At a Surrogate Court, held in and for the County of Saratoga at the Surrogate's office in the village of Ballston Spa on the 7th day of January 1885. Present Elias H. Peters, Surrogate. Be it remembered that at a Surrogate's Court held in and for the county of Saratoga at Ballston Spa on the 3rd day of December 1884, Squire Crandall of the town of Milton in Saratoga County aforesaid, the person named as executor in a certain instrument in writing purporting to be the last Will and Testament of Betsey Crandall, appeared and presented said Will for probate, and at the same time made satisfactory proof that the said Betsey Crandall died on the 10th day of October 1883, being at the time an inhabitant of said county of Saratoga, and that she left her surviving, the petitioner her husband Squire Crandall, and William Pier who is all and the only heir at law and next of kin of the said deceased; and thereupon a citation was issued to the said heir at law and next of kin, citing him to appear before said Surrogate at his office in the village of Ballston Spa aforesaid, on the 7th day of January 1884, at 10 o'clock in the forenoon to attend the proof and probate of said Will; at which time and place the said petitioner again appeared and returned said citation with proof of the due and legal service of the same upon him to whom directed, and the said petitioner produced said Will and made application to have the same admitted to probate and, no one opposing, the said Will was shown to the attesting witnesses (unreadable) and the proof was taken as follows: Merritt J. Esmond and Ira R. Tucker of the village of Ballston Spa in the county of Saratoga being first duly sworn in open court on their oaths, do depose and say that they are subscribing witness as to the last Will and Testament of Betsey Crandall, late of the town of Milton in the county of Saratoga aforesaid, deceased. And these deponents further say that the said deceased did, in the presence of these deponents, subscribe her name at the end of the instrument which is now shown to these deponents, and which purports to be the last Will and Testament of the said deceased, and which bears date on the ninth day of February in the year one thousand eight hundred and eighty-one; that the said deceased did at the time of subscribing her name to said instrument as aforesaid, declare the same to be her last Will and Testament; that these deponents did thereupon subscribe their own names at the end of said instrument as attesting witnesses to the (unreadable) thereof, at the request of the said deceased, and in her presence, and in the presence of each other; that the said deceased, at the time of subscribing her name to said instrument as aforesaid, was upwards of twenty-on years of age; that she appeared to be of sound mind and memory, and was not under restraint to the knowledge of belief of these deponents. Subscribed and sworn this 7th day of January 1884, before me: Merritt T. Esmond Ira R. Tucker E. H. Peters, Surrogate. And it appearing from the proof so taken that said instrument was duly executed, and that the said testatrix was, at the time of executing the same, in all respects competent to devise real estate, and was not under restraint, and our said Surrogate having inquired into the facts and circumstances, and being satisfied of the genuineness and validity of said instrument, and no objection being made thereto: It is ordered, adjudged and decreed that said instrument be admitted to probate as and for the last Will and Testament of the said Betsey Crandall, deceased. And it is further ordered that said Will be recorded with the proof thereof, which proof is hereinbefore recorded, and said Will is in the words and figures following, to wit: "In the Name of God, Amen I, Betsey Crandall of the town of Milton, Saratoga County and state of New York being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last Will and Testament, that is to say: First After all my lawful debts are paid and discharged, I give and bequeath to my husband Squire G. Crandall all of my property both real and personal of whatever kind or nature. And I hereby further will and direct that my executor herein after designated shall have full power and authority to sell and convey any and all real estate that may be in my name at the time of my death as he may elect. Likewise, I make, constitute and appoint Squire G. Crandall to be executor of this my last Will and Testament, hereby revoking all former Wills by me made. For Witness Whereof, I have hereunto subscribed my name and affirmed my seal, the Ninth day of February in the year of our Lord one thousand eight-hundred and eighty-one. Betsey Crandall The above written instrument was subscribed by the said Betsey Crandall in our presence and acknowledged by her to each of us; and she at the same time declared the above instrument, so subscribed, to be her last Will and Testament; and we at her request, have signed our names as witnesses hereto in her presence and in the presence of each other, and written opposite our names our respective places of residence.
