Imprimis it is my Will and I Do Order that all my just and lawfull Debts and funeral charges be paid out of my personal Estate within a convenient time after my decease by my Executors here after named. Then I give and Devise unto my son Andries Smith all of my real Estate Lands Tenements and Hereditaments where I now live with the improvements thereon laying in Said town of Clarkstown in the County and State aforesaid or Elsewhere. To my said son Andries and to his heirs and assigns forever In lieu thereof, he shall pay a sum of fifteen Hundred Dollars to my three Daughters Each one fourth and one fourth thereof to my four grand children the children of my Daughter Altje Deceased formly wife of Henry Westervelt that is to say to my Daughter Anne wife of Dowa Tenure the sum of three Hundred and Seventy five Dollars on or within two years after my Decease to her and her heirs and assigns forever. To my Daughter Sarah wife of James G. Demarest and to her heirs and assigns the sum of three Hundred and Seventy five Dollars on or within two years after my Decease. To my Daughter Margaret wife of Hercules Ryder and to her heirs and assigns the sum of three Hundred and Seventy five Dollars on or within two years after my Decease and to my four Grand Children the children the children of Daughter Altje Deceased and to their heirs and assigns the sum of three Hundred and Seventy five Dollars in Equal Shares on or within two years after my Decease and if not paid when Due by my said son Andries or his heirs, then and is such case, I authorize and give my Executors hereinafter named full power and Authority to sell and dispose of so much of my land that lays on the North side of the Publick road to the amount of the said legacies and sum of fifteen Hundred Dollars or the Remainder that is unpaid when Due and therewith Discharge the legacies aforesaid. Then I give and Bequeath unto my wife Nelly the Beurow and cubbard Hic has bought and had made after our marriage to her heirs and assigns forever. Then I give and bequeath all the Residue and Remainder of my personal Estate of what kind it may be to be Equally Divided among my said three Daughters Anne, Sarah, and Margaret Each one fourth share and the Remainder one fourth part to my said four Grand Children equally all to them their heirs and assigns forever. Then it is my will that my Negro man bill shall be kept and maintained by all my said Children and Grand Children equally to have the Liberty to live by any of them he desires and lastly I constitute and appoint my friend James Demarest and Peter Taulman to be my Executors of this my Last Will and Testament hereby Revoking, Disanul and make Void all former wills and testament by me made Ratifying and Confirming this and no other to be my Last Will and Testament. I Witness sohereof I the Said Aurie Smith have hereunto set my Hand and Seal this twenty third Day of March in the year of Our Lord one Thousand Eight Hundred and twelve. Be it Remembered that on the Seventeenth Day of August In the year of our Lord one Thousand Eight Hundred and Nineteen before me Richard Blauvelt Surrogate in and for the County of Rockland came Cornelius Bogert of the town of Orange in said county and being Duly sworn and on his oath Declared that he did see Aury Smith Deceased sign and seal the written Instrument.. Then shared unto him of which the proceeding is a true copy purporting to the Last Will and Testament of the said Aury Smith bearing Date the Twenty third Day of March in the year of our Lord one Thousand Eight Hundred and twelve and heard him Publish and heard him publish and Declare the same as and for his Last Will and Testament that at the time thereof he Hic. Said Aury Smith was of a sound Disposing mind and memory to the best of the knowledge and belief of him the Deponent and that he together with Peter Van Blarcom and James I.
