Wanamaker and Hannah Wanamaker the sole executor and executrix named in the last will and testament of Lawrence Wanamaker late of the town of Ramapo, Rockland County, deceased, appeared in open court, before the surrogate of Rockland County, and made application to have the said last will and testament, which relates to both real and personal estate, proved; and, on such application the surrogate did ascertain, by satisfactory evidence who were the widow, heirs and next of kin of said testator, and their respective residences, and one of them appearing to be a minor and having no general guardian residing within the State of New York, a special guardian was appointed in due form of law to take care of their interests in the matter of proving the said last will, by an order entered for that purpose by said surrogate; and said surrogate did thereupon issue a citation in due form of law directed to the said widow, heirs and next of kin and special guardian by their respective names stating their respective places of residences, requiring them to appear before said surrogate, at his office in the town of Clarkstown on the twenty ninth day of August instant attend the probate of the said will. And afterwards to wit on the said twenty ninth day of August satisfactory evidence, by affidavit was produced and presented to said surrogate of the service of the said citation in the mode prescribed by law; and, on that day, no one appearing to oppose the probate of such will, such proceedings were thereupon had afterwards that the surrogate took the proof of said will hereinafter set forth upon this twenty ninth day of August in the year one thousand eight hundred and fifty nine and he adjudged the said will to be a valid will of real and personal estate, and the proofs thereof to be sufficient, which said last will and testament and proofs, are as follows, that is to say: Will In the name of God Amen, I, Lawrence Wanamaker of the town of Ramapo in the county of Rockland and state of New York do make publish and declare this my last will and testament, in manner and form following. First I resign my soul into the hands of Almighty God, hoping and believing in a remission of my sins by the merits and mediation of Jesus Christ. And my body I commit to the earth to be buried at the discretion of my executors. And my worldly estate I give, devise and bequeath as follows. First I order and direct my Executrix and my Executor hereinafter to pay all my just debts, testamentary and funeral expenses out of my personal estate. Item, I give and devise unto my beloved wife Hannah, all my mesuage or tenement and the appurtenances where I now reside situate and being in the town of Ramapo county of Rockland and state of New York together with the land and hereditaments thereunto belonging; bounded as follows: Beginning at the Northeast corner of said lot at the stump of a white oak sapling with a heap of stones around it and in the southwest corner of the late Peter H. Frederick deceased, and now James J. Wanamaker, and in the line of land of John Hennion thence (1) North forty four degrees and fifty minutes west seventeen chains and fifty three links to a stake and stone heap in the line of the said Peter H. Frederick deceased (2) South twenty degrees west twenty three chains and thirteen links to a stake and stone heap in the line of Samuel W. Coe (3) South sixty eight and one quarter degrees west, six chains and five links to a stake standing in the corner of lands of Samuel W. Coe and John Henion (4) South sixty three degrees east four chains and seventy links to a stake and heap of stones in the corner of lands of John Hennion and thence (5) North thirty eight and one half degrees East seventeen chains and thirty five links to the place of Beginning containing twenty seven acres and the rents issues and profits thereof for and during the widowhood of my said wife and from and after her remarriage or death it is my will and I so hereby order my Executor to sell for the best price he can obtain either at public or private sale the lands and tenements and hereditaments thereunto belonging and out of the monies arising from said sale to pay my grand son Daniel son of my daughter Hannah Maria deceased the sum of two hundred dollars should he have arrived at the age of twenty one years and in case he should die before he shall obtain his majority then and in that case the said sum of two hundred dollars shall be equally divided between my four sons Peter L. Wanamaker, Abraham L. Wanamaker, Henry L. Wanamaker and Lawrence B. Wanamaker their heirs or assigns. And the balance of the money arising from said sale together with all the rest and residue of my estate, both real and personal and of whatever nature of kind soever I give and bequeath unto my four sons above named and their heirs and assigns forever share and share alike and lastly I hereby constitute my dearly beloved wife Hannah and my affectionate son Abraham L. Wanamaker my sole executrix and executor of this my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal the eighteenth day of July in the year of our Lord one thousand eight hundred and fifty nine. Lawrence Wanamaker (L.S.) The above instrument consisting of one sheet was now here subscribed by Lawrence Wanamaker the testator in the presence of each of us and was at the time declared by him to be his last will and testament and at his request sign our names hereto as attesting witnesses John Hennion residing in Ramapo Rockland County, Thomas W. Howell residing in Ramapo Rockland County, In the matter of proving the last will and testament of Lawrence Wanamaker deceased Rockland County ??, Be it remembered that on twenty ninth day of August in the year one thousand eight hundred and fifty nine that Edward Pye surrogate of the said county personally appeared Thomas Howell who being by the said surrogate duly sworn and examined doth depose and say that this deponant was well acquainted with Lawrence Wanamaker deceased that he was present as a witness and did see the said Lawrence Wanamaker deceased subscribe at the end thereof the instrument now produced and shown to the deponant purporting to be the last will and testament of the said Lawrence Wanamaker deceased bearing date the eighteenth day of July in the year one thousand eight hundred and fifty nine that such subscription was made by the said testator at the same time declared the instrument so subscribed by him to be his last will and testament whereupon this deponant signed his name at the end thereof at the request of the said testator and that the said testator at the time of executing and publishing the said last will and testament was of full age, of sound mind and memory and not under any restraint.
