I Benjamin Roberts of Schenectady in ye County of Albany in ye Colony of New York in America, being in good health and of sound an dperfit memory (torn), unto Almighty God for the Same) and calling to mind (torn) uncertain State of this Transitory Life and that all of (torn) on Earth must Yeald unto death when it shall please God to Call and being desyrous to Setle things in order doe make this my Last will and Testament in manner & form following Revoakeing and absolutely annulling by the (crumbled) all and Every Testament and Testaments, will and wills, heretofore by me made and declared Either by word or by writteing notwithstanding any Promise to the Conrary or Clause de(crumbled) in the Same and this to be taken, only for my Last will and Testament and none other (first) I bequeath my soul to Almighty God my Maker and to Jesus Christ my Redeemer and to the holy ghost my Santifyer, and my body to the Earth from whom it came to be buried in a decent and Christian manner then to Rest untill my Soul and body shall meet again and by joynd together at the joyfull Resurrection and be made Partakers of the new fadeing joys of Immortality which God in mercy through the merrits of Jesus Christ alone hath Promised and prepared for all that (torn) that trudly and assigned by Repent and Boleeve in ha(torn) and touching such temporall Estate of goods chatles and de(torn) as the Lord hath been pleased far above my Desires to (torn) upon me I doe order give and bequeave and dispose (torn) same in manner and form following. I doe give and bequeow all my Estate Reall & Personally goods and Chatles debts and Creditts after my just debts are paid to my well beloved wife Mary Roberts that is to say my farm scituate lyeing and being at Maelwyck on the northside of Schennechtady River to ye west of land former ye belonged to Jan Rudhout , now in possession of John Mc Intyre which farm is now in my occupation as also all my other goods and Cahtles, moveables and Immovables actions credits nothing exempted, belonging to my Estate, to be enjoyed and possessed by her without any controle or contradiction of my friends and Relatiosn or her children without being obliged to Ponder any account to them or any other by then meanes how she enjoys and posseth the same much feetd to be oblidged to make Inventory but to possess my said Estate further sustenance and (fold crease obscured) during her widowhood. 3dly. After my said wife's decease being widow ither wise if she shall happen to remary my will is that of the above legaces the choice heretofor my stieff sonn caled Peter Clement and to his Brother Joseph Clement the house Ban Barracks orchards and hoffsted belonging to my said farm soas the same now is in forever in my possession then my will is that the rest of the said farm and all other my goods and chatles moveables and immovables of what kinde and nature soever be equally divided in wo equall parts of shares the one half thereof to the said Peter Clement and the other half thereof to the said Joseph Clement the one no more than the other they the said Peter and Joseph clement Paying to their two sisters called Elisabeth Clement and Fransyretid Clement. Each the summe of twenty Pounds currant money of New York. And Lastly I make constitute and appoint my wife Mary aforesaid sole Executrix and administr of this my Last will and Testament in Testimony whereof I have hereunto sett my hand and sealed at Maelwyck the day and year first above.
