Recorded March 12, 1849. WILL : In the name of God, I, JOSEPH SLADE, of the town of Pittstown, in the County of Rensselaer and state of New York considering the uncertainty of this Mortal Life and being of sound and perfect mind and memory and knowing that it is appointed for all men once to die: I do make and ordain this my Last Will and Testament that is to say, Principally and First of all, I recommend my soul into the hands of Almighty God that gave it and my body I recommend to the earth to be buried in my burying place reserved by MY FATHER and me on the Farm now owned by MY SON PHILIP SLADE in a decent Christian burial at the discretion of my Executors hereafter named and my Friends and Family, nothing doubting, but at the general Resurrection I shall receive the same again by the Mighty Powers of God and as touching such Worldly Estate wherewith it has pleased God to bless me with in this life I give, devise and dispose of the same in the following manner and form FIRST My will and desire is that all my just debts and Funeral charges be paid and discharged by my Executors hereafter named. 2nd I give and bequeath to MY BELOVED WIFE ELSIE all the Real Estate now owned by me where I now live and that was purchased by me of and GIDEON SHERMAN and all my Household Furniture in my house at the time of my death and all my farming tools on said place and my Horse, Cow and Hogs, Harness, and Carriages at the time of my death for her use and improvement during her natural life, and after her decease to be divided equally among my children. 3rd To my CHILDREN (viz), SALLY HASKINS, JOSEPH SLADE JUNIOR, PHILIP SLADE , CALEB SLADE , ISRAEL SLADE, BENJAMIN SLADE , and NELSON SLADE I give and bequeath seven ninths of all my Estate both real and personal after taking out of my said estate the above bequest to MY WIFE, the said seven ninths to be divided equally among them. 4th To my GRAND CHILDREN, HEIRS OF WILBER SLADE I give and bequeath the one ninth part of my said estate after taking out the bequest to my said WIFE, the said one ninth to be divided equally among the said HEIRS OF WILBER SLADE in such a manner that they shall all have an equal share with my other before mentioned Children. 5th To my DAUGHTER NANCY WADSWORTH, WIFE OF WADSWORTH, I give and bequeath the sum of One Dollar. 6th To my SONS PHILIP SLADE and BENJAMIN SLADE I give and The other one ninth part of my said estate not before disposed of this to be kept by them in trust for my said DAUGHTER NANCY WADSWORTH and given to my said DAUGHTER in such portions as they my two last mentioned SONS shall think proper and after her decease, whatever remains in their hands of her share is to be divided equally among HER HEIRS And I further will and devise that all obligations for money held by me against any of MY SONS and against any of MY DAUGHTERS' HUSBANDS is to be by this will included as a part of my estate in such a manner that they shall all be equal in value by adding to their respective shares such obligations as I may hold against them at the time of my decease. Finally, and lastly, I do hereby make, ordain, constitute and appoint my two SONS PHILIP SLADE and BENJAMIN SLADE Joint Executors to this my Last Will and Testament, hereby revoking all former wills by me made. In witness whereof I, the said JOSEPH SLADE have hereunto set my hand and affixed my seal this Twenty First Day of June in the Year of Our Lord, One Thousand Eight Hundred and Thirty Seven. NORMAN BAKER Pittstown WILLIAM STURGESS of Pittstown PROOFS : SURROGATE COURT In the matter of proving the Will and Testament of JOSEPH SLADE deceased COUNTY OF RENSSELAER, S.S. : NORMAN BAKER and WILLIAM STURGIS of the Town of Pittstown in the County of Rensselaer being duly sworn in open court now depose and say and each for himself say that he is a subscribing witness to the Last Will and Testament of JOSEPH SLADE late of the Town of Pittstown in the County of Rensselaer deceased and that the said JOSEPH SLADE did in the presence of this deponent subscribe his name at the end of the instrument which is now shown and exhibited to his deponent and which purports to be the Last Will and Testament of the said JOSEPH SLADE and which bears date on the Twenty First Day of June in the Year of Our Lord, One Thousand Eight Hundred and Thirty Seven, and that the said JOSEPH SLADE did at the time of subscribing his name as aforesaid declared the said instrument to be his Last Will and Testament and this deponent did thereupon subscribe his name at the end of the said will as an attesting witness thereto at the request of the said testator and that at the time when the said testator subscribed his name as aforesaid the said JOSEPH SLADE was of sound mind and memory, of full age to execute a will, and was not under any restraint, but competent in all respects to devise real estate and that these deponents severally did at the same time subscribe their names to the said will as witnesses thereto at the request of the said testator in his presence and in presence of each other and further this deponent saith not NORMAN BAKER WILLIAM STURGIS Subscribed and sworn this 12th Day of March 1849 before me - G.T. BLAIR / BLAIN, Surrogate CODICIL : Whereas I JOSEPH SLADE did on the Twenty First Day of June in the Year of Our Lord, One Thousand Eight Hundred and Thirty Seven make the foregoing as my Last Will and Testament And I now ordain and order that this shall be a Codicil to said foregoing Will and that this said Codicil shall make my foregoing Will and Testament subject to this Codicil but this foregoing Will and Testament shall stand and Remain as it is written, excepting the hereafter said Codicil. FIRST I give and bequeath to my said DAUGHTER NANCY WADSWORTH the same privilege in my dwelling house to live in that she has occupied while living with me for the turn of Four Years after me decease and the use of my Cow during said turn, and the Cow is to be kept on my said Land durind said Four Years. SECONDLY, I give and bequeath to my SON PHILIP SLADE a certain note By MYSELF and JOHN BABCOCK now deceased, but I direct that one half of the amount of said note shall be taken from my said SON PHILIP'S share out of my former bequest to him.
