A. 99 NY I. ============================================================ Act of June 27, 1890, Declaration for Invalid Pension State of New York County of Richmond ss: On this 19th day of September AD one thousand eight hundred and ninety before me, a Notary Public in and for the County and State aforesaid, personally appeared Charles E Smith aged 45 years, a resident of West Brighton, county of Richmond State of New York, who being duly sworn according to law, declares that he is the identical Charles E. Smith who was enrolled on the 12th day of August, 1862 as Private in Co. A, 99th Reg't New York Vol, in the service of the United States during the war of the rebellion, and served at least ninety days, and was honorably discharged at or near Salisbury N.C. in the State of ___, on the 15th day of July, 1865. That he is partially unable to earn a support by reason of [?]Ceracea[?]. That said disabilities are not due to vicious habits, and are to the best of his knowledge and belief permanent. That he has not received or applied for a pension. That he makes this declaration for thepurpose of being placed on the pension roll of the United States under the provisions of the Act of June 27, 1890. He hereby appoints J. W. Morris, of Washington D.C., his true and lawful attorney to prosecute his claim. Smith, on the 12 day of August 1862 as a Private, in Co K 132 Regt & Prvt. Co. A 99 Regt NY Infantry in the service of the United States, in the Civil War, and was honorably discharged at Salisbury N.C., on the 15 day of July 1865. That he also served no where else. That his personal description at enlistment was as follows: Height 5 feet 7 1/2 inches; complexion Light color of eyes Hazel; color of hair Brown; that his occupation was Painter that he was born July 12 1845 at Staten Island Richmond Co. NY. That he requires the regular personal aid and attendance of another person on account of the following disabilities: Ulcer on Left Leg Single Rupture, Defective Eye Sight - Hearing Very Bad. That since leaving the service he has resided at Staten Island Richmond Co. NY and his occupation has been Painter. That he is a pensioner under Certificate No. 720102. New York State. That she is the widow of Charles E. Smith who enlisted Aug 13, 1862 at Staten island New York State under the name of Charles E Smith as a Private in Co. K 132 Regt NY Infty [?] transferred to 99 Regt NY Infantry Co. A. and was honorably discharged July 15, 1865, having served ninety days or more, and was discharged for or died in service of a disability incurred in the service and the line of duty, during the Civil War. That he also served in Co. A 99 Regt NY Infntry. That she was married to said soldier Charles E. Smith, under the name of Elizabeth Burten [hard to read] Aug 30/68 at Factory Ville Richmond Co. N.Y. by Rev. Ah. H. Mead; that she had not been previously married; that he had not been previously married - neither one were ever married before they were married to each other and that neither one was ever divorced from one another but they lived together as man & wife untill soldier died ... That said soldier died Oct 27, 1922 at Richmond Co. N.Y. that she was never divorced from him, and that she has not remarried since his death. That the following are the ONLY children of the soldier under sixteen years of age, who are now living, namely: [here there are wavy lines indicating no living children under 16.] That She has not heretofore applied for pension; that said soldier was a pensioner, the number of his pension certificate being 720102. Smith, deceased, of K-132 N.Y. Inf. who died on the 27th day of October, 1922 at No. 41 Wright Avenue, Port Richmond, Richmond County, N.Y. That deponent was married to said Charles E. Smith on the 30th day of August, 1868, at West Brighton, Richmond County, N.Y. Deponent cannot remember the name of the Church where she and said Charles E. Smith were married, but the Minister's name was Rev. Mr. Mead, who is dead. The two witnesses to said marriage are also dea; in fact, all the persons who attended at said marriage are dead, and, therefore, deponent is unable to comply with paragraph 2 of form M F 53. Deponent further states that neither she nor her husband, Charles E. Smith, the soldier, were ever married before they were married to each other. Deponent and her said husband, lived together happily as husband and wife from the date of marriage until the death of said Charles E. Smith. Deponent further states that neither she nor her said husband, Charles E. Smith, were ever divorced. Deponent further states that she has not remarried since the death of her husband, Charles E. Smith, the soldier. There were 9 children of said marriage, six of whom are living, all over the age of Twenty-one years.
