The submittor has given permission to the USGenWeb Archives to store the file permanently for free access. ************************************************************************ Will of Jonas Titus Jonas Titus of Stillwater in Saratoga County having made his will by which he appointed his wife Rhoda Titus his Executrix there to which said will having been proved and the said Rhoda having taken the usual Oaths letters Testamentary were this second day of November 1795 granted to her which said will with the proof thereof and the letters Testamentary there are in the words following [ ] This fourth Day of August one thousand seven hundred and ninety five Jonas Titus of the Town of Stillwater and county of Saratoga and State of New York being favored with a sound disposition of mind and Memory Do make and order this my last will and Testament and as in such things and have been favored with in this life give Devise and dispose of in the following manner and form first my will is that all my just debts be paid out of my Estate by my Executor hereinafter named secondly I give and bequeath to my beloved wife Rhoda Titus one third of my estate I Likewise give her the household furniture except one Bed and Bedding to Polly Titus I likewise give to her one horse and saddle and two cows as long as she remains my widow at her Death or marriage the horse and cows to be given to my three sons equally divided and the saddle to Polly Also I give to my two sons John and Zadock Titus all the remainder of my Estate to be equally divided excepting thirty and seven pounds John has already received Therefore Zadock's Legacy is to exceed John's to that amount their Legacies to be paid to them at the time they are twenty one years old at the time that Polly is eighteen years old [they] are to give to her one cow and six sheep and my son Jonas Titus is to be brought up out of the Estate and to have schooling to learn him to read write and [cipher] so far as the rule of three by the time he is [fourteen]Years old and if he has then a mind to learn a trade [ ]He [shall] have the privilege and at the time he is twenty one years old John and Zadock [are] to give him twenty five pounds each lastly I constitute order and ordain my wife Rhoda Titus my lawful Executor to this my last will and Testament and I do hereby utterly disallow revoke and disapprove all and every other former Testament will legacies bequeaths and Executors by me in anywise named ratifying this and no other to be my last will and Testament In witness whereof I have hereunto set my hand and seal the day and year above written. Signed Sealed Published and pronounced and disclosed by the said Jonas Titus as his last will and Testament in this the presence of us who in his presence and in the presence of each other have hereunto subscribed our names Jonas Titus (seal) Zebulon Mott Thadeus Histead Daniel Cook Saratoga County Be it remembered that on the Thirty first day of October in the year of our Lord one thousand seven hundred and ninety five personally appeared before me Henry Walton Surrogate of the said County Zebulon Mott one of the subscribing witnesses to the above written will who affirmed (being one of the description of persons called Quaker) that he [saw] said Jonas Titus sign and seal The above instrument in writing purporting to be the last will and Testament of Jonas Titus and that he heard him publish and Declare the same as and for his last will and Testament and that at the time thereof the said Jonas Titus was of sound Mind Memory and understanding to the best of his knowledge and belief and that his name subscribed to the said will is of his own proper hand writing that he saw Thadeus Histead and Daniel Cook the other witnesses thereto, subscribe their names as witness in the presence of the Testator And be it further remembered that on this second Day of November in the same year personally appeared before me Henry Walton as aforesaid Thadeus Histed another witness for the said will who being duly sworn on his oath declared that he saw Jonas Tutus sign and seal the said instrument in writing and that he heard him the said Jonas Titus publish and declare the same as and for his last will and Testament and that at the time thereof the said Jonas Titus was of sound Mind Memory and understanding to the best of his knowledge and belief and that his name subscribed to the said will is of his own proper handwriting and that he saw Zebulon Mott and Daniel Cook the other witness thereto subscribe their names as witness in the presence of the Testator and be it further understood that on the said Thirty first Day of October personally appeared before me the said Henry Walton surrogate as aforesaid Rhoda Titus Executrix named in the said will and was duly sworn to the faithful performance and execution of the said Will Henry Walton The people of the state of New York by the Grace of God free and Independent To all whom these presents shall come or may concern, send greeting Know ye That at the Town of Ballstown in the County of Saratoga on the thirty first Day of October last and on the second day of November instant before Henry Walton Esq Surrogate of our said County the last will and Testament of Jonas Titus of the town of Stillwater deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us and the said deceased having wilst he lived and at the time of his death goods chattels or credits within this state by means whereof the proving and registering the said will and the granting Administration of all and singular the said goods chattels and credits and also the [ ] and final discharging the [ ]wife in the administration of all and singular the Goods Chattels and credits of the said deceased and any way concerning his will is granted unto Rhoda Titus Executrix in the said will named she being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect Inventory of all and singular the Goods chattels and credits and to render a just and true account thereof when thereto required And Testimony whereof we have caused the seal of Office of our said Surrogate to be hereunto affixed Witness Henry Walton Esquire surrogate of the said county at Ballstown aforesaid the second day of November in the year of our Lord one thousand seven hundred and ninety five and of our Independence the Nineteenth Henry Walton (Transcribed from microfilm by Karen Stark, March 2000.
