All rights reserved. http://www.usgwarchives.org/copyright.htm http://www.usgwarchives.org/ny/nyfiles.htm *********************************************************************** Source: sampubco.com photocopy Rensselaer co NY Will Book Vol. 5 page 198 Written: not listed Probated: 13 Sep 1815 State of New York, Rensselaer County Be it remembered That on the Thirteenth day of September in the year of our Lord one thousand eight hundred fifteen personally appeared before me William McManus Esquire Surrogate of our said County of Rensselaer James Mathison one of the subscribing witnesses to the will of Robert Armstrong late of the Town of Lansingburgh in the said County deceased, who being duly sworn declared, that he did see the said Robert Armstrong seal & execute the written instrument of which the annexed is a copy purporting to be the Last will and Testament of the said Robert Armstrong (without dates) at Lansingburgh in the year of our Lord one thousand eight hundred and fifteen, and heard him publish and declare the same as and for his last will and Testament that at the time thereof he the same Robert Armstrong was of sound disposing mind & memory to the best of the knowledge and belief of the said James Mathison and that the same James Mathison together with John Stewart and Andrew Thompson the other witnesses to the said will generally subscribed their hands & names to the said will as witnessed thereto in the presence of the Testator and of each other. Wm. McManus -------------- The last will and Testament of Robert Armstrong deceased, with the probate there of. Recorded Sept. 13th 1815. In the name of God amen, I Robert Armstrong, of Lansingburgh in the County of Rensselaer & State of New York do make publish and declare this my last will and testament in manner and form following that is to say I give and bequeath to my beloved wife Hannah Armstrong Seven hundred Dollars and to my son Archibald Armstrong I give and bequeath Twenty Dollars to be paid to the said Archibald as soon as may be after my decease. And as to the rest residue and remainder of my estate, both real and Personal I devise give & bequeath the same to my son Robert and my daughters Hannah, Margaret, Jennet & Elizabeth Armstrong in equal proportions share & share alike but no divisions of said property to be made amongst my said children last mentioned until the youngest there of shall arrive to the age of Twenty one years. And if any or either of them shall die previous to the Youngest child arriving to such age, I do hereby order and direct that the residue of my estate aforesaid be divided amongst the previous of them, share and share alike, unless the child or children so dying shall leave lineal heir or heirs capable in Law of inheriting his or her share. And further I will order & direct that my said children receive out of the residue of my Estate aforesaid a reasonable maintenance and support at the discretion of my executors & executrix after named or such of them as remain unmarried during the minority of the Youngest thereof as aforesaid. And further that if it shall hereafter become necessary to sell any part of my estate for the payment of debts or legacies charged there out or for the Maintainance & support of my children aforesaid that then in that case such part or all if necessary of my Personal Estate be sold for that purpose except necessary household furniture and wearing apparel and that stock which I hold in the Farmers Bank, Bank of Lansingburgh and Saratoga Insurance company and if such personal property shall I hereby order & direct that all or such part as may be necessary of my real estate be sold and that the monies arrising therefrom be assets in the hands of my executors & executrix, except the house I now occupy as a d house and the lot whereon it stands before any part of the above excepted personal property be disposed of. And further I will & direct that my son Robert be continued as Student in the Lansingburgh academy until he be prepared to enter college and that then his future education be at the discretion of my executors & executrix herein after mentioned. And I do hereby constitute and appoint my esteemed friends Cornelius Lansing and Jonathan Burr and my beloved wife Hannah Armstrong the survivor or survivors of them Guardians of my infant children until they arrive to the age of Twenty one years for all beneficial purposes, and do also nominate constitute and appoint them the said Cornelius, Jonathan and Hannah executors and executrix of this my last will and Testament.
