Written as it appeared to read to me, without corrections. The Will of Isaac P Bemis The last will and Testament of Isaac P. Bemis late of the Town of Northumberland, in the County of Saratoga, decessed, relating to both real and personal estate. Admitted to probate January 29, 1897. As a Surrogates Court held in and for the County of Saratoga, at the Surrogates Office in the village of Saratoga Springs, on the 29" day of January 1897. Present: Hon. Elias H Peters Surrogate. Be it remembered that at a Surrogates Court held in and for the County of Saratoga at the village of Saratoga Springs on the 5" day of January 1897. George A Bemis of the town of Saratoga, in the County aforesaid, and Lew-At-Law of Isaac P Bemis deceased, duly appeared and presented for probate a certain instrument in writing preporting to be the last will and Testament of Isaac P Bemus dated August 27, 1881 and at the same time made satisfactory proof that the said Isaac P Bemus died December 30, 1896. Being at the time an inhabitant of said County of Saratoga, and that he left him surviving the following his only heirs-at-law and next of kin. ??? Eliza Bemis his widow, and your peritioner, and Isaac Bemis, Eliza B Carner, Eugene Sanden and William Sanden; thereupon a citation was issued to them citing them to appear before our said Surrogate at his office in the village of Saratoga Springs in the County aforesaid, on the 28" day of January, 1897. to attend the proof and probate of said will. At which time and place the petitioner again appeared and returned said Citation with proof of the due and legal service of the same upon all to whom it was directed, and thereupon further proceedings were adjourned to January 29, 1897. at the same time and place. And now on this adjourned day the petitioner again appeared, and no one opposing said will was shown to the surviving attesting witness thereto, and proof was taken as follows: Saratoga County, SS James A Fake of the Town of Northumberland, in the county of Saratoga, being duly sworn in open court, on his oath, does apose and say, that he and Aaron M Thompson are subscribing witnesses to the last Will and Testament of Isaac P Bemis late of the Town of Northumberland, in the County of Saratoga, aforesaid, deceased and these deponent further says, that the said deceased did in the presence of this deponent and said Aaron M Thompson subscribe his name at the end of the instrument which is now shown to this deponent and which purports, and which purports to be the last will and Testament of the said deceased, and which lean date on the 27" of August in the year one thousand eight hundred and eighty one; that the said deceased did at the time of subscribing his name to said instrument as aforesaid, declare the same to be his last will and testament; that deponent and said Aaron M Thompson did thereupon subscribe their own names as the end of said instrument as attesting witness to the execution thereof, at the request of said deceased, and in his presence and in the presence of each other. That the said deceased, at the time of subscribing his name to said instrument as aforesaid, was upwards of twenty-one years of age; that he appeared to be of sound mind and memory, and was not under restraint, to the knowledge or belief of these deponent.
