NY Will Book Volume 41 page 152 At a Surrogate's Court held in and for the County of Saratoga, at the Chambers of the Surrogate's Court in the Village of Saratoga Springs, on the Seventh day of August, 1906. Present. Hon. William S. Ostrander, Surrogate. Be it Remembered, that at a Surrogate's Court held in and for the County of Saratoga, at the Village of Saratoga Springs, on the Ninth day of April, 1906, Elizabeth A. Perkins of the town of Corinth, in the County of Saratoga, the person named as Executrix in a certain instrument in writing purporting to be the last Will and Testament of Elijah J. Aldrich, dated July 29, 1905, duly appeared and presented to the Court a written petition, duly verified, describing the Will setting fortht he facts upon which the jurisdiction of said Court to grant Probate thereof depends and praying that the Will might be proved and that the persons required by law might be citied to attend the Probate thereof. And Thereupon, a citation was issued to Charles Aldrich, Cora Aldrich, Joel Aldrich, Ella Green, Lewis Aldrich, Lester Aldrich, Warren Aldrich, Frances G. Aldrich, Ida Furchner, Anna E. Colbornson, Cora B. Ericson, James W. Aldrich, Sallie M. Aldrich, Eva. A. Johnson, Charlie W. Aldrich, Minnie M. Aldrich, Bertha E. Aldrich, L. J. Aldrich, D. B. Aldrich, Fred H. Aldrich, John J. Aldrich, James Aldrich, Amy Frasier, Nettie Sturdevan, Theda Lawrence, Truman S. Darling, Warren Darling, George Darling, Deborah Post, Elmer Darling, Sallie Holden, George W. Kennedy, Seth Aldrich, Joel Aldrich, Maria Dayton, requiring them to appear before said Surrogate at his office in the Village of Saratoga Springs, on the 5th day of June, 1906. And thereafter, and on the 13th day of June, 1906, the above named petitioner filed a supplement petition setting forth the facts above stated and also setting forth that since the filing of the original petition and the issuing of the citation in this matter it had come to the knowledge of the petitioner that there were other and additional parties who were required by law to be cited, and a citation was issued to said parties who are as follows: Ida Alexander, George Butler, John Butler, Jr., Dudley Butler, William Hopkins, Ornan K. Hopkins, Alfred Hopkins, Frank Shields, Bernard M. Spissman, George W. Aldrich, John Butler, Sr., John Hopkins, Daniel Shields, George Spissman, Mrs. George Aldrich, Charles Kennedy, janette Aldrich, Celestia Aldrich, Idelia Aldrich, and a waiver of the issuing and service of any citation was duly made a dfiled by william Hopkins, the persons required by law to be cited requiring them to appear before our said Surrogate at his office in the Village of Saratoga Springs on the Seventh day of August, 1906, to attend the probate of said will; at which time and place the petitioner again appeared in person and by S. M. Richards, her attorney,a nd returned said original citation with due proof of the service thereof upon all to who directed; And at the same time the place the said petitioner returned said supplemental citation with proof thereof upon all the persons to whom the same was directed requiring them to appear before our said Surrogate at his offic eint he village of Saratoga Springs in the County aforesaid on the 7th day of August, 1906, to attend the probate of said Will. And, Thereupon, no one opposing, the Surrogate caused the witnesses to said will to be examined before him and the proofs reduced to writing, which proofs were as follows: SARATOGA COUNTY:SS Solomon M. Richards and William H. Eddy both of the Town of Corinth in the County of Saratoga, New York, being duly sworn in open court, on their oaths, do depose and say that they are subscribing witnesses to the last Will and Testament of Elijah J. Aldrich late of the town of Corinth in the County of Saratoga, aforesaid, deceased. And these deponents further say, that the said deceased did, in the presence of these deponents, subscribe his name at the end of the instrument which is now shown to the deponents and which purports to be the last Will and Testament of the said deceased, and which bears date on the 29 day of July in the year One Thousand Nine Hundred and Five; that the said deceased did, at the time of subscribing his name to said instrument as aforesaid, declare the same to be his last Will and Testament; that deponents did thereupon subscribe their own names at the end of said instrument as attesting witnesses to the execution thereof, at the reques tof said deceased, and in his presence and in the presence of each other. That the said deceased, at the time of subscrbing his name to said instrument as aforesaid, was upwards of twenty-one years of age; that he appeared to be of sound mind and memory, and was not under restraint to the knowledge or belief of these deponents. Solomon M. Richards Willam H. Eddy Subscribed and sworn this 7th day of August, 1906, before me, George O. Tuck, Clerk Surrogate's Court. And, it now appearing from the proof so taken that said instrument was duly executed and that the testator at the time of executing the same was in all respects competent to make a will and was not under restraint; and our said Surrogate having inquired particularly into all the facts and circumstances, and being satisfied of the genuineness of the willand the validity of its execution, and no objection being made thereto, It is ordered, adjudged and decreed, that said instrument be and tit is hereby admitted to pronate as and for the lat Will and Testament of the said deceased, valid to pass both real and personal property and that Letters Testamentary be issued to the Executrix named in said Will upon her qualifying as provided by law. And it is further ordered, that said Will be recorded with the foregoing proof thereof which said Willis as follows, to wit: In the Name of God, Amen: I, Elijah J. Aldrich of Corinth, Saratoga County, New York, being of sound mind and memory, and considering the uncertainty of this life, do therefore make, ordain, publish and declare this to be my last WILL and TESTAMENT, that is to say: First - After all my lawful debts are paid and discharged, I give and bequeath unto my namesake Elijah J. Aldrich the sum of $100. Second I give devise and bequeath unto Joel Aldrich who has lived so many years with the use income and profits of Farm on which I formerly lived in Town of Corinth, N.Y. during period of his natural life. Third, I give, devise bequeath unto my niece Jennie VanRensselaer the sum of $100. Fourth all the rest residue and remainder of my property both Real and personal I give devise and bequeath unto Elizabeth A. Perkins with who I now reside. Likewise, I make, constitute and appoint said Elizabeth A. Perkins to be executrix of this, my last Will and Testament, hereby revoking all former Wills by me made. In Witness Whereof, I have hereunto subscribed my name and affixed my seal, the 29th day of July in the yar one thousand nine hundred and five. E. J. Aldrich (L.S.) Witnesses, The above instrument, constiting of one sheet, was at the date thereof, subscribed by Elijah J. Aldrich the Testator named int he foregoing Will, in the presence f us and each of us, and at the timeo fmaking such subscription, the above instrument was declared by the said Testator to be his last Will and Testament, and each of us, at the request of said Testator and in his presence and in the presence of each other, sign our name as witness thereto at the end of the will. Tuck, Clerk of the Surrogate's Court in and for said County, do hereby certify the foregoing to be a true and correct record of the last will and testament of elijah J.
