Recorded Dec. 17, 1890 At a Surrogates court held in and for the County of Saratoga at the Surrogates Office in the village of Mechanicville on the 17 day of Dec 1890 Present Elias H. Peters, Present Be it remembered that at a Surrogates Court held in and for the County of Saratoga in the Village of Mechanicville on the 17th day of December 1890 Eliza A. Knight, Emma E. Close and Albert E. Knight appeared and presented for probate a certain instrument in writing purporting to be the last will and testament of Alonzo Knight deceased, and made application to have the same admitted forthwith. And at the same time made satisfactory proof that the said Alonzo Knight died on or about the 14th day of November 1890 being at the time an inhabitant of said County of Saratoga and that he left him surviving Eliza A. Knight, Emma E. Close and Albert E. Knight who are all and the only heirs at law and next of kin of said deceased and no one opposing said will _______ to the attesting witnesses thereto and the proof was taken as follows: Saratoga County, ss: Lewis Howland and Daniel S. Douglas of the Town of Stillwater in the County of Saratoga being first duly sworn in open court on their oath do depose and say that they are subscribing witnesses to the last will and testament of Alonzo Knight late of the town of Halfmoon in the County of Saratoga aforesaid deceased. And these deponents further say that the said deceased did in the presence of these deponents subscribe his name at the end of the instrument which is now shown to those deponents and which purports to be the last will and testament of the said deceased, and which bears date on the 19th day of October in the year one thousand eight-hundred and ninety, that the said deceased did at the time of subscribing his name to said instrument as aforesaid declare the same to be his last will and testament, that these deponents did thereupon subscribe their own names at the end of said instrument as attesting witnesses to the execution thereof, that at the request of the said deceased, and in his presence, and in the presence of each other. That the said deceased at the time of subscribing his name to said instrument aforesaid was upwards of twenty-one years of age, that he appeared to be of sound mind and memory, and was not under restraint to the knowledge and belief of these deponents. Douglas And it appearing from the proof as taken that the said instrument was duly executed and that the said Testator was at the time of executing the same in all respects competent to devise real estate and was not under restraint and on said Surrogate having inquired into the facts and circumstances and being satisfied as to the genuineness and validity of said instrument and no objection being made thereto it is ordered, adjudged, and decreed that the said instrument be and is admitted to probate as and for the last Will and Testament of Alonzo Knight, deceased, valid to pass real and personal estate and is further ordered that the said will be recorded with the proof thereof. Which proof is hereinbefore recorded and said will is in the words following, to wit. Will In the name of God Amen- I, Alonzo Knight, of the town of Halfmoon in the County of Saratoga and State of New York and being of sound mind and memory do make publish and declare this my last Will and Testament in manner following that is to say: First, My will is that all my just debts and funeral expenses shall by my executrix and executor hereinafter named be paid out of my estate as soon after my decease as shall by them be found convenient excepting however a certain indenture of mortgage executed by myself and wife, since deceased to one Philo Hall on the 1st day of April AD 1882. And by the executors of the last will and testament of the said Philo Hall deceased duly assigned to my personal beloved wife Eliza A. Knight on the 1st day of April AD 1887 which said mortgage was given for the purpose of securing the payment of the sum of $1,000 and interest at the time and in the manner therein specified. This mortgage I do not wish or expect my said Executrix and Executor hereinafter named to pay, only to pay the accrued interest that may be due on said mortgage at the time of my decease. Second, After the payment of my just debts and funeral expenses and interest as aforesaid, I give and devise and bequeath to my beloved wife Eliza A. Knight all the rest residue and remainder of my personal estate, goods and chattels of what nature or kind soever to have and to hold the same to her and her executors, administrators and assigns forever. I also give and bequeath to her my said wife Eliza A. Knight, the use, improvement and income of all that tract or parcel of land with the building thereon, situate in said town of Halfmoon in the County and State aforesaid, being the farm on which I now reside, and bounded as follows, viz: On the north by land of J. W. Ensign and M. Degraff; on the west by said Degraff land; on the south of W. Mayhew and others; and on the east by land of the estate of Elias Sternberg and the highway containing about 94 acres of land-together with all the ___________ and appurtenances thereunto belonging or in any wise appertaining, to have and to hold the same to her for and during her natural life. Said described premises being willed to my said wife, subject to the payment by my said wife of all taxes that may be laid, charged, imposed, and assessed on said premises from and after my decease. And I hereby declare the said gift to my wife is intended to be, and is so given to her in full satisfaction and recompense of and for her dower and _______ which she may or can in anywise claim of demand out of my estate and shall be received by her as such. Third, after the decease of my said wife Eliza A. Knight I give and devise and bequeath to my daughter Emily Close, wife of William Close the sum of Five Hundred dollars to be paid to her out of my estate within one year after the decease of my said wife. Fourth, I give, devise and bequeath to my son Albert E. Knight the reversion or remainder of my said farm situate in said town of Halfmoon, and being the same premises as previously bounded and described in the second item of this my last Will and Testament together with all the ___________and appurtenances thereunto belonging or in any wise appertaining and all profit income and advantage that may result therefrom, from and after the decease of my said wife Eliza A. Knight to have and to hold the same to him the said Albert E. Knight his heirs and assigns, from and after the decease of my said wife Eliza A. Knight to his and their use and behalf forever subject however to my said son Albert E. Knight, or his heirs, paying the full amount of principal and interest due on the aforesaid mortgage, and also paying the aforesaid legacy so bequeathed to my said daughter Emily C. Close, within gone year after the decease of my said wife Eliza A. Knight. Lastly, I hereby nominate constitute and appoint my said wife Eliza A. Knight Executrix and my son Albert E. Knight Executor of this my last Will and Testament, hereby revoking all former wills by me made. In witness where of I have hereunto set my hand and seal this 19th day of October in the year of our Lord one thousand eight hundred and eighty-nine.
