I, Samuel Thompson of the City of Schenectady coloured person [colored person] do make this my last and only will and Testament. First, after payment of all my debts and funeral charges and other necessary expences of my Executor herein after named in relation to my estate I give to my wife Sarah all my personal property of every nature and kind whatsoever. Second, I give and devise to my said Executor his heirs and assigns my real estate consisting of two lots lying together situate on Fonda Street in the said City purchased by me in the year one thousand eight hundred and fourteen from Richard Duncan to have and to hold the same during the life of my said wife Sarah and no longer in trust to let the same from time to time during that period for the best price that can be got for the same and to pay the rent thereof after deducting the necessary expences of said property for repairs, taxes or otherwise to my said wife Sarah during her said life as the same shall be received, And I do hereby declare the above bequest of my personal property to my wife and the above devise of my real estate to be in lieu and instead of dower to my said wife. Third, after the death of my said wife I hereby give and devise the said real property as follows, the Southernmost of said two lots being the one on which my house is at present built I give and devise to my nephew Samuel Thompson the son of my brother Thomas his heirs and assigns forever and the Northernmost of the said two lots I give and devise to my Nephew Samuel Thompson E. Carter, son of my sister Susan his heirs and assigns forever provided however that if either of my said nephews shall die before they arrive at the age of twenty one years and unmarried the share of the one so dying shall go to Sarah Carter, daughter of my said Sister her heirs and assigns -- Lastly, I hereby appoint my brother Richard Thompson the Executor of this my last will and Testament. In witness whereof I have hereto set my hand and seal this twenty fifth day of March in the year of our Lord One thousand eight hundred and twenty two. Yates Surrogate of said County, Samuel W. Jones & John B. Duane two of the subscribing witnesses to the last will & Testament of Samuel Thompson late of the City of Schenectady, in said County deceased who being duly sworn, on their oaths declared that they saw the said deceased sign and seal the Instrument hereunto annexed, purporting to be the last will and testament of him the said deceased, and heard him publish and declare the same as and for his last will and Testament -- that at the time thereof he was of a sound disposing mind memory and understanding according to the best of the knowledge and belief of them the said Deponents; that their names subscribed thereto as witnesses to said will sign his name thereto as such in their presence and in the presence of the Testator.
