And of the proof there of recorded on the 24th day of October 1870. A_a Surrogate Court held at the Village of Saratoga Springs in and for the County of Saratoga on the 24th day of Octobert 1870. Present: Cornelius A. Waldrow, Surrogate. Be it remembered that as a surrogates court held on the 26th day of September 1870. Daniel C. Eggleston, the person named as Executor in a certain instrument in writing elected the 7th day of January 1870. Purpuiting to be the Last Will and Testament of Silas Eggleston, appeared and presented said Will for probate. And the same time made satisfactory proof that said Sial Eggleston died on the 7th day of September 1870. Being at the time our inhabitant of the County of Saratoga. And that he left him surviving the following persons: Lucy Eggleston, Jiram B. Eggleston and Ruth A. Clothier, all of full age, and who are all and the only heirs at law and next of kin of said deceased. And therefore a citation was issued to said heirs at law and next of kin citing them and each of them: to appear before the Surrogate at his office in the Village of Saratoga Springs in said County of Saratoga on the 24th day of October 1870 at 10 O'Clock. A.M. to attend the proof and probate of said Will and Now at this day the said Daniel C. Eggleston again appeared and returned said citation with proof of the due and legal services of the _____ on all to whom directed and made application to have said Will admitted to probate and no one opposeing, and said Will being produced and shown to the attesting witnesses that the proof thereof was taken as follows: County of Saratoga } Surrogates Court } In the matter of proving the Last Will and Testament of Silas Eggleston, Deceased. Saratoga County: Daniel B. Ide and Charles Adams of the town of Corinth in the County of Saratoga being first duly sworn in open court on their _____ do depose and rety. That they are suvserbing witnesses to the Last Will and Testament of Silas Eggleston, Late of the town of Corinth in the County of Saratoga, aforesaid, deceased, in the presence of their depu___te (deponent?) subscribe his name at the end of the instrument which is now shown to these depu____te . And which (purports?) to be the Last Will and Testament of the said deceased and which bears date of the Seventh day of January 1870. That the said deceased did at the time of subscribing his name to said instrument as aforesaid declare the same to be his Last Will and Testament. That these electives did, therefore subscribe their own names at the end of said instrument as attesting witnesses to the execution thereof at the request of the said deceased. And in his presence, and in the presence of each other. That the said deceased at the time of subscribing his name to said instrument as aforesaid, was upwards of twnty one years of age, that he appeared to be of sound mind and memory and was not under restraint to the knowledge or belief of these deponents. D. B. Ide, Charles Adams. Subrscibed and Sworn this 24th day of October 1870 before me. C. A. Waldrow Surrogate And is appearing from the proof so taken that said instrument was duly executed and that said testator was at the time of executing the same in all respects to devide real estate and not under restraints. And the said Surrogate having inquired into the the facts and circumstances. And being satisfied of the validity of said instrument. And no objective being made thereto, it is ordered, adjudged and decreed that said instrument be the admitted to probate as and for the Last Will and Testament of Silas Eggleston, deceased. And it is further ordered that said Will be recorded with the proof thereof which said proof is herein before recorded and said Will is in the words and figures following, to wit: "know all men by these present that I, Silas Eggleston, of Corinth, Saratoga County, New York, considering the uncertaintly of life and being of sound mind and memory do make, declare and publish this, my Last Will and Testament. First, I give and bequeath unto my wife, Lucy, the use, improvements & income of my dwelling house, our buildings, lands and their appurtenances to have and to hold the same to her. For and during her natural life. Together with all of my personal property, consisting of money, notes, mortgages, (sl__k?) on the farm, farming tools and utensils. Second, my daughters Lydia Ann and Ruth are to have a home with my wife , Lucy, as long as they remain unmarried. Third: At the death of my wife, Lucy, I give to my daughters the entire household furniture to be divided equal. Also one cow each. Fourth: I give on the death on my wife, Lucy, one cow to my grand daughter (that is, Lydia Ann's daughter). Fifth: At the death of my wife, Lucy, I give all the remainder of my property to my children Daniel C., Hiram B., Lydia Ann and Ruth to be divided equally between the four. Sixth: I do nominate my son Daniel C. Eggleston and my daughter Lydia Ann to be the executors of this, my Last Will and Testament subscribed my name and set my seal this Seventh day of January 1870.
