Saratoga County, New York HOWARD, Harris - Corinth Vol 34 page 311 WILL OF HARRIS HOWARD OF CORINTH, NY The last will and testament of Harris Howard late of the town of Corinth in the county of Saratoga, deceased, relating to both real and personal estate. Admitted to probate Sept. 12, 1894, at a surrogate court held in and for the county of Saratoga at the Surrogate's office in the village of Saratoga Springs Sept. 12, 1894. Present Elias H. Peters. Surrogate. Be it remembered that at a Surrogate's Court held in the county of Saratoga at the village of Saratoga Springs on the 4th day of August, 1894, Daniel B. Ide of the town of Corinth in the county aforesaid, a person named as executor in a certain instrument in writing purporting to be the Last Will and Testament of Harris Howard, dated March 5th, 1884, duly appeared and presented said Will for probate, and at the same time made satisfactory proof that the said Harris Howard died on or about July 24th, 1894, being at the time an inhabitant of Saratoga County, and that he left him surviving the following only heirs at law and next of kin, viz Aseneth Howard, his widow, Harriet Shipper, Amanda Gallup, Richard Howard, Marion Dewire and & Laura Dewire. Thereupon a citation was issued to them citing them to appear before our said Surrogate at his office in the village of Saratoga Springs in the County aforesaid Sept. 12, 1894 to attend the proof and probate of said will. At which time and place the petitioner again appeared and returned said citation with proof of the due and legal service of the same upon all to whom directed. And it appearing to said Surrogate that the said Marion and Laura Dewire was an infant and had no testamentary or general guardian, Walter P Butler was duly appointed their special guardian for the sole purpose of taking care of their interest in the probate of said will. And said special guardian accepted said appointment and appeared in person at said time and place. And thereupon said Will was shown to the attesting witnesses thereto, and the proof was taken as follows: Saratoga County, ss. Daniel B. Ide and Rufus H. Eggleston residing in the County of Saratoga being first duly sworn in open court on their oaths, do depose and say that they are subscribing witnesses to the last Will and Testament of Harris Howard late of the town of Corinth in the county of Saratoga aforesaid, deceased. And these deponents further say that the said deceased did, in the presence of these deponents, subscribe his name at the end of the instrument which is now shown to these deponents and which purports to be the Last Will and Testament of the said deceased, and which bears date on the 5th day of March in the One Thousand Eight Hundred and Eighty four, that the said deceased did at the time of subscribing his name to said instrument aforesaid declare the same to be his Last Will and Testament. That these deponents did thereupon subscribe their own names at the end of said instrument as attesting witnesses to the execution thereof at the request of said deceased, and in his presence, and in the presence of each other. That the said deceased at the time of subscribing his name to said instrument as aforesaid was upwards of twenty-one years of age, that he appeared to be of sound mind and memory and was not under restraint to the knowledge and belief of these deponents. Peters Surrogate And it appearing from the proof so taken that said instrument was duly executed and that said testator at the time of executing the same was in all respects competent to devise real estate and was not under restraint, and our said Surrogate having inquired into the facts and circumstances and being satisfied of the genuineness and validity of said instrument, and no objection being made thereto, it is ordered adjudged, and decreed that the said instrument be and it hereby is admitted to probate as and for the Last Will and Testament of said deceased, valid to pass both real and personal estate. And it is ordered further: that the said will be recorded with the proof thereof, which proof is hereinbefore recorded and the said Will is as follows, to wit: Will I Harris Howard of Corinth, Saratoga County, State of New York, being of sound mind and memory do make publish and declare this my last Will and Testament in manner as follows: First I give and devise to my daughters Harriet Shipper, Amanda Gallup and Helen Dewire each the sum of Fifty dollars, each to be paid within two years after my death. Second I give and devise to my wife Aseneth the balance of my property both real and personal during her lifetime. After her death I give the entire Estate to my son Richard Howard. Should he stay on the farm and manage the same subject to his mother's wishes. I do hereby nominate and appoint my wife Aseneth and D. B. Ide to be the executors of this my last Will and Testament. Recorded Sept 12th, 1894 Transcriber's Notes: In burial and census records the deceased is listed as Horace Howard. On the death certificate his name is spelled Horriace.
