Pettit and Richard Hewitt two of the executors named in a certain instrument dated December 3 1839 purporting to be the last will testament of John Pettit deceased relating to both real and personal estate appeared & offered said instrument & also another instrument annexed thereto purporting to be a codicil to the _____ bearing the same date for the probate and made satisfactory proof by affidavit which is now on file in said Surrogates office that the said John Pettit and on or about the 1st day of January 1840 that at the time of his death for several years previous thereto he was an inhabitant of the town of Greenfield in said county That he left no widow, that he left five sons to wit Charles G Pettit of the above named executors who resides in Greenfield aforesaid John Pettit and Jonathan R Pettit who reside in sterling Cayuga County William R Pettit who resides in Gortain, Ontario county and Alexander G Pettit who resides at or near Beverly in the County of Adams state of Illinois daughters to wit Polly wife of foresaid Hrsha, said Polly resides in Evanfield of in and ___ ___ in Sterling of aforesaid & Louisa A. wife of Joseph Van Patten who resides in Sterling Aforesaid the following named Grandchildren to wit Gerson ______ ____ Clairborne Carly C. Morehouse & Frederick A. Morehouse & Hannah Morehouse all of above reside in Greenfield aforesaid Hannah S Morehouse & Matilda Turner who reside in Sterling aforesaid &Elizabeth Ann Pettit who resides in the Territory of Iowa, the town &county unknown his only heirs ___ of him, that all foresaid persons are office___ ayers except said grandchildren in all of whom are minors under the age of twenty one years & have no general guardian to knowledge of said executors. And thereupon George S. Scott of Ball___ ___ having consented in writing to serve as special guardian to said several minor to take care of their interests in the premises on filing said consent it was ordained by said Govt that the said George G Scott be and he then ___was in due form of law appointed by said county official guardian to look after the above named minors to take care of their interest in the proceedings & thereupon a citation was issued pursuant to the provision of the Act Concerning the proof of will, as ___ May 16 1837. directed to each of the said heirs ___ of kind who are official ayer except said Charles G Pettit the a aforesaid Surrogate of his office in the Village of Ballson __ in said County of Saratoga on the 26th day of October 1840 at 10 Oclock AM to attend the probate of said. The Last will and Testament of John Pettit of Greenfield in the County of Saratoga and State of New York being weak in body but of sound mind and memory I give grateful thanks to my creator and my God for the same do hereby make and order this my last will and testament in ______ following that is to say. First I commit my body to the earth for a Christian burial under the direction of my executors and my Immortal part I commit to God who gave it trusting and believing in all his mercies and my worldly goods I dispose of as follows Item 1st I give and bequeath to John Pettit Jun. My son and my son- Jonathan R. Pettit each thirty acres of land being part of lot sixteen in the town of Sterling in the county of Cayuga and of which they are now in possession of and which is their full share. Item 2nd I give and bequeath to Charles G Pettit my son all the stock and movables that he received in January eighteen hundred and thirty seven amounting to five hundred dollars I also give and bequeath unto my son Charles G. Pettit one half of the farm I reside on in Greenfield aforesaid and also the other half of the said farm on the death of his sister Betsey Pettit 3rd I give and bequeath unto my daughter Betsey Pettit the one half of the farm we now reside on for and during her natural life. I also give give (sic) and bequeath unto my son Charles G. Pettit and my daughter Betsey all the bedding & household furniture that may in any way belong to me. 4th I give and bequeath unto my daughter Polly ninety dollars and to William R Pettit Two hundred dollars and to Louisa A. Pettit two hundred dollars to be taken from a bond & mortgage against Jonathan R. Pettit 5. Item and from a fund composed of a bond and mortgage against Nicholas V. Van Patten and also from a bond and mortgage against Sylvester Mines and from a note against Charles G. Pettit of seventy dollars and also from the interest on Loan office moneys paid for the said Charles G. Pettit to the Loan office and of which I make the following disposal I give and bequeath unto my daughter Polly one hundred dollars also to my grand daughter Matilda Turner on hundred dollars and to Elsey Ann Pettit the reputed daughter of my son James Pettit one hundred dollars Also to Gershum Morehouse George C Morehouse Cahrles G Morehouse and Frederick A Morehouse, sons of my daughter Sally one hundred dollars each and also to Harriet Morehouse and Maria Louisa Morehouse daughters of my daughter Sally fifty dollars each and if the said funds should not be sufficient then in proportion to eqach and also as my debts are in considerable they are to be assessed on each legate according to the bequests they respectively receive. None of the Legacies bequeathed to minors are to be paid until they become twenty one years of age but to be put and kept on interest within two years after my decease for their use and benefit And also I ordain that my son Alexander H. Pettit shall receive from the sources above mentioned or from my residuary estate the sum of fifty dollars and I do hereby appoint William R Pettit of the County of Ontario town of Gorham and Richard Heriot and Charles G. Pettit of the town of Greenfield County of Saratoga my Executors to execute this my last will and testament hereby revoking &disallowing all or any last wills and testaments hereto fore by me made Witness my hand and seal at Greenfield this fourth day of December in the year of out lord one thousand eight hundred and thirty nine John Pettit L. Cronkite, Greenfield And further as a codicil or amendment to any last will and testament I further ordain and declare that there be added to the fund for paying certain Legacies to my daughters Polly Matilda Turner Elsy Ann Pettit Gersham Morehouse George C. Morehouse Charles C Morehouse Frederick Morehouse Harriet Morehouse Maria Louisa Morehouse and Alexander H. Pettit the amount of a note due from Sylvester Mines and Jonathan R. Pettit to me of nearly ninety dollars and also of a note of hand due to me from Jonathan R.
