And the said deceased having whilst he lived and at the time of his death goods chattels or credits within this state (by means whereof the proving p.427 and registering the said will and the granting administration of all & singular the said goods chattels and credits, and also the auditing allowing and final discharging the account thereof doth belong to us; & the administration of all and singular the goods chattels and credits of the said deceased and any way concerning his will is granted unto John J. Kittle & William Canfield Executors in the said will named and being first duly sworn will and faithfully administer the same and to make and exhibit a true and perfect inventory of all and singular the said goods chattels and credits, and also to render a just and true account thereof when thereunto required. In testimony whereof we have caused the seal of office of our said surrogate to be hereunto affixed. Witness Thomas Clowes, Esquire Surrogate of the said County at the City of Troy the Second day of October in the year of our Lord one thousand eight hundred and Twenty six [Signed] T. H. Clowes Surrogate In the name of God, Amen. I, Johannes Kittle of the Town of Schodack County of Rensselaer and State of New York farmer being of sound mind & memory blessed be Almighty God for the same but considering the uncertainty of life do make this my last will and testament in manner following that is to say First. I give devise and bequeath unto my son John J. Kittle all that certain tract or farm of land situated in the Town of Schodack aforesaid on which I now live, together with all the buildings thereon standing with the appurtenance as thereto belonging to his heirs & assigns forever. I also give and bequeath to my son John aforesaid & to his heirs & assigns my cider mill & press all the provisions of Beef & Pork which I may have put up for my family’s use all hogs & beef which I may have on hand fatting. One milk cow all the hay and grain which may be growing on the premises heretofore devised to him at the time of my decease on which I may have reaped or gathered all my farming utensils of every description my cider hogs heads & barrels my pleasure sleigh & carriage my wagons & other sleighs together with the harnesses thereto belonging, my clock, my desk marked. I give devise & bequeath to Hannah widow of my son Nicholas J. Kittle deceased all that certain piece or parcel of land messuage & tenement situate lying & being in the Town of Schodack aforesaid which on she now lives & was in possession of her husband Nicholas at the time of his death to remain to the said Hannah during the time she shall remain the widow of my said son Nicholas and when that time shall cease I give devise and bequeath the same to my grand sons John N. Kittle & Isaac Kittle & to their heirs and assigns forever. Also I give & bequeath to my grand sons as aforesaid John p. 428 and Isaac all my equal undivided half part of all that certain Island situate in the county of Albany on the west side of the channel of the Hudson’s River opposite Beekman’s at Schodack & adjoining Beekmans Island & to their heirs & assigns forever. I give devise and bequeath unto my daughter Lena Schermerhorn wife of Abraham Schermerhorn all that certain tract of land situate in the county of Albany containing about fifty one acres which I lately purchased of my son in law the said Abraham Schermerhorn for the said Lena’s soul use and benefits to her heirs & assigns upon condition however that she my said daughter Lena or her heirs pay to my executors herein after named within four years after my decease one hundred pounds with interest thereon from the first day of May one thousand eight hundred and eighteen until my decease & do hereby charge the land hereby devised to her and her heirs with the payment of the said one hundred pounds & the interest as aforesaid. & I hereby authorize & direct my executors herein after named to retain in their hands such proportion of personal property as I shall hereafter in this instrument bequeath to my said daughter Lena as should be sufficient to pay off & satisfy the charge which I have imposed resow the land so as aforesaid devised to my said daughter Lena & if the same shall not be sufficient then & in that case the land aforesaid devised to her is to stand charged for the payment of the remainder. I gave & bequeath to my grand son Nicholas Gardinier one milk cow and wooden frame looking glass. I give & bequeath to my grand daughter Geshe Claw one cherry table with leaves to it. I give & bequeath to Iche Van Denbergh six dollars. To Catherine Barhyte six dollars. To Lena Schermerhorn six dollars. To Nicholas Gardinier & Geshe Claw each three dollars which said sums of money I order to be paid by my son John J. Kittle at my decease. With respect to the residue of my personal property not heretofore particularly bequeathed I order & give & bequeath in manner following, first I order & direct that out of the same my executors herein after named pay my just debts & funeral expenses. Secondly that my said executors as soon as conveniently may be after my decease collect all the monies which are or may become due on account by Notes, bills, bonds, judgments, Mortgages or otherwise except the note against Rachel Bosworth of which only one hundred dollars is to be collected & remainder of which to be divided equally between the children of my son Richard deceased and and when the same shall be collected by my executors as aforesaid the amount thereof together with the personal property not heretofore particularly bequeathed is to be divided as nearly as may be into four equal parts. One of which I order my executors to pay to my daughter Lena. One to my daughter Iche one to my daughter Catherine and the other to my grand children Nicholas Gardinier Geshe Claw & Caty Foland the wife of John Foland. I give & bequeath unto my p. 429 daughters Iche Catherine & Lena each one hundred pounds and unto my grand children Nicholas Geshe & Caty Foland the wife of John Foland Nicholas one hundred & twelve dollars and fifty cents Geshe Claw the same Caty Foland twenty five dollars & I hereby order and direct my son John J. Kittle to pay the said last mentioned legacies to my daughters Iche Catherine and Lena & my said grand children Nicholas Geshe and Caty within two years after my decease & I do hereby charge the land & personal property heretofore devised & bequeathed to him the said John with the payment of the same. Likewise I order my executors to pay out what money I shall have at my decease in the following manner & proportions that is to say the same to be divided into five shares, to my daughter Catherine one share to my daughter Iche one share, to my daughter Lena one share & to my grand children Nicholas & Geshe one share to be divided between them. I order and direct my executors to pay the monies to my grand son Nicholas which are bequeathed to him by virtue of this my will and testament at such times & such sums as they in their discretion shall shall think proper & as it will most conduce to his benefit. Any thing herein to the contrary notwithstanding. Lastly I hereby nominate John J. Kittle & William Canfield executors of this my last will & testament hereby revoking all other wills testaments & codicils by me heretofore made. In witness whereof I have hereunto set my hand & seal this twenty seventh day of June in the year of our Lord one thousand eight hundred & twenty five. Van Iyck, Philip Van Ness, Thomas Miller State of New York Rensselaer County ys: Be it remembered on the Second day of October in the year of our Lord one thousand Eight hundred and twenty six personally appeared before me Thomas Clowes, Esquire Surrogate of the said County of Rensselaer Henry P. Van Iyck & Thomas Miller two of the subscribing witnesses of the will of Johannes Kittle late of the Town of Shodack in said county deceased who duly sworn declared that they did see the said Johannes Kittle seal & execute the annexed written instrument purporting to be the last will and testament of the said Johannes bearing date the twenty seventh day of June in the year of our Lord one thousand eight hundred & twenty five & heard him publish & declare the same as & for his last will & testament that at the time thereof he the said Johannes was of sound disposing mind & memory to the best of the knowledge and belief of the said Henry P. & Thomas as and that they the said Henry P. and Thomas together with Philip Van Ness the other witness to the said will severely subscribed their hands p. 430 and names to the said Will as witnesses thereto in the presence of the Testator and each other.
