I Nanning J. Visscher of Greenbush in the county of Rensselaer being of sound & disposing mind but being sick & weak which may terminate in final dissolution and desirous to settle all my worldly affairs whilst I have sufficient capacity so to do do hereby make & publish this my last Will and testament commending my soul to the creator who gave it and my body to the earth to be properly interred. Imprimis: Having heretofore executed a trust deed to my friends Barent Bleecker & James McKown to sell such of my estate as might be necessary for the payment of my debts and after certain trusts therein mentioned were executed to hold such of my estate as might remain unsold at my death to be conveyed to such person or persons & for such estates as I might by my last will & testament direct & appoint and also to account with & pay over any personal estate that might remain to such person or persons as I should direct by my said last Will & Testament as by a reference to this said deed dated on or about the twenty eight day of April 1817 appears Being therefore minded & disposed to make a disposition of such of my real & personal estate as may remain after the debts mentioned in the said Deed shall have been paid & the purposes & trusts for which the same deed was particularly executed shall have been accomplished Do hereby give devise & bequeath to my beloved wife Catharine all the use income profits & emoluments of all my real estate whatever kind or wheresoever situate with the appurtenances thereunto belonging which may remain after the execution of the said trust Deed. To have & to hold the same to my beloved wife for & during her natural life. Item. I do further give & bequeath unto my beloved wife all the two equal undivided third parts of all that dwelling house in which I reside with the outhouses & buildings therein together with the land belonging to the same & now actually occupied by me being about _____ [a line with no entry] acres of land be the same more or less & as the same is now & has been used & held by me To have and to hold the same to my beloved wife her heirs & assigns for her & them sole use benefit & profit forever. Item. I do also give devise & bequeath to my beloved wife all the right title & interest which I have or may or can have in & to a certain other piece of land with the buildings & appurtenances thereto belonging south of & adjoining to the last mentioned premises the same being an unexpired term of a lease for lives held under John Van Rensselaer, dec'd, subject however to all rents due or to become due therefore. Item. I do also give & bequeath unto my beloved wife all my household furniture stock horses carriages plate watch books & papers And all other personal property of every description which may remain after my said trustees Barent Bleecker & James McKown Shall have paid & satisfied all my debts mentioned & to be paid by the said Trust Deed. Item. I do hereby give devise & bequeath to the children of my sister Eleanor the wife of Isaac Denniston and to the daughter of my deceased sister Alida who was the wife of George Shepherd all the rest residue & remainder of my real & freehold estate after the death of my beloved wife which is not herein before specifically devised to my said wife & her heirs forever To have & to hold the same to my said Nephews & Nieces share & share alike their heirs & assigns forever and in case it shall happen that any of my said Nephews or Nieces die before my said wife then I give and devise such share to the child or children always to take the share their parent would have taken if living or if there shall not be any such child or children then such share to be divided among the surviving Nephews & Nieces in equal portions. Item. I do give & bequeath unto Catharine Visscher Van Rensselaer the daughter of my friend Solomon Van Rensselaer the sum of one thousand dollars to be paid to her by my wife when she the said Catharine Visscher Van Rensselaer shall have arrived at the age of twenty one years or shall be married which ever first shall happen And I do hereby expressly charge that part of my said estate devised to my said wife absolutely in fee with the payment of the foregoing legacy and do exempt all other parts of my said estate from any liability for the payment thereof or any part thereof. Item. It is my will & desire & I do hereby direct that all the just debts which I may owe at the time of my decease whether the same may have accrued before or since the execution of the said Trust Deed to my friends Barent Bleecker & James McKown shall be paid out of the credits of my estate not specially devised to my said wife in fee forever And I do hereby authorize & direct amy sale or sales to be made for that purpose. Lastly. I do hereby nominate & appoint my beloved wife Catharine Glen Visscher Executrix and my friends Barent Bleecker & James McKown & Solomon Van Rensselaer Executors of this my last Will & Testament. In Witness whereof I have hereunto set my hand & seal this Ninth day of December in the year of our Lord one thousand eight hundred twenty one. Nanning J. Vanderzee State of New York Rensselaer County} SS Be it remembered that on the eleventh day of January in the year of our Lord one thousand eight hundred & twenty two personally appeared before me Thomas Clowes Esquire Surrogate of the said County of Rensselaer Storm T Vanderzee one of the subscribing Witnesses To the Will of Nanning I. Visscher late of the town of Greenbush in the said County Deceased who being duly sworn declared that he did see the said the said Nanning I. Visscher seal & execute the annexed written instrument purporting to be the last Will & Testament of the said Nanning J. Visscher dated the ninth day of December in the year of our Lord one thousand eight hundred & twenty one & heard him publish & declare the same as & for his last Will & Testament that at the time thereof he the said Nanning J. was of sound disposing mind & memory to the best of the knowledge of the said Storm T Vanderzee and that he the said Storm T Vanderzee together with Samuel Cheever & William Aikin the other Witnesses to the said Will severally Subscribed their hands & names to the said Will as Witnesses thereto in the presence of the Testator & each other.
