Will to be a valid Will of real and personal estate, and the proofs thereof to be sufficient, which said Last Will and Testament and proofs are as follows, that is to say: Will: The Last Will & Testament of Abram Schermerhorn. I Abram Schermerhorn of the Town of Boylston Oswego County and State of New York do make, ordain, publish and declare this to be my last will & testament, in the manner & form following, that is to say First, I hereby give and bequeath unto my wife Sally Ann Schermerhorn for her support and maintenance` for and during the period of her natural life only, the use and avails of the sum of three thousand dollars ($3000.) to be paid to her as follows. I hereby direct my executor herein after named to invest and keep invested for the purpose above specified. the said sum of three thousand dollars in good and safe securities yielding as large a rate of interest as a commitment to obtain and to pay over annually to the said Sally Ann Schermerhorn for her support as above provided, the avails and income thereof. This gift and bequest to my said wife Sally Ann Schermerhorn why by me made & by her to be received in lieu of all dower and all rights and interests which she would have in & to my estate personal real or mixed in case I died intestate. And at the death of my said wife Sally Ann I hereby give & bequeath to my nephew Alfred Schermerhorn of the town of Boylston aforesaid the said sum of three thousand Dollars to be his absolutely and forever. Second, after my lawful debts & funeral expenses and the experience of administering my estate are paid. I hereby give, devise and bequeath unto my said nephew Alfred Schermerhorn all the rest residue and remainder of my estate of which I may die seized or possessed of every name and nature, personal real and mixed to be his absolutely & forever. Third, Likewise I make constitute & appoint my said nephew Alfred Schermerhorn to be my executor of this my last will and testament hereby revoking all former wills by me made. In witness whereof, I have hereunto subscribed my name affixed my seal, the tenth day of March in the yearof our Lord one thousand and eight hundred ninety Abram Schermerhorn The foregoing instrument was at the date thereof subscribed by Abram Schermerhorn the testator therein named in the presence of us & each of us he at the time of making such subscription acknowledged that he executed the same and declared the said instrument so subscribed by him to be his last will and testament.
