The Will of Ebnezer Davis Deceased

     This twenty secont day of July one Thousand eight hundred  I Ebenerzer
Davis of the Town and County of Saratoga and State of New York being now
favourd with a sound disposetion of mind memory do make and order this my last
will and testament and as to such things as I have been favoured with in this
life I gave devise and dispose of in the following manner and form Ferstly my
will is that all my just debts be first paid out of my Estate by my Executors
hereafter named  Secondly I give and bequeath to my beloved wife Susane Davis
the management use and income and improvement of all my Estate real and
parsonal as long as she remans my widow as her dowry  Also I gave to my Six 
Sons namely Abraham Lamul William Ebenzer John Timothy Davis all my Estate
real and parsonal to be equally devided among them after there mothers time of
inprovements is out either by death or by marriage and the legasees herein
ordered to be paid to there Sisters and three youngest brothers hereafter
named are fully paid to them Rachel Mary Lydia Anne and Ruth Davis  Also I
give and bequath to my five Daughters Twenty five Pounds a piece to be paid
each of them by my Executors at there mothers death or marriage  Also I give
to my three yongest sons each of them a Colt Lastly I constitute make and
ordain my trusty friend John Davis and Thomas Bennett and my wife Susanna
Davis my lawfull Executors to this my last will and Testament and  I do hereby 
utterly disallow ??? and disannul all other former Testaments wills bogasus
Execters by me in any were named willed ratifying this and no other to be my
last will and Testament  In witness I have hereunto set my hand and seal the
day and year here written  Ebnezer Davis  LS Signed selled publised and
pronouned and declared by me the said Ebenzer Davis as his last will and
Testament in the presents of us who in his presents and in the presents of
each other have hereunder subscrbed our names  Thomas Bennett  John Davis 
Nathaniel Sterburk 

Saratoga County SS:  Be it remembered that the Eighth day of January in the
year of our Lord one Thousand eight hundred and One personally appeared before
me  Henry Walton  Surrogate of the County of Saratoga Thomas Bennett being one
of the people called Quakers one of the subscribing witnesses to the above
written will who being duly affermed declared that he saw Ebnezer Davis
Acknowledge the signature and seal of the above written insterment purporting
to be the last will and testament of him the said Ebenezer Davis and that he
heard him publish and declare the same as and for his last will and Testament
and that at the time thereof he the said Ebenezer Davis was of sound mind 
memory and understanding to the best of his knowledge and belief and that the
name of the said Thomas Bennett subscribed to the said Will is of his own
proper hand writing and that John Davis and Nathaniel Storburk the other
subscribing witnesses to the said will were in his presence and in the
presence of the Testator when they subscribed there names as witnesses thereto
and that John Davis another of the subscribing witnesses to the above written
will being duly sworn on his oath declared that he saw Ebenezer Davis
acknowledge the signature and seal of the above written instrument purportin
to be the last will and Testament of him the said Ebenezer Davis and that at
the time thereof he the said Ebenezer Davis was of sound mind memory and
understanding to the best of his knowledge and belief and that the name of the
said John Davis subscribed to the said will is of his own proper hand writing
and that Thomas Bennett & Nathaniel Storburk the other subscribing witnesses
to the said will were in his presence and in the presence of the Testator when
they subscribed there names as witnesses thereto and be it remembered that 
on the day and year above said the above mentiond Thomas Bennett one of the 
Executors in the said will named was duly affirmd to the faithful performance
& Execution of the said will and that on the same day and year above said the
said John Davis and Susanna Davis the other Executors with said will named
were duly sworn to the faithful performance and Execution of the said will.
