Forsyth of the town of Wright in the County of Schoharie I, Oliver S. Forsyth of Wright aforesaid considering the uncertainty of this mortal life, and being of sound mind and memory do make publish and declare this my last will and testament in manner and form following. viz.: First. I give and bequeath to my beloved wife Prudence the sum of Seventy dollars per year, to be paid to her annually on each first day of January, during her life. Second. I give to my granddaughters Amanda and Frances Forsyth, daughters of my deceased son Chester each the sum of One Hundred Dollars. And I also give to my granddaughter Anna Possen the daughter of Henry Possen the sum of One Hundred Dollars. Third. I give and devise all the residue and remainder of my real and personal estate and property of whatever kind or description, or wherever the same may be to my daughters Mary Ann Plank, Lucy Van Dyck, Sally McDonald, Harriet Ball, Clarissa Schoolcraft and Emily Like, and my son Spicer Forsyth in equal proportions to be divided between my said six daughters and one son share and share alike and to their heirs forever. Lastly. I do hereby constitute and appoint my son-in-law James Plank executor of this my last will and testament hereby revoking all former wills by me made. In testimony whereof I have hereunto put my hand and seal this 30th day of January in the year 1856. Oliver S. Forsyth In presence of R. Brewster Schoharie NY Wm. H. Forsyth the testator named in the foregoing will, in our presence and at the time of making such subscription, declared by the testator to be his last will and testament, and each of us signs his name as a witness at the end of the will at the request of the testator and in his presence. Ralph S. Brewster Schoharie NY Wm. H. Davis Schoharie NY Schoharie County Surrogate Court In the matter of proving the will of Oliver S. Forsyth late of Wright deceased. Ralph Brewster of Schoharie in the County of Schoharie and William H. Davis of Schoharie in the county of Schoharie being first duly sworn in open court do depose and say that they are subscribing witnesses to the last will and testament of Oliver S. Forsyth of the town of Wright in the county of Schoharie deceased. That the said Oliver S. Forsyth did in the presence of these deponents subscribe his name at the end of the instrument which is now shown and exhibited to these deponents and which purports t o be the last will and testament of the said Oliver S. Forsyth and which bears date on the 30th day of January in the year of our Lord one thousand eight hundred and fifty six. Deponents further say that the said Oliver S. Forsyth the said testator did at the said time of subscribing his name as aforesaid at the end of the said will declare the said instrument so subscribed and now exhibited to be his last will and testament: and these deponents did therefore subscribe their names at the end of the said will as attesting witnesses thereto at the request and in the presence of the said testator and of each other. Deponents further say that at the said time when the said testator subscribed his name to the said last will as aforesaid, and at the time of these deponents subscribing their names as attesting witnesses, thereto as aforesaid, the said Oliver S. Forsyth was of sound mind and memory, of full age to execute a will of real estate, and was not under any restraint to the knowledge information or belief of these deponents. And further these deponents say not. Wm. H. Davis R. Brewster Sworn and subscribed this 5th day of December 1859 before me Lyman Sanford County Judge Schoharie County Surrogate Court I, Lyman Sanford County Judge of said county do hereby certify that the preceding is a true and perfect record of the last will and testament of Oliver S. Forsyth late of the town of Wright Schoharie County deceased and of the proofs and examinations taken in relation to the execution and validity thereof at the time the said will was duly proven before me in open court pursuant to law and the same is hereby recorded as a will of both real and personal estate.
