And by these presents do grant, bargain, sell, release, alien and confirm unto the said party of the second part and to his heirs and assigns, All that certain farm piece or parcel of land, situate lying and being in the town of Carlisle in the county of Schoharie in the State of New York, known and distinguished as lot number one in great lot number five in the allotment in a tract of Seven thousand acres of land granted by letters Patent to Philip P. Livingston and others, which said lot number one begins at the northwest corner of the .? Lot in the said tract of seven thousand acres of land and runs thence due west fifteen chains & eighty links to the northwest corner of lot number two of great lot number five in the said allotment aforesaid, thence south thirteen degrees and twenty minutes east, sixty four chains and sixty one links, thence due east fifteen chains and eighty links to the e .? lot aforesaid, thence along the same north thirteen degrees west sixty four chains and sixty one links to the place of beginning, containing one hundred acres of land more or less. Together with all and singular the hereditments, thereunto in any wise belonging and the reversion and reversions, remainder and remainders, rents, issues and profits thereof: To have and to hold the said premises hereby released and confirmed, with the appurtenances unto the said party of the second part and to the sole and only proper use, benefit and behoof of the said party of the second part, his heirs and assigns forever. Provided Always, and these presents are upon this express condition that if the said James German, his heirs, executors and administrators, do and shall well and truly pay or cause to be paid, unto the said party of the second part, his certain attorney, or attornies, heirs, executors, administrators, or assigns, the sum of one thousand dollars current money as aforesaid together with the interest which may accrue thereon in the manner particularly specified in the condition of a certain bond or obligation bearing e ? date herewith executed by the said parties of the first part to the said party of the second part, that their and from thenceforth, these presents and everything herein contained shall cease and be void anything herein contained to the contrary? In anywise not withstanding. But in case default shall be made in payment of all or any part f the said principal sum of one thousand dollars or the interest thereof, at the time or times when the same ought to be paid as aforesaid, the then and in such case, the said parties of the first part for themselves, their heirs, executors and administrators, do covenant, grant, promise and agree to and with the said party of the second part, his heirs, executors, administrators and assigns, that it shall and may be lawful for the said party of the second part, his heirs, executors, administrators or assigns at anytime or times thereafter to sell and dispose of the said premises, hereby granted or any part or parts thereof, at public vendue, to any person or persons whomsoever. And on such sale to make sign, seal and deliver any deed or deeds of conveyance in the law for the said premises, or the part thereof so sold to the purchaser or purchasers, his, her or their heirs or assigns forever and out of the monies arising from such sale or sales to keep and retain in his hands, the said sum of one thousand dollars or so much thereof or of the interest thereof as shall be then due, together with all costs, charges or expenses, that shall or may be due, accrue, arise or happen by reason or on account of such sale or sales, and the overplus money (If there be any) shall be paid to said parties of the first part, their heirs, executors, administrators or assigns. I do hereby certify that on the thirteenth day of November in the year of our Lord one thousand eight hundred and eighteen, personally appeared before me, William Beekman Esquire, first Judge of the county of Schoharie, James German and Elizabeth German his wife, both persons proven to be the persons described in the within mortgage by the oath of Cornelius Marshall, a person to me well know, and one of the subscribing witnesses to the within mortgage who duly acknowledged that they executed the same for the purpose therein mentioned and the said Elizabeth German being examined by me privately and apart from her husband, confessed that she executed the same freely without any fear threat or compulsion of her husband and I having examined the same and finding no material erasures or interlineations do allow the same to be recorded.
