Cure, of the Town of Catherine, County of Schuyler and State of New York. I, James M. Cure, do make, ordain, publish and declare this to be my last will and testament, in manner and form following, that is to say: First, I give and bequeath to my daughter Julia A. Ring the sum of One Hundred Dollars ( $100.00 ) the same being discharge of any and all obligations for services rendered from me whilst she remained at home with me after she became the age of twenty one years. Second: I give, bequeath and devise all of my property of every kind and nature, real, personal and mixed to my son, daughters and Grandson as follows, that is to say: Mary E. Cure, Addison Dewitt Cure, Rhoda A. Ward, Julia A. Ring and Sarah R. Dunham and to my Grandson Guy Demott Henderson, the son of my deceased daughter Fanny B. Henderson, each to receive an equal undivided one sixth part thereof after the payment of my past debts, funeral and burial expenses. The sum of $100.00, bequeathed to Julia A. Ring and the sum hereinafter named to be taken from the share of my grandson, Guy D. Henderson and paid to my daughter Rhoda A. Ward with the exceptions, hereinafter stated and the provisions hereinafter made each to share and share alike in all of my property, real and personal and in all my equitable interests. Third: Out of the share of my Grandson Guy D. Henderson as hereinbefore provided I direct to be paid the amount of a certain promissory note executed on or about June 1885 to my daughter, Rhoda A. Ward for $100.00 which said note was executed by Lyman Henderson and his wife and is still unpaid, such sum is hereby bequeathed to my said daughter Rhoda A. Ward. In case said note is paid to my said daughter Rhoda before said share is paid over by the said Guy Demott Henderson then this third claim is to be __?___ and of no effect. Fourth: It is my will and I hereby direct that the share hereby willed, bequeathed and devised to my said daughter Mary E. Cure be placed in the hands of my said daughter Rhoda A. Ward, who I hereby appoint as Trustee for that purpose to hold and manage the same for the benefit of my said daughter Mary during her natural life. That the said estate be safely and properly invested as soon as practicable in some safe manner and so much thereof as may be necessary for her comfortable support and maintenance of her be used and paid over for that purpose as her necessities may require whether interest or principle, form time to time and at her death after paying her funeral and burial expenses the remaining sum if any be divided amongst my son, daughters and Grandson above named to have an equal share of such surplus if any remains. Likewise, I make, constitute and appoint my son in law John Ring and my daughter Rhoda A. Ward to be Executor and Executrix of this, my Last Will and Testament, and I hereby revoke all former wills by me made. In witness whereof , I have hereunto subscribed my name and affixed my seal the 4th day of June in the year of our Lord one thousand eight hundred and ninety one. Signature of James M. Cure The foregoing instrument was at the date thereof subscribed by James M. Cure the Testator therein named, in the presence of each of us. He at the time of making such subscription acknowledged that he executed same, and declared the said instrument so subscribed by him to be his Last Will and Testament. Whereupon we, at his request, and in his presence, and in the presence of each other, do here subscribe as witnesses hereto. Henry W. Smith residing at Odessa N. Y. W. F. Henry residing at Odessa N. Y. Schuyler County SS: John J. Van Allen being duly sworn makes oath that on the day the will bears date James M. Cure, deceased, after the execution of his will which was done in my office left the will with me for safe keeping and it did not go out of my Custody until I passed it into the hands of the Surrogate of Schuyler Co. after petition filed for its probate and it is in the same condition today as when I handed it to the Surrogate.
