Van Patten 16 Nov 1839 @ Ref. Church Kinderhook, Columbia co NY this couple had 9 known children two of which were deceased prior to this Will. His wife Margaret Weatherwsx's Will is already posted on the USGENWEB site for Schenectady co. NY. Last Will and Testament of Philip Weatherwax of the city and county of Schenectady and State of New York, First I direct my funeral and testamentary expenses and debts to be paid Second I hereby direct that all my property both real and personal of every name and nature whatsoever be sold by my executor herein after named as soon as practicable after my decease either at public or private sale as he shall deem best and advisable, hereby giving and authorizing my said executor full power and authority to execute and deliver a good and suffiecient deed and conveyance therefor. Third That out of the proceeds of the sale of my real and personal property I direct my executor herein after named to first pay debts and testamentary expenses. To give to my Wife Margaret her dower right in the real property as now provided by law, for her which I give devise and bequeath to her in full and in lieu of any right she may have as widow in my real property. All the rest, residue and remainder of all my property both real and personal I give, devise and bequeath to my children as follows: To: James Weatherwax,John Weatherwax,Christopher Weatherwax, and George Weatherwax, sons and to Ida Todd; daughter wife of John Todd; and Clara Lambert,wife of Charles Lambert, also daughter equally to them share and share alike forever. Fourth: I make no bequest to my son Andrew Weatherwax in this Will because I have heretofore given him material and financial aid and further because he is still owing me on obligations contracted with me. Fifth: I hereby revoke all former Wills or testaments made by me. Sixth: I appoint my friend and neighbor William W. Wemple ,executor of this my last Will and testament.
