The submittor has given permission to the USGenWeb Archives to store the file permanently for free access. ************************************************************************ Will of Knickerbocker, Philip H Philip Knickerbocker is buried in the Whitford Cemetery, Saratoga Spa, Saratoga Co., New York The last will and testament of Philip H Knickerbocker deceased, relating to both real & personal Estate together with the proof thereof recorded the 24th day of November 1851. at a Surrogate Court held at the village of Saratoga Springs in and for the County of Saratoga on the 14th day of November 1851 Present John C Hulbert Surrogate Be it remembered that heretofore, to wit at a Surrogates Court held at the village of Saratoga Springs on the 14th day of November 1851. John Hellin an Executor named in a certain instrument dated the 25th day of October 1851. Is reporting to be the last will and testament of Philip H Knickerbocker deceased & relating to real and personal Estate, appeared and offered said instrument for probate: And the said John made satisfactory proof & by petition that the said Philip died a natural death on or about the 7th day of November 1851 that at the time of his death and for a long time previous thereto he was an inhabitant of the town of Saratoga Springs in the County of Saratoga: That he left Bessy Knickerbocker his widow and Joseph Knickerbocker & John H Knickerbocker his only heirs and next of kin: That said Joseph and John are minors under the age of twenty one years & having no general Guardian And thereupon John R Putnam consenting thereto in writing was appointed the Special Guardian of said minors to take care of their rights & interests in the matter of proving said will and thereupon a Citation was filed to the said widow & to the said Special Guardian citing them & each of them to appear before said Surrogate at his office in the village of Saratoga Springs on the 24th day of November the next at ten oclock A.M. to attend the proof & probate of said instrument. And at a Surrogates Court here at the Village of Saratoga Springs - on 24th day of November 1851, the return day of aforesaid, the said Executor again appeared & returned the said citation with proof of the due and legal service of the same on all to whom it was directed and made application to hear said instrument proved and admitted to probate & no one appearing to oppose & there upon the said instrument having been produced and shown to the attesting witnesses thereto the proof there of was taken in the words & (????) following to wit. County of Saratoga Surrogates Court In the matter of proving the last will & testament of Philip H Knickerbocker Deceased Saratoga County SS: David Davis and Harry Hiller of the town of Milton in the County of Saratoga being first duly sworn in open Court on their oaths do say, that they are subscribing witnesses to the last will and testament of Philip H Knickerbocker late of the town of Saratoga Springs in the County of Saratoga, (???) and deceased. And their Deponents further say that the said deceased did in the presence of their deponents subscribe his name at the end of the instrument which is now shown to these deponents, & which purports to be the last will & testament of the said deceased and which bears date on the 25th day of October in the year one thousand eight hundred and fifty one: That the said deceased did at the time of subscribing his name to said instrument, declare the same to be his last will and testament: that then deponents did thereupon subscribe their own names at the end of said instrument as attesting witnesses to the execution thereof at the request of the said deceased & in his presence. That the said deceased at the time of subscribing his name to said instrument as aforesaid was upwards of twenty one years of age: That he appeared to be of sound mind and memory & was not under restraint to the knowledge or belief of these deponents. David Davis, Henry Hiller. Subscribed & Sworn this 24th day of November 1851 before me. John C Hulbert Surrogate. And it appearing from the proof so taken that the said instrument was duly executed & that the (?????) at the time of executing the same was in all respects competent to (????) real estate and not under restraint, & the said Surrogate having insoever inquired particularly into the facts & circumstances and being satisfied of the genuineness & validity of the said instrument & no objections being made thereto, an is hereby ordered adjudged & decreed that the said instrument be admitted to probate as the last will & testament of Philip H Knickerbocker deceased & relating to real and personal estate: and it is further ordered that said will be recorded together with the proof thereof which said proof is (?????) before recorded: The said will is in the (???) & figures following: to wit. The last will and testament of Philip H Knickerbocker of the town of Saratoga Springs in the County of Saratoga & State of New York. I Philip H Knickerbocker of the Town of Saratoga Springs in the County of Saratoga do make and publish this my last will & testament in manner following. First I give devise & bequeath unto my beloved wife Betsey all my real & personal property of any name nature or description to have and to hold to her heirs & (????) forever - Second: I hereby appoint my wife Betsy Knickerbocker Executrix & Lorenzo Riley & John Hiller Executors of this my last will & testament hereby revoking all wills heretofore by me made. In (????) whereof I have hereunto set my hand & Seal this twenty fifth day of October in the year of our Lord one thousand eight hundred and fifty one Philip H Knickerbocker L.S. The foregoing written Instrument declared the (???) to be his last will & testament & requested us to sign our names as attesting (?????) thereto We (?????) by signing our names as said (????) in his presence and in presence of each other.
