Recorded May 12,1834 State of New York, County of Rensselaer, SS. Be it remembered that a Surrogate Court held for the County of of Rensselaer at the Surrogate Office in the City of Troy on the twelfth day of May in the year of our Lord one thousand Eight hundred and thirty four, in the matter of the Real Estate of George Clickner, deceased; present Philip Viele Surrogate. (?) William Clickner, a Devisee named in the last Will and Testament of George Clickner late of the Town of Brunswick in the County aforesaid deceased, and informed the said Court that notice had been given pursuant to the Statute in such case made and provided of his intention of proving the last Will and Testament of the said George Clickner, deceased and the said William Clickner brought into this Court a notice of his intention to prove the said Will signed by the said William Clickner a Devisee named in said Will with affidavets of the said William Clickner, Philo K. Cole, George S. Ferris, Abraham Dayton, Jedediah Tracy, William Shafer and George W. Goodhue and the written admission of John P. Clickner proving due service to publication of said notice upon all the heirs of the said George Clickner deceased which said notice affidavits and admission are as follows to wit. To the Heirs of George Clickner deceased, You will please take notice that I shall apply to the Surrogate of the County of Rensselaer at his office in the City of Troy on Monday the Twelfth day of May next and at ten o'clock in the forenoon of that day to take the proof and record the last Will and (pg 14) Testament of George Clickner late of the Town of Brunswick in the County of Rensselaer aforesaid deceased, in pursuance of the Revised Statues of the State of New York concerning "Wills of Real Property and the proof of them" which said Will is dated the first day of September in the year of our Lord one thousand eight hundred and Eighteen. Dated March 20, 1834 Yours &c. William Clickner a Devisee named in said will. I hereby admit due service of a copy of the above notice. Dated Henrietta April 15, 1834. John P.(X his mark) Clickner son of Philip Clickner late of Brunswick signed in the presence of Isa Carpenter, County of Rensselaer SS; William Clickner being duly sworn deposeth and saith that he delivered Copies of the above notice of his intention to prove the last Will and Testament of Real Estate of George Clickner late of the Town Of Brunswick in said County deceased. John Clickner, Eve Johnson Margaret Clickner (now wife of Hugh Seker) Mary Clackner, Christina Clickner, Elizabeth Rui?s, Adam Clickner Junior, Thomas Clickner, Mary Ann Clickner, John G. Clickner, Angeline Miller, Catherine Kilmer, Susan Myers, and Martin Springon Special Guardian of Sarah Clickner, Henry Clickner and Catherine Stowals on or before the first day of April last. And Deponent further saith that the persons above named reside in the County of Rensselaer and are all heirs at law of said George Clickner deceased (including deponent) residing in the County aforesaid and are all of full age with the exception of said Sarah Clickner, Henry Clickner, and Catherine Stowals and deponent further saith that the residue of the heirs at law of said deceased reside out of the County of Rensselaer to wit: Adam Clickner of Camden in the County of Oneida, Eve Boomhour of Rensselaerville in the County of Albany, Angelica Clackner of Chautauqua in the County of Chautauqua, Sophronia Barkman of Middleburgh in the County of Schohaire, Sarah Bergher and John P. Clickner of Henrietta in the County of Monroe, Margaret Patlow and Mary Boomhour of The Province of Lower Canada and Deponent further saith that Copies of said Notice have been duly served on said Adam Clickner, Eve Boomhour, Angelica Clickner, Sophronia Barkman, Sarah Bergher John P. Clickner as appears by the affidavits of George S. Ferris, Abraham Dayton, Jedediah Tracy, William Shafer, George W. Goodhue and the admission of said John P. Clickner hereunto annexed, And deponent further saith that the persons whose names are above mentioned as residing out of the County of Rensselaer are all full age, and further the deponent saith not. Cole of the City of Albany, being duly sworn says that he is foreman in the office of the Albany Argus, and that the notice of of which the annex is a printed Copy has been regularly published in said Albany Argus once in each week for six weeks successively commencing on the thirty first day of March last past. Ferriss of the Town of Camden in the County aforesaid being duly sworn doth depose and say that he did on the Seventh day of April instant serve Adam Clickner of said Camden with a Copy of the above written notice by delivering the same to him personally and further deponent saith not. Abraham Dayton of the Town of Rensselaerville in the County aforesaid being duly sworn doth depose and say that he did on the Seventh day of April instant serve Eve Boomhour of of the place afore'd with (pg 15) a Copy of the above written notice by delivering the same to her personally, and further deponent saith not. Abraham Dayton from on this 18th day of April 1834 before me Lewis M. Dayton Com. of Deeds, State of New York County of Chautauqua S.S. Jedediah Tracy of the Town of Chautauqua in the County aforesaid being duly sworn doth depose and say that he did on the nineteenth day of April instant serve Angelica Clackner the wife of Joseph Clackner of the place aforesaid with a Copy of the above notice by delivering to her a copy of said above notice in person, and further Deponent saith not. I, William Shafer of the Town of Middleburgh in the County aforesaid being duly sworn doth depose and say that he did on the Eighteenth day of April instant serve Sophronia Barkman with a Copy of the above notice by delivering the same to her personally, and further Deponent saith not. Whereas the said Court being satisfied with the proof made in the premises that due notice have been given according to Law of the intention to have the said Will of the said deceased proved in pursuance of