At a surrogate court held at the village of Schuylerville in and for the County of Saratoga on the 4th day of May 1880. Present Elias H Peters Surrogate Be it remembered that at a Surrogate Court held at the village of Saratoga Springs in and for the County of Saratoga on the 5th day of March 1880 Mary Larmouth of the town of Saratoga in Saratoga County the person named as executrix in a certain instrument in writing dated February 14th 1872 and purporting to be the last will and testament of John G. Larmouth appeared and presented said will for probate and at the same time made satisfactory proof that the said John G. Larmouth died on the _____ day of ____ 18__ (these dates are blank in the original document) being at the same time an inhabitant of the said county of Saratoga and that he left him surviving his widow Mary Larmouth, William Larmouth, Brill Larmouth, Martha V. Larmouth, Frances Larmouth, Ida Larmouth, Mary E. Angell, Agnes A. Angell and John A. Larmouth who are all and the only heirs at law and next of kin of the said deceased. And in whereupon a citation was issued to the said heirs at law and next of kin citing them to appear before said surrogate at the office of Samuel Wells Esq in the Village of Schuylerville aforesaid in the 4th day of May 1880 at 10 O'clock AM to attend the proof and probate of said will. At which time and place the said petitioners again appeared and returned said citation with proof of the due and legal service of the same upon all to whom divided and the said petitioner to probate and no one opposing the said will was shown to the attesting witnesses thereto and the proof was taken as follows: Saratoga County SS. Samuel Wells and Samuel Sheldon of the Town of Saratoga in the county of Saratoga being first duly sworn in open court in their oaths do depose and say that they are subscribing witnesses to the last will and testament of John G. Larmouth late of the town of Saratoga in the County of Saratoga aforesaid deceased. And these deponents further say that the said deceased did in the presence of these deponents subscribe his name at the end of the instrument which is now shown to these deponents and which purports to be the last will and testament of the said deceased and which bears date on the 14th day of February in the year 1872, that the said deceased did at the time of subscribing his name to said instrument as aforesaid declared the same to be his last will and testament that these deponents did thereupon subscribe their own names at the end of said instrument as attesting witnesses to the execution thereof at the request of the said deceased and in his presence and in the presence of each other that the said deceased at the time of subscribing his name to said instrument as aforesaid was upwards of twenty one years of age; that he appeared to be of sound mind and memory and was not under restraint to the knowledge or belief of these deponents. Saml Wells Saml Sheldon Subscribed and sworn this 4th day of May 1880 before me E H Peters Surrogate And it appearing from the proof so taken that said instrument was duly executed and that the said testator was at the time of executing the same in all respects competent to devise real estate and not under restraint and the said surrogate having inquired into the facts and circumstances and being satisfied of the genuineness and validity of said instrument and no objection being made there to. It is ordered, judged and decreed that said instrument be admitted to probate and for the last will and testament of the said John G. Larmouth deceased And it is further ordered that sand will be recorded with the proof thereof which proof is hereuntofore recorded and said will is in the words and figures following to writ: Will In the name of God Amen I John G. Larmouth of the Town and County of Saratoga and the state of New York aged twenty-one years and upwards and being of sound disposing mind and memory do make and publish this my last will and testament in the manner following that is to say: First I give and devise to my son John A. Larmouth a strip of land in the rear part of the dwelling house and lot in the south east corner of Broad and Saratoga Streets in the Village of Schuylerville in which I now live said strip of land being thirty three feet in width and extending from the ally on the east to a point seventy-five feet west from the western boundary of said ally and is bounded North by Saratoga Street and East by said ally. Second I give devise and bequeath all the rest, residue and remainder of my estate, real and personal to my beloved wife Mary Larmouth for and during her natural life to be received by her in lieu of dower or other interest she may have in my estate and from and after her death, I give and devise and bequeath the same to my five daughters Mary E. Larmouth, Martha V. Larmouth, Agnes Larmouth, Frances Larmouth and Ida Larmouth share and share alike as tenants in common. Lastly I do hereby nominate and appoint my wife Mary Larmouth executrix and my son John A. Larmouth and son-in-law Alfred Angell executors of this my last will and testament hereby revoking all previous wills by me made. In witness whereof I have hereunto set my hand and seal this 14th day of February A D. 1872. John G. Larmouth L L We whose names are hereto subscribed do certify that John G. Larmouth tae testator subscribed his name to this instrument in our presence and in the presence of each of us and at the same time he declared in our presence and hearing that the same was his last will and testament and requested us and each of us to sign our names thereto as witnesses to the execution thereof and which we have done accordingly in the presence of the testator and of each other the day of the date of the said will. Larmouth late of the town and county of Saratoga deceased relating to real and personal estate together with the proof thereof. Recorded on the 4th day of May 1880. EH Peters Surrogate Additional Comments: I believe this to be the will of John G. Larmon even though it says Larmouth. I base this on dates, names of children and the fact that I have found John G. Larmon listed as Larmouth o other documents.
