I John J. Enders of the town of Wright in the County of Schoharie & State of New York, Do make and declare this my last Will and testament in manner and form following First, I resign my soul into the hands of Almighty God hoping and believing in a remission of my sins by the merits and mediation of Jesus Christ, and my body I commit to the earth to be buried at the discretion of my Executor herein after named and my Worldly Estate I give and devise as follows, Viz. Item 1st: I give and devise unto my beloved wife Margaret all that my messauge and tenement, it being my present residence containing about Six acres of land situate in the town of Wright and county of Schoharie aforesaid to have and to hold to my said beloved wife Margaret, her heirs and assigns forever. Item 2nd: I give and bequeath unto John W. Enders, the son of my brother William Enders deceased my set of Scotts family Bible and commenteries containing three volumes also the sum of fifty dollars in addition to the said books to be paid to him six months after my decease by my Executor. Item 3: Also I give and bequeath unto Jeremiah Enders my bay horse and my pair of oxen in case he has them in his possession or either the horse or oxen at the time my decease shall take place he shall hold one or both. Item 4: Also I give and bequeath unto my beloved wife Margaret all and singular my personal property not herein before bequeathed and effectually disposed of above which is here excepted, that is to say all my household furniture, library wearing apparel, money and outstanding debts & after paying my debts and funeral expenses, I do hereby constitute and appoint my trusty friend David Shell Executor to this my last Will and testament, hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal the fourth day of May in the year of our Lord one thousand eight hundred and forty six. John J. Enders L.S. The above instrument consisting of one sheet was now here subscribed by John J. Enders the testator in the presence of each of us and was at the same time declared by him to be his last Will and Testament and we at his request sign our names hereto attesting witnesses. Shafer of the town of Wright, Schoharie County Schoharie County Surrogate Court In the matter of proving the last Will and testament of John J. Enders deceased, Schoharie County. John Shafer of the town of Wright in the county of Schoharie being first duly sworn in open court doth depose and say that he is a subscribing witness to the last will and testament of John J. Enders late of the town of Wright in the county of Schoharie deceased. Deponent further saith that the said John J. Enders, the said testator did in the presence of this deponent subscribe his name at the end of the instrument which is now shown and exhibited to this deponent and which purports to be the last will and testament of the said John J. Enders and which bears date on this fourth day of May in the year of our Lord One thousand eight hundred and forty six. Deponent further saith that the said John J. Enders , the said testator did at the same time of subscribing his name as aforesaid at the end of the said will declare the said instrument so subscribed and now exhibited to be his last will and testament and deponent did thereupon subscribe his name to the said will as an attesting witness thereto at the end of the said will at the request and in the presence of the said testator and of the other subscribing witness thereto. Deponent further saith that at the said time when the said testator subscribed his name to the said last will as aforesaid and at the time of this deponents subscribing his name as an attesting witness thereto as aforesaid the said John J. Enders was of sound mind and memory of full age to execute a will and was not under any restraint to the knowledge information or belief of this deponent. And further this deponent saith not.
