All rights reserved. http://www.usgwarchives.org/copyright.htm http://www.usgwarchives.org/ny/nyfiles.htm Submitted Date: June 22, 2004 This file has been created by a form at http://www.genrecords.org/nyfiles/ File size: 10.3 Kb ************************************************ Assigned To: Renselear Germond Written: 9 Nov 1819 Recorded: 12 Aug 1821 Know all men by these presents, that I Jonathan Bloom the within named Mortgagee in consideration of the sum of one thousand dollars to me in hand paid before the signing and sealing hereof by Rensselear Germond of the town of Clinton, in the County of Dutchess and State of New York, do grant, sell, assign, transfer & make over unto the said Renssellear his heirs and assigns forever, the within described premises to have & to hold the same to him the said Rensselaer his heirs and assigns forever as fully and in as ample a manner as I the said Jonathan my heirs or assigns might hold and enjoy the same by virtue of the within mortgage deed & not otherwise and I do for myself my heirs, executors & administrators, hereby authorize & empower the said Rensselear, his heirs, executors and administrators to receive to his and their own use, the sum or sums of money mentioned in the condition of the within mortgage deed, whenever the same shall be tendered or paid to him or them and to discharge the within mortgage or to pursue such steps & means for recovery of the said sum or sums with the interest by sale of the within mortgaged premises or otherwise as by law is provided as fully to all intents and purposes as I the said Jonathan my heirs might or could do in the premises. And I do for myself, my heirs, executors & administrators, covenant with the said Rensselear, his heirs and assigns, that I have good right to assign the within described premises as aforesaid & that he the said Rensselear shall and may have, hold, occupy, possess and enjoy the same (subject to the right of redemption as by law in such case provided) against the lawful claim of all persons. In witness of the above do hereunto set my hand and seal this twenty ninth day of November in the year one thousand eight hundred & nineteen. In presence of E. Nye witness. Jonathan Bloom L.S. Be it remembered that on the 27 July 1821 personally appeared before me Jonathan Bloom to me known to be the same person who is described in and who executed the above assignment of mortgage dated 29 November 1819. and acknowledged that he executed the above assignment of mortgage for the uses and purposes therein mentioned. The words"Rensselear Germond" on he 3rd line from the top and the word "Rensselear" in 5,6,9,16 & 17th lines from the top were first interlined before acknowledgment. E. Nye Commissioner In & for Dutchess To which said assignment of mortgage, was annexed a certificate of the clerk of the County of Dutchess, dated the 27 July 1821 certifying that E. Nye, was on the day when the said acknowledgement was made, a commissioner to take the proof of deeds & in & for the County of Dutchess and that the signature of the said E. Chapman Ward of the town of Jefferson, in the County of Schoharie and Mary his wife having mortgaged to Jonathan Bloom of Clinton, Dutchess County , on the first day of May in the year of our Lord one thousand eight hundred and nineteen for securing the payment of one thousand dollars, with interest, according to the condition of a certain bond bearing the same date, All that certain lot, piece or parcel of land situate, lying and being in the town of Jefferson and County of Schoharie, Known and distinguished as and by lot no. sixty eight in the patent of Strasburgh, containing one hundred and nineteen acres and three tenths be the same more or less, and more particularly described in said mortgage, registered in the Clerks office of the county of Schoharie, the ninth day of November 1819 at 7 O'clock P.M. in book D of Mortgages pages 224 and 225 - which said mortgage was duly transferred and assigned by the said mortgagee on the first day of May 1820 to Rensselear Germond. Default having been made in the payment of the interest, the said mortgaged premises will pursuant to a power in said mortgage, be sold at public vendue, at the Court house in the town of Schoharie on the sixteenth day of August next at ten O'clock in the forenoon. Peter Keyser, printer and publisher of a newspaper in the village of Schoharie, in the County of Schoharie, called the "Schoharie Republican" being duly sworn deposeth and saith, that he hath from about the 14th day of February last past, weekly for six successive months printed and published in said newspaper a notice of intended sale by mortgage a copy whereof is hereunto annexed. I do certify that on the 15th day of August in the year of our Lord one thousand eight hundred and twenty one, Peter Kyser in the above affidavit named, personally appeared before me and made the above contained oath. William Mann of the town of Schoharie in the County of Schoharie, being duly sworn, deposeth and saith that the mortgaged premises, mentioned in the advertisement hereunto annexed were on the sixteenth day of August in the year one thousand eight hundred and twenty one exposed for sale. Peter Germond of said County bid twenty dollars for the same Then Rensselaer Germond bid thirty dollars for the same, then another person bid thirty five dollars for the same and then the aforesaid Peter Germond bid forty dollars for the same and that being the highest sum bid, the said premises were accordingly struck off by this deponent for the said sum of forty dollars to the said Peter Germond, as the highest bidder for the same. I do hereby certify that on the seventeenth day of August in the year one thousand eight hundred and twenty one, William Mann in the above affidavit named personally appeared before me & made the above contained oath. Jonathan Bloom was Mortgagee to Chapman Ward & Wife. May 1, 1819. November 29, 1819, Jonathan Bloom assigned the mortgage to Rensselaer Germond. There was default in the payment of interest and the property was sold at auction to Peter Germond for $40.00 on August 16, 1821.
