Peters - Surrogate - Be it remembered that at a Surrogates Court held in and for the County of Saratoga at the village of Saratoga Springs on the 29th day of September 1891, Drayton Strang of Stillwater in the County of Saratoga aforesaid, one of the persons named as executor in a certain instrument in writing purporting to be the last Will and Testament of Ira Strang, bearing date July 9, 1888 duly appeared and presented said will for probate and at the same time made satisfactory proof that the said Ira Strang died on the 31st day of August 1891 being at the time an inhabitant of said County of Saratoga, and he left him surviving his widow Ann Strang - the petitioners Drayton Strang, J. Read Strang and Edward H. Strang who are all and the only heirs-at-law and next of kin of said deceased - and thereupon a citation was issued to said heirs-at-law and next of kin citing them to appear before the said Surrogate at his office in the village of Saratoga Springs in the County of Saratoga aforesaid on the 14th day of October 1891 at 10 o'clock A. M. to attend the proof and probate of said Will. At which time and place the petitioner again appeared and returned said citation with proof of the due and legal service of the same upon all to whom directed, and presented said Will for probate - And thereupon no one opposing, said Will was shown to the attesting witnesses thereto and proof thereof was taken as follows: Saratoga County S. S.- Gabriel Strang and Thomas Miskels of the town of Stillwater in the County of Saratoga being first duly sworn in open Court on their oaths, do depose and say, that they are subscribing witnesses to the last Will and Testament of Ira Strang late of the town of Stillwater in the County of Saratoga, aforesaid, deceased. And these deponents further say, that the said deceased did, in the presence of these deponents, subscribe his name at the end of the instrument which is now shown to these deponents, and which purports to be the last Will and Testament of the said deceased, and which bears date on the 9th day of July in the year 1888, that the said deceased did, at the time of subscribing his name to said instrument as aforesaid, declare the same to be his last Will and Testament; that these deponents did thereupon subscribe their own names at the end of said instrument as attesting witnesses to the execution thereof, at the request of said deceased, and in his presence, and in the presence of each other. That the said deceased, at the time of subscribing his name to said instrument as aforesaid was upwards of twenty-one years of age; that he appeared to be of sound mind and memory, and was not under restraint, to the knowledge or belief of these deponents. Subscribed and sworn this 14th } Gabriel Strang day of October 1891, before me} Thomas Miskels E. H. Peters Surrogate - And it appearing from the proof as taken, that said instrument was duly executed, and that said testator at the time of executing the same was in all respects competent to devise real estate, and was not under restraint, and the said Surrogate having inquired into the facts and circumstances and being satisfied of the genuineness and validity of said instrument; no objection being made thereto. It is Ordered, adjudged, and decreed: that said instrument is and it hereby be admitted to probate as and for the last Will and Testament of the said Ira Strang deceased, valid to pass both real and personal estate. And it is further Ordered that said Will be recorded with the proof thereof, which proof is hereinbefore recorded and said Will is in the words and figures following, to wit: Will I Ira Strang of Stillwater, Saratoga Co. N. Y. Do make, publish and declare my last Will and Testament as follows: I give, devise, and bequeath to my two sons Drayton Strang and J. Read Strang, and to their heirs and assigns forever: all my property and estate whether real, personal, or mixed, share and share alike. And I constitute and appoint Drayton Strang and J. Read Strang executors of this my Will. Sinse [Since] this made upon the condition and with the understanding that my wife will convey to our son Edward H. Strang by will or deed the Hunt homestead farm, of which he now has the avails, and has has had the past 17 or 18 years, failing to will or deed, by neglect or otherwise, shall make this my Will void and of no effect.
