NY The last Will and Testament of Thomas Phillips of the Town of Petersburgh in the County of Rensselaer and State of New York. I Thomas Phillips considering the uncertainty of this mortal life and being of sound mind and memory (blessed be Almighty God for the same) do make and publish this my last Will and Testament in manner and form following - First, I resign my soul into the hands of Almighty God hoping and believing in a remission of my sins by the merits and mediation of Jesus Christ, and my body I commit to the earth to be buried at the discretion of my executor hereafter named. And as to my worldly estate I will and bequeath it as follows: Having given my son Thomas Phillips Jr. my real estate after my decease, it is understood between us that he pay my burying and funeral charges and all other legal demands that shall come against my estate after my decease. I give and bequeath unto my son Samuel Phillips all my wearing apparel and also seventy five dollars to be paid to him within two years after my decease. I give and bequeath unto my son Thomas Phillips, Jr. my mare and my brass clock and my stove and all my other personal property that I do not otherwise dispose of. I give and bequeath unto my daughter Elizabeth Wellman one hundred dollars to be paid to her within two years after my decease. I give and bequeath unto my daughter Mary Steward one hundred dollars to be delivered to her within two years of my decease. I give and bequeath unto Caleb Wells that married my daughter Susannah (now deceased) the sum of one hundred dollars to be paid unto him within two years after my decease. I give and bequeath unto my daughter Wilaby Brown, wife of Nathan Brown, one hundred dollars to be paid unto her within two years after my decease. I give and bequeath unto my daughter Abigail Waite, wife of Clark Waite, the sum of one hundred dollars to be paid unto her within three years after my decease. I will and bequeath unto my four above named daughters namely Elizabeth Wellman, Mary Steward, Wilaby Brown and Abigail Waite and to their heirs all my household furniture that I have not otherwise disposed of, to be equally divided between them. And I do hereby constitute and appoint my son Thomas Phillips, Jr. executor of this my last Will and Testament, in witness whereof I have here unto set my hand and Seal this eighth day of June in the year of our Lord one thousand eight hundred and thirty. Saunders residing in Petersburgh Rensselaer County State of New York County of Rensselaer Be it remembered that on the sixteenth day of October in the year of our Lord one thousand eight hundred and thirty four personally appeared before me, Philip Viele Surrogate of the said County of Rensselaer, Isaac Saunders one of the subscribing witnesses of the Will of Thomas Phillips late, of the Town of Petersburgh in said county deceased, who being duly sworn declared that he did see the said Thomas Phillips execute the annexed written instrument purporting to be the last Will and Testament of the said Thomas Phillips, bearing date the eighth day of June in the year of our Lord one thousand eight hundred and thirty, and heard him publish and declare the same as and for his last Will and Testament that at the time thereof he, the said Thomas Phillips, was of sound disposing mind and memory, to the best of the knowledge and belief of the said Isaac Saunders, and that he, the said Isaac together with Thompson W. Saunders, the other witness to the said Will, severally subscribed their hands and names to the said Will, as witness thereto in the presence of the testator and each other.
