ADMITTED TO PROBATE MAY 21, 1894 AT A SURROGATE'S COURT held in and for the COUNTY of SARATOGA at the SURROGATE'S OFFICE in the VILLAGE OF SARATOGA SPRRINGS, MAY 21, 1894 Present: HON. ELIAS H. PETERS, SURROGATE BE IT REMEMBERED, that at a Surrogate's Court held in and for the COUNTY of SARATOGA at the SURROGATE'S OFFICE in the VILLAGE OF SARATOGA SPRRINGS on the 20th DAY OF APRIL 1894 NORMAN G. BRINTNALL of BOSTON, MASS, a person named as EXECUTOR in a certain instrument in writing purporting to be the Last Will and Testament of SARAH W. B. SALISBURY, dated APRIL 7, 1892 duly appeared and presented said Will for probate and at the same time made satisfactory proof that the said SARAH W. B. SALISBURY died APRIL 14, 1894 being at the time an inhabitant of said County of Saratoga and that she left her surviving the PETITIONER, and the following the only heirs at law and next of kin, all persons in being who would take a interest in any portion of her real or personal property under the provisions of said Will or otherwise and the EXECUTORS and TRUSTEES named and described therein, viz: ELSIE BRINTNALL, her COUSIN and a LEGATEE residing at SARATOGA SPRINGS, N.Y., SALISBURY her NIECE and a LEGATEE residing at TROY, N.Y., THE CONGREGATIONAL SOCIETY of SARATOGA SPRINGS, N.Y., REV. C. F. SWIFT, GEORGE PICKERING, HENRY SALISBURY, DUNCAN , , HARRIET FISHER, CELESTIA FISHER, ELIZA STONE all LEGATEES but NOT RELATIVES. Thereupon, a Citation was issued to them citing them to appear before our said Surrogate at his office in the Village of Saratoga Springs in the County aforesaid on the 30th day of APRIL 1894 to attend the proof and probate of said Will, At which time and place the petitioner again appeared and returned said citation with proof of due and legal service of the same upon all to whom directed, and further proceedings were thereupon adjourned to this day at the same hour and place, And now the petitioner again appeared and the said Will was shown to the attesting witnesses thereof and proof taken as follows: SARATOGA COUNTY SS: JAMES W. HOUGHTON and HARRY P. PENDRICK of the Town of SARATOGA SPRINGS in the County of Saratoga being duly sworn in open court on their oaths do depose and say, that they are subscribing witnesses to the Last Will and Testament of Sarah W. B. Salisbury late of the Town of Saratoga Springs, in the County of Saratoga, aforesaid, deceased, And these deponents further say, that the said deceased did, in the presence of these deponents, subscribe her name at the end of the instrument which is now shown to these deponents, and which purports to be the Last Will and Testament of the said deceased, and which bears date on the 7th day of April in the year one thousand eight hundred and ninety two: that the said deceased did, at the time of subscribing her name to said instrument as aforesaid, declare the same to be her Last Will and Testament; that deponents did thereupon subscribe their own names at the end of said instrument as attesting witnesses to the execution thereof, at the request of said deceased, and in her presence, and in the presence of each other, That the said deceased, at the time of subscribing her name to said instrument as aforesaid, was upwards of twenty one years of age; that she appeared to be of sound mind and memory, and was not under restraint to the knowledge or belief of these deponents. J. W. HOUGHTON H. P. PENDRICK Subscribed and sworn this 21st DAY of MAY 1894 E. H. PETERS, SURROGATE And it appearing from the proof so taken that said instrument was duly executed and that said testator at the time of executing the same was in all respects competent to devise real estate, and was not under restraint. And our said Surrogate having inquired into the facts and circumstances, and being satisfied of the genuineness and validity of said instrument, and no objection being made thereto, it is ordered, adjudged and decreed that the said instrument be and it is hereby admitted to probate as and for the Last Will and Testament of said deceased, valid to pass both real and personal estate. And it is further ordered that said Will be recorded with the proof thereof, which proof is hereinbefore recorded and said Will is as follows, to-wit: WILL: I, MRS. SARAH W. B. SALISBURY, being of sound mind and memory do make, ordain, publish and declare this to be my Last Will and Testament, that is to say: FIRST: After all my lawful debts are paid and discharged, I give, devise and bequeath all my property, both real estate and personal, to my BROTHER, NORMAN G. BRINTNALL with the exception of five hundred dollars to be given to my NIECE ELSEY BRINTNALL, five hundred dollars to my NIECE SALISBURY and five hundred dollars, the interest of which to be used annually for repairs and improvements to The LOT Marked BRINTNALL and SALISBURY in GREEN RIDGE CEMETERY The same five hundred dollars to be secured by the VILLAGE so that it can be used or thus appropriated continually one hundred dollars to MY CHURCH, fifty dollars to my LAST PASTOR or MINISTER, one hundred dollars to GEORGE PICKERING, my FAITHFUL HELPER The following list to be divided as follows: Large, Gold Watch to my BROTHER-IN-LAW HENRY SALISBURY, also <__________> and Clock, formerly HIS FATHER'S Silver Goblet to my NEPHEW DUNCAN - two large, silver table spoons to my SISTER-IN-LAW MRS. , gold pencil with pen and picture in the head to my SISTER-IN-LAW MRS. HARRIET FISHER my large dictionary English to SALISBURY my music books to ELSIE BRINTNALL, my ward-robe to be divided among MY DOMESTICS who have served me long and faithfully MOTHER'S beautiful work of embroidery and linen, which are in a trunk by themselves, and in no wise included in my general wardrobe to be divided or presented as loving mementoes to the CHILDREN OF MY AUNT CELESTIA FISHER with the portraits of MY UNCLE and AUNT FAN, also MY GRANDMOTHER FAN'S picture, and to my COUSIN MRS. ELIZA STONE Lincoln's cabinet beautifully framed, also five small silver tea spoons marked "E. F." Likewise, I make, constitute and appoint NORMAN G. BRINTNALL to be EXECUTOR of this my LAST WILL AND TESTAMENT, hereby revoking all former Wills by me made.
