DECEASED In the name of God Amen, I Peter Enders Junior, of Schoharie in the county of Schoharie and state of New York, being of sound disposing mind and memory, Do make, ordain and publish this my last will and testament in manner and form following. To my son Jacob P. Enders and to his heirs and assigns forever, I give and devise all my lands situate in the town of Schoharie in the east side of the Schoharie creek. To my son Peter J. Enders and to his heirs and assigns forever, I give and devise all the residue of my lands situate in the said town of Schoharie on the west side of said Schoharie creek. The above devises to my said sons Jacob and Peter are upon the express condition that my said son Jacob and his wife shall within sixty days after my decease, execute and deliver to my said son Peter J. Enders, a good and sufficient deed of conveyance in the law to my said son Peter, his heirs and assigns for all the lands which were formerly a part of the farm of Jacob Kniskern, deceased, and which my said son Jacob now owns in the right of his said wife, and shall also release within the time aforesaid, all claims which he may have against my said son Peter for the use & occupation of the same, up to the time of the execution of the said release But in case my said son Jacob and his wife shall not execute, the said deed of conveyance as above specified within the time above specified and also release all claim for use or occupation as aforesaid, then and in such case I give and devise to my said two sons Jacob and Peter , all my lands aforesaid situate in the town of Schoharie aforesaid on both sides of the Schoharie creek, to be equally divided between them share and share alike and to their respective heirs and assigns forever. To my said two sons Jacob and Peter and to their respective heirs and assigns forever. I give and devise all my lands in Lot number twenty in the first allotment of a patent usually called Lawyer and Timmers(?) patent to be equally divided between them share and share alike which said lot number twenty is situate in the town of Middleburgh in the county of Schoharie aforesaid. To my daughter Catharine, wife of Joseph J. Borst and to her heirs and assigns forever, I give and devise about thirteen acres of land situate in the town of Middleburgh aforesaid, in a patent granted to Myndert Schuyler and others and bounded on the north and east by land of Hermanus Becker, Junior, south by lands of Joseph J. Borst and Hezekiah Manning and west by the public highway. To my daughter Catharine I give and bequeath all the notes and obligations which I now hold against her said husband Joseph J. Borst. To my daughter Nancy, wife of Philip Dietz I give and bequeath all the notes and obligations which I now hold against the said Philip Dietz. All my lands situate in the towns of Charlestown and Florida in the county of Montgomery. I give and devise to my two daughters, Maria widow of Jacob Enders deceased, and Elizabeth wife of John Enders, to be equally divided between them, share and share alike and to their respective heirs & assigns forever. To my said four daughters, Maria, Elizabeth, Nancy and Catharine, I give and bequeath all my sheep and horned cattle, and also all my household furniture to be equally divided between them share and share alike. To my said son Jacob P. Enders, I give and bequeath all my horses, wagons, sleighs, harnesses and farming utensils. All the rest and residue of my personal estate, I give and devise to my said two sons Jacob and Peter, to be equally divided between them share and share alike. To my beloved wife Elizabeth Enders, in case she shall survive me, I give and devise during her natural life to be for her own use and occupation, and not to be sold or assigned by her, the north room in my dwelling house and also the room in the chamber immediately over the same, together with such privileges in the kitchen and cellar and hall as may be necessary for her use and all such yard room as may be necessary for the full and free enjoyment of the same. And in any event to secure to my said beloved wife comfort and competence during her natural life. I do hereby will, order and direct that my executor herein after named pay to her half yearly during her natural life the sum of one hundred dollars, the first payment to be made to her in forty days after my decease and one hundred dollars at the expiration of every six months thereafter. And I do hereby nominate, constitute and support my said two sons Jacob P. Enders and Peter J. Enders executors of this my last will and testament hereby revoking all former wills by me made In Testimony where of I have hereunto put my hand and seal this sixteenth day of April in the year of our Lord on thousand eight hundred and thirty. Be it remembered that on Monday, the thirteenth day of September in the year of our Lord on thousand eight hundred and thirty, personally appeared before me William Mann, Surrogate of the county of Schoharie, Henry Hamilton and John Gebhard of Schoharie and Alexander Boyd of Middleburg in the county of Schoharie. They being the subscribing witnesses to the will of Peter Enders Junior, late of the town and county of Schoharie deceased who being severally duly sworn, declared that they did see the said Peter Enders Junior deceased, seal and execute the instrument now exhibited to them purporting to be the Last Will and Testament of the said Peter Enders Junior deceased bearing date the sixteenth day of April in the year of our Lord one thousand eight hundred and thirty, that they heard him publish and declare the same as and for his Last Will and testament, that at the time there of the said Peter Enders junr. Was of sound disposing mind and memory to the best knowledge and belief of them the said witnesses and under no restraint and that they the said witnesses did severally subscribe their names thereto as witnesses in the presence of the testator and of each other.