the Revised Statues of this State concerning "Wills of Real property and the proof of them". It is ordered on reading and filing the above affidavits by the said Court, that William Clickner, devisee named in said Will have leave to proceed to prove the said Will of the said deceased and thereupon the said Will being produced and shown to the said Court: County of Rensselaer Surrogates Court. In the matter of proving the Will of Real Estate of George Clickner, deceased Daniel Simmons of Brunswick in the County of Rensselaer being first duly sworn deposeth and saith that he saw George Clickner now deceased execute the instrument presented to Deponened by deponents writing the name of said deceased "George Clickner" to said Will at the request of deceased, after deponent had read or explained said Will to said deceased and which purports to be the last Will and Testament of the said George Clickner deceased bearing date the first day of September in the year of our Lord one thousand eight hundred and Eighteen. that he heard the said George Clickner, declare the same to be his last Will and Testament, and that he, this deponent, did subscribe his name as a witness thereto at the request of the said George Clickner and further that at the time thereof the said George Clickner was of sound mind and memory of full age and not under any restraint, and further this Deponent saith not. Daniel Simmons sworn this 12th day of May 1834 before me Philip Viele Surrogate, County of Rensselaer Surrogates Court, in the matter of proving the Will of Real Estate of George Clickner deceased. William Hass of Clarkson in the County of Monroe being first duly sworn deposeth and saith that he saw George Clickner now deceased execute the Instrument presented to deponent (the name of said "George Clickner" having been written to said Will by Daniel Simmons Esq. at the request of deceased in his presence and in the presence of Deponent) and which purports to be the last Will and Testament of the said George Clickner deceased bearing date the first day of September (pg 16) in the year of our Lord one thousand eight hundred and Eighteen, that he heard the said George Clickner declare the same to be his last Will and Testament, and that he, this Deponents name was subscribed to said Will by said Daniel Simmons as a witness thereto at the request of the said George Clickner and further at that time thereof the said George Clickner was of Sound mind and memory of full age and not under any restraint, and further this Deponent saith not. Sworn this 12th day of May 1834 before me Philip Viele Surrogate County of Rensselaer Surrogates Court In the matter of proving the Will of Real Estate of George Clickner deceased. Adam Clickner Junior of Grafton in the County of Rensselaer being first duly sworn deposeth and saith that he saw George Clickner now deceased execute the instrument presented to Deponent (the name of said "George Clickner" having been written to said Will by Daniel Simmons Esq. at the request of deceased in his presence and in the presence of Deponent) and which purports to be the last Will and Testament of the said George Clickner, deceased bearing date the first day of September in the year of our Lord one thousand Eight hundred and Eighteen, that he heard the said George Clickner declare the same to be his last Will and Testament, and that he, this Deponents name was subscribed to said Will by said Deponent Daniel Simmons as deponent did not write, as a witness thereto at the request of the said George Clickner and further at that time thereof the said George Clickner was of sound mind and memory of full age and not under any restraint, and further this Deponent saith not. Adam (X his mark) Clickner Junr. Sworn this 12th day of May 1834 before me Philip Viele Surrogate. And hereupon it appearing to said Court that the said Will of the said deceased was duly executed according to law and that the said Testator who executed the same was at the time of making such execution of full age of sound mind and memory and not under any restraint. It is ordered by the said Court that the said Will together with the probate thereof be recorded; which said proof is herein before recorded and contained and that said Will so ordered to be recorded is as follows: In the name of God Amen, I George Clickner of the Town of Brunswick County of Rensselaer and State of New York, being of weak in body, but of Sound and perfect mind and memory blessed be Almighty God for the Same, do make and publish this my last Will and Testament in the manner and form following, that is to say. First, I give and devise unto my Son William Clickner all my freehold Estate to him the said William his heirs and assignes to have and hold forever. I also give and bequeath unto my son John Clickner fifty dollars. I also give and bequeath unto each of my daughters the sum of Forty one Dollars and fifty eight cents, namely, Margaret the widow of David Patlow, Mary the wife of Jacob Boomhour, Sarah the wife of Henry Bargher, Eve the wife of Michael Boomhour, and Fiona the wife of Gerrit Barkman. I also give and bequeath unto my grand daughter Angelica Kilmer, daughter of William Kilmer, the sum of forty one Dollars and fifty Eight cents; And I order my said son William to pay the above said several sums as legacies to my above mentioned son John and Several named daughters and grand daughter three years after my decease. I also give and bequeath unto my grand daughter Angelica aforesaid a good bed and beding one cow and three sheep, to be delivered immediately after my decease, and the remainder part of my household furniture I give and bequeath unto my five daughters and grand daughter above named equally to be divided between them, And lastly as to all the rest residue and remainder of my personal Estate goods and chattels of what kind and nature I own I give and bequeath unto my said son William. And Lastly I appoint my son John and Daniel Simmon my Executor of this last Will and Testament. hereby revoking all former Wills by me made.
