Recorded May 5th, 1818. L.S. The People of the State of New York, by the grace of God Free and Independent: - To all to whom these presents shall come, or may concern, send Greeting: Know Ye, that at the City of Troy in the County of Rensselaer, on the Fifth day of May in the year of our Lord One Thousand eight hundred & eighteen before William McManus Esquire, Surrogate of our said county, the Last Will and Testament of Daniel Schermerhorn late of the Town of Schodack in the County of Rensselaer and State of New York, deceased, (a copy whereof is hereunto annexed), was proved, and is now approved and allowed by us; and the said deceased having whilst he lived, and at the time of his death, Goods, Chattels or Credits within this state, (by means whereof the proving and registering the said Will, and the granting administration of all and singular the said Goods, Chattels and Credits, and also the auditing allowing and final discharging the account thereof, doth belong to us); the administration of all and singular the Goods, Chattels and Credits of the said deceased, and any way concerning his Will, is granted unto John Schermerhorn one of the executors in the said Will named, he being first duly sworn will and faithfully to administer the same, and to make & exhibit a true and perfect inventory of all and singular the said Goods, Chattels and Credits, and also to render a just and true account thereof when thereunto required. - In testimony whereof, we have caused the seal of office of our said surrogate to be hereunto affixed. - Witness William McManus Esquire, Surrogate of the said County, at the City of Troy the Fifth day of May in the year of our Lord One Thousand eight hundred and eighteen - [Signed] Wm McManus The last will and testament of Daniel Schermerhorn deceased, with the probate thereof . - Recorded May 5th, 1818. In the name of God Amen. I Daniel Schermerhorn of Schodack being weak in body but of sound mind and memory blessed be Almighty God for the same: do make and publish this my last Will and Testament. in manner and form following (that is to say) – Item, I give unto my son Isaac the estate I bought of Peter Van Valken whereon he now lives, (that is to say) if my said son Isaac conveys to the heirs of my son Abraham the estate where my said son Abraham now lives in Coeymans in the County of Albany, and in case of a Refusal of my said son Isaac.- I do hereby give and devise the estate herein devised - to my son Isaac to the heirs of my son Abraham.- Item. I give and devise to my son Jacob the farm he now possesses in the County of Rensselaer. - Item, I give and devise to my son Philip his Heirs and assigns the farm I bought of Jacobus J. Vosburgh in the Town of Kinderhook in the County of Columbia, likewise the use of the orchard that is on the land I purchased from the p.113 late John Barhite as long or until he has an orchard on the place or the land herein devised to him. I likewise bequeath unto my said son Philip one thousand dollars. - Item, I give and devise unto my two daughters Mariah wife of Mathew Bove and Hanney Schermerhorn their heirs or assigns the House and lot of land occupied by my son Philip all the lands belonging to the said lot. I likewise will and order that my said daughter Mariah her heirs or assigns pay or cause to be paid to my daughter Hanney eighty pounds to be paid to her out of the property herein devised to my daughter Maria. - I further give and bequeath to my two daughters my two large looking glass, I further give & bequeath unto my daughter Hanney my brass hand irons one bed with its furniture two cows and six sheep. I further give and devise unto my son John his heirs or assigns all the estate I now live on and now possess in the town of Schodack with all the appurtenances thereunto belonging. I further give and bequeath unto him four fifths of all the grain now on hand likewise of all the grain sown on the said Farm, the other remaining one fifth, I give and devise to my son Philip. - I further give and bequeath unto my son John all my Farming utensils with three fourth of all my stock consisting of horses, cows, hogs, sheep, etc. the other one fourth I give and bequeath unto my son Philip. - I further give and bequeath unto my son Cornelius his heirs or assigns Five hundred dollars.- I further give and devise unto my grand daughter Polly wife of Ryer Springsteen one hundred and twenty five dollars and six chairs which all said legacies I will and or: that my son John pay one year after my decease. - I give and bequeath – to my son John his heirs or assigns all my Bonds Notes Book accounts. - I will and order that my said son John pay or cause to be paid all my just debts and Funeral charges. - I hereby appoint my sons Jacob and John Schermerhorn with Cornelius I. Schermerhorn Executors of this my last Will and Testament hereby revoking all former Will by me made. In witness whereof I have hereunto set my hand and seal this First day of January in the year of our Lord One Thousand eight hundred and eighteen. - [signed] Daniel Schermerhorn L. S. Signed sealed published and declared by the above named Daniel Schermerhorn to be his last Will and Testament in the presence of us whose names are hereunto subscribed as witness in the presence of the Testator.— E. State of New York Rensselaer County} Be it remembered, that on the fifth day of May in the year of our Lord One thousand eight hundred eighteen, personally appeared before me William McManus Esquire, Surrogate of the said County of Rensselaer, Ryer B. Springsteen and Anthony Ten Eyck Two of the subscribing witnesses to the Will of Daniel Schermerhorn late of the Town of Schodack in the said County, deceased, who being duly sworn declared p. 114 that they did see the said Daniel Schermerhorn seal and execute the written instrument, (of which the annexed is a copy), purporting to be the last Will and Testament of the said Daniel Schermerhorn bearing date the first day of January in the year of our lord One Thousand eight hundred and eighteen and heard him publish and declare the same as and for his last Will and Testament; that at the time thereof, he the said Daniel Schermerhorn was of sound disposing mind and memory, to the best of the knowledge and belief of the said Ryer B. Springsteen and Anthony Ten Eyck and that they the said Ryer B. Springsteen and Anthony Ten Eyck together with Ebenezer Vallentine the other witness to the said Will, severely subscribed their hands and names to the said Will as witnesses thereto, in the presence of the Testator and of each other.— [Signed] Wm.
