Stiner To John I. Enders This indenture made the twelfth day of February in the year of our Lord one thousand eight hundred and forty, Between Adam I. Stiner of Conklin in the County of Broome and State of New York of the first part and John I. Enders, of Schoharie County of Schoharie, State aforesaid of the second part. Witnesseth that the said party of the first part, for and in consideration of the sum of Two hundred and twenty three dollars in hand paid by the party of the second part, the receipt wherewith the said party of the first part do hereby declare himself satisfied and paid(?) that and by these presents doth grant, bargain, sell, alien, release, convey and confirm unto the said party of the second part , his, heirs and assigns. All that certain tract of land lying and being in the town of Conklin foresaid being part of lot number twenty one, in Clinton & Melchers Patent, the part hereby intended to be conveyed is bounded west by the line of the lot north by the land of Jeremiah Enders, east by the line of the lot and south in part by the line of the lot and fifty acres owned by the said party of the first part, containing forty five and a half acres of land more or less. To have and to Hold the said tract of land and premises with the appurtenances unto the said party of the second part, his heirs, and assigns, to his and theirs only proper such benefit and behoof forever. Provided always and these presents are upon this express condition, that if the said party of the first part, his heirs, executors, administrators or assigns well and truly pay or cause to be paid to the said party of the second part, his heirs, executors, administrators or assigns, the just and full sum of Two hundred twenty three dollars, with interest, in manner following, fifty dollars and annually for two years and the balance of one hundred and twenty three dollars three years from the date hereof, with interest annually, according to the condition of a certain bond or writing obligatory bearing even date herewith, executed by the said party of the first part to the said party of the second part as a collateral security, then these presents, and the said bond of writing obligatory, shall cease and be null and void. But in case of the nonpayment of all or any part of the said principal sum of Two hundred and twenty three dollars or any part thereof at the time or times above (?) for the payment thereof, then and in such case it shall and may be lawful for the said party of the second part, his heirs, executors, administrators or assigns and the said party of the first part doth hereby empower and authorize the said party of the second part, his heirs, executors and assigns, to grant, bargain, sell, release and convey the said premises with the appurtenances thereunto belonging at public auction & vendue and on such sale to make and execute to the purchaser or purchasers, his, hers, their heirs and assigns forever good, ample and sufficient deeds of conveyance in the law pursuant to the statute in that case made and provided, rendering the surplus monies, if any there be, to the said party of the first part, his heirs, executors, administrators, assigns, after deducting the costs and charges of such vendue and sale as aforesaid. Stiner personally appeared before me and acknowledged that he executed the within conveyance and I certify that I know the said Adam I. Stiner to be the individual described in and who executed the within conveyance. Let it be recorded. Wm H. Gallup Com. of Deeds of Schoharie County. State of New York, Schoharie County, Clerk's Office. I William M. Holton, Clerk of the Court of Common Pleas in and for the County of Schoharie, Do certify that William H. Gallup whose name is subscribed to the certificate of the proof of the annexed Mortgage and endorsed thereon, was on the day of the date of the said certificate, a Commissioner of Deeds, in and for the said county and duly authorized by law to take the same, And further, that I am well acquainted with this handwriting and verily believe that the signature of the said Commissioner subscribed to the said certificate is his proper hand writing.
