At the Surrogates Court held in and for the county of Saratoga, at the Surrogates office, in the Village of Saratoga Springs, on the 17th day of February, 1887. Present, Elias H. Peters, Surrogate; Be it remembered, that at the Surrogates Court, held in and for the County of Saratoga, at the Village of Saratoga Springs, on the 17th day of February, 1887, Daniel Huestis of the town of Stillwater in the county of Saratoga, aforesaid, the person named as executor in a certain instrument in writing, purporting to be the last Will and Testament of Catherine Huestis; and Phebe Bishop of the same place, appeared and presented said Will and made application to have the same admitted to probate forthwith; and at the same time made satisfactory proof, that the said Catherine Huestis died on or about the 30th day of January, 1887, being at the time an inhabitant of said County of Saratoga, and that she left her surviving, your petitioners, who are the only heirs-at-law of the deceased, and thereupon no one opposing, the said Will was shown to the attesting witnesses thereto, and the proof was taken as follows; Saratoga County, SS. George W. Neilson and Lusina Neilson of the Town of Stillwater in the County of Saratoga, being first duly sworn in open court, on their oaths, do depose and say, that they are subscribing witnesses to the last Will and Testament of Catherine Huestis, late of the town of Stillwater, in the County of Saratoga, aforesaid, deceased. And these deponents further say, that the said deceased did, in the presence of these deponents, subscribe her name at the end of the instrument which is now shown to these deponents, and which purports to be the last Will and Testament of the said deceased, and which bears date on the 8th day of July in the year one thousand eight hundred and eighty four, that the said deceased did, at the time of subscribing her name to said instrument as aforesaid, declare the same to be her last Will and Testament; that these deponents did thereupon subscribe their own names at the end of said instrument as attesting witnesses to the execution thereof, at the request of the said deceased, and in her presence, and in the presence of each other. That the said deceased, at the time of subscribing her name to said instrument as aforesaid, was upwards of twenty-one years of age; that she appeared to be of sound mind and memory and was not under restraint, to the knowledge or belief of these deponents. Subscribed and sworn this} George W. Neilson 17th day of February, 1887, before me} Lusina Neilson E. H. Peters, Surrogate And it appearing from the proof so taken that the said instrument was duly executed and that the said testatatrix [testatrix] was at the time of executing the same in all respects competent to devise real estate and was not under restraint, and our said Surrogate having inquired into the facts, and circumstances, and being satisfied of the genuineness and validity of said instrument, and no objection being made thereto, it is ordered, adjudged and decreed, that the said instrument be and is admitted to probate as and for the last Will and Testament, of the said Catherine Huestis, deceased, valid to pass both real and personal estate; and it is further ordered, that said Will be recorded with the proof thereof, which proof is herein before recorded, and said Will is in the words and figures following, to wit:- I Catherine Huestis of the town of Stillwater, County of Saratoga, and State of New York, being of a sound mind and memory, do make, publish and declare, this to be my last Will and Testament, in the manner following: First, my Executor hereinafter named shall after my decease pay all my funeral expenses, also all my just debts. Second: I give unto my daughter Phebe Bishop, all my household furniture, of every name and nature, including silver ware; also one hundred dollars. Third: I give unto my son Daniel Huestis, and my daughter Phebe Bishop, the remainder of my personal property, that I may have or left after my decease to be divided equally between them. Fourth: I hereby nominate and appoint my son Daniel Huestis to be the Executor of this my last Will and Testament, hereby revoking all former Wills by me made. In witness whereof I have hereunto subscribed my name and seal this 8th day of July 1884. in presence of - Catherine Huestis L.S. The above instrument was subscribed by the said Catherine Huestis, in our presence, and acknowledged by her to each of us, and she at the same time declared the above instrument, so subscribed, to be her last Will and Testament, and us at her request, have signed our names as witnesses hereto, and written opposite our names our respective places of residence.
