I, Dirk Van Ingen, of the City of Schenectady being weak in body but of sound and disposing mind and understanding and mindful that it is my duty to arrange my temporal affairs in proper order while by the blessing of God an opportunity is afforded me for the purpose, do make this my last will and testament in form following: Imprimis, I will that my funeral expenses and just debts first paid by my executors hereinafter named out of my personal and real estate and for that purpose and for the payment of the legacies hereinafter mentioned, hereby empower my said executors to grant, bargain, sell and convey the whole of my real estate or so much thereof as they shall deem necessary. Item I give devise and bequeath unto my beloved wife Gertrude, her heirs, executors and administrators the sum of One Thousand two Hundred and fifty Dollars of the money of account of the United States, together with all her clothing and the furniture which she possessed at the time of our intermarriage or which she has obtained since and also my negro girl named Criss and also the use and occupation of my present dwelling house and the lot of ground whereon the same is erected. To have and to hold the said dwelling house and lot of ground to my said wife, her heirs, executors, administrators and assigns for and during the term of one year from the time of my decease and no longer, which devises and bequests to my said wife are in lieu and ? of her dower out of my said real estate. Item I give devise and bequeath unto my three daughters, Francina, Elizabeth and Judith all the household furniture, whereof I shall be possessed at the time of my decease (excepting what has been acquired by my wife as is above bequeathed) to be divided between my said daughters, share and share alike. Item I give devise and bequeath unto my three sons, John V Van Ingen, James Van Ingen and Abraham Van Ingen and the survivor or survivors of them and his and their heirs the sum of One Thousand and seventy five Dollars of like money as aforesaid. In trust, nevertheless that they shall apply the sum of Seven Hundred and fifty Dollars part thereof for the separate use of my daughter Elizabeth Mercer and her children and the and the remaining sum of three hundred and twenty five dollars for the separate use and behalf of my daughter Francina Demarest and her children, so that neither of the present husbands of my said two daughters shall in any manner partake of the benefit of the above devises and bequests to the use of my said daughters Francina and Elizabeth and to my daughter Judith , I give the sum of Three Hundred and Seventy five dollars. Item I hereby empower my said executors to give unto my grandson Henry Glen Van Ingen or his heirs such sum or sums of money as they in their discretion shall deem proper not exceeding in the whole the sum of fifty dollars like money as aforesaid. Item I give to my grandchild William Mercer, my silver watch. Item Having given unto my son Joseph a farm, my will is that he be therewith content. Item I give, devise, and be bequeath all the rest and residue of my real and personal estate of what kind or nature soever the same may be, and wheresoever the same may be situate, after payment of my just debts and funeral charges and the legacies and bequest above mentioned unto my three sons John, James and Abraham and to their heirs and assigns forever. Lastly, I nominate and appoint my sons John, James and Abraham above named, Executors of this my last will and testament, hereby revoking all former wills and testaments by me made. Hegerman James Rosa Joseph C Gates CODICIL Whence, I, Dirk Van Ingen of the City of Schenectady have duly made and published my last will and testament in writing whereby I have among other things devised a certain portion or share of my estate to my son John V Van Ingen and whereas my said son John V Van Ingen hath departed this life since the making and publishing of said will whereby the devise intended to be made to him has become void and inoperative, and whereas my son Abraham Van Ingen hath made sundry advances for my said son John and hath lately become responsible for monies due from the said John to the Bank of Albany, now therefore, I do hereby give, devise and bequeath to my said son Abraham all and singular the share and portion of my estate, real or personal which is my last will and testament devised or bequeathed to my said son John, to have and to hold the same to my said son Abraham, his heirs and assigns forever. And I do hereby devise this my Codicil to be annexed to and taken as part of my last will and testament which in other respects I do hereby ratify and confirm, declaring this to be an additional codicil to my said will and to be accepted and taken as part thereof.
