I, THOMAS SALISBURY of STILLWATER in the County of SARATOGA being weak in Body but of perfect Mind and Memory Thanks be to Almighty God for the same, and considering the uncertainty of this mortal life do after commending my Soul to God who gave it, dispose of such earthly estate wherewith He has Blessed me, in manner following, to wit, after my decease I give devise and bequeath unto my SON OLIVER, the South part or half of my Farm to sell and dispose of in manner following, to wit, as soon as may be proper and convenient after my decease I direct that the said OLIVER shall sell said south part at public <____________> giving at least six months previous notice of said sale in public newspapers and otherwise, and the purchase money shall be distributed and paid to among the following persons as follows, to JOHN SALISBURY, the sum of five hundred dollars, to THOMAS SALISBURY JUN. , the sum of one hundred and fifty dollars, to OLIVER SALISBURY, the sum of two hundred fifty dollars, to PRESERVED SALISBURY, the sum of two hundred and fifty dollars, to ZUBA KIMBLE, the sum of two hundred and fifty dollars, to MARY WOODS the sum of two hundred and fifty dollars, to LYDIA THOMPSON two hundred and fifty dollars, and to REBECCA SALISBURY one thousand dollars, provided the same shall produce so much, if not, the above legacies to be reduced proportionally, and if it should produce more, the said sums shall be increased proportionally, and at all events, the sum of one thousand dollars shall be paid to the said REBECCA if that sum can be raised by the sale aforesaid, and, if not, then what it may. I give, devise and bequeath to her one Cherry Dining Table, one Looking-Glass, one Chest of Drawers, one good Bed and Bedding, one Side Saddle and Riding Beast which were devised t6 her by her MOTHER. I further give, devise and bequeath all the rest of my household furniture to my DAUGHTERS: ZUBA, MARY, LYDIA and REBECCA, to be equally divided among them, share and share alike. I give, devise and bequeath unto my CHILDREN above named JOHN SALISBURY, THOMAS SALISBURY, OLIVER SALISBURY, PRESERVED SALISBURY, ZUBA KIMBLE, MARY WOOD, LYDIA THOMPSON and REBECCA SALISBURY all my money, securities, farming utensils, stock on the farm and every species of property whatsoever not before disposed to be equally divided among them share and share alike after all my just debts are paid <______>, and whatever <______> are <____________> on shares or otherwise, I declare to be personal property and <______> under this clause, And also that what debts may be due from any of the above legacies on note or otherwise, are to be considered due from them, not discharged by anything herein contained and that the south part heretofore mentioned to be sold, is all my land not included in PRESERVED SALISBURY'S deed. Being duly sworn on their oaths, declare and say that they heard and saw THOMAS SALISBURY sign, seal, publish and declare an instrument in writing purporting to be his Last Will and Testament and that at the time thereof the said THOMAS SALISBURY was of sound mind, memory and understanding according to the best of their knowledge and belief and that the names of the said STEPHEN SOUTHWARD and GEORGE PALMER JUN. is of their own respective proper handwriting and that they subscribed their names to the said instrument as witnesses to the execution thereof in the presence of the Testator and in the presence of each other and that they saw WILLIAM TALLMADGE and BRADFORD FREEMAN subscribe their names as witnesses to the said will also in presence of the said Testator and be it further remembered that on the day and year above mentioned, likewise appeared before me the said SURROGATE, OLIVER SALISBURY, the EXECUTOR named in the said will, who being duly sworn to the faithful performance and execution of the said will by taking the oath of an executor.
