All rights reserved. http://www.usgwarchives.org/copyright.htm http://www.usgwarchives.org/ny/nyfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Joyce Phillips phillmuell@charter.net April 10, 2007, 8:38 pm Source: Baley Researcher Written: May 3, 1752 Recorded: March 12, 1826 JAMES BALEY WILL In the name of God, Amen – I, James Bayley of the Town of Romulus County of Seneca and State of New York being at this time in perfect health of body and of sound and perfect disposing mind and memory, thanks be to Almighty God for the same and calling to mind the mortality of my body and uncertainity of life, and wishing to dispose of my estate so as to prevent any dispute of misunderstanding about the same do make, ordain, and constitute this my last will and Testament in manner and form following, revoking all others – first I give and bequeath my Soul to almight God as into the hand of a merciful creator who fist gave it me; and my body to the dust from whence it came (to be decently intered therein by my Executors.) looking for the coming of our Lord and the resurrection of the Just – Imprimis, I give and bequeath onto my son Jonathan the two notes I hold against him one for two hundred and sixteen dollars and twenty six cents, the other for fifty dollars and the interest on them which is all I intend the shall have of my Estate – Item I give and bequeath unto my son Abner the note I hold against him for one hundred and twelve dollars sixty eight cents and the interest therein, and one hundred and thiry dollars besides; to him his heirs and asigns – Item I give and bequeath unto my son Samuel seven hundred dollars to him his -heirs and asigns – Item I give and bequeath unto my daughter Hannah the fifty acres of land that I have lying in the county of Ontario and Town of Lyons (being part of tract purchased by Zadoc Bostwick) to her, her heirs and asigns forever – and I further give and bequeath unto my daughter Hannah a note that I hold against Zadoc Bostwick for twenty three dollars and thirty two cents and the interest thereon. – Item I give and bequeath unto my son James five hundred and fifty four dollars and twelve cents or in other words the note which I hold against him for that sum – and also I give and bequeath unto him one hundred dollars to him his heirs and asigns – Item I give and bequeath unto my daughter Rhoda threee hundred and eighty four dollars to her, her heirs and asigns. And whereas my son William has been settled by me on a farm in the Town of Jerusalem on the west side of the C___ed lake containing forty four acres and for which he holds the Deed. Now therefore if he shall deliver up and deed over said farm to my Executors to this my last will and testament to be by them disposed of as hereinafter directed – I give and bequeath unto him the said William instead “thive” of the farm and the oppurtunities thereunto belonging situate lying and being in the Town of Wayne County of Steuben, State of New York, on Lat. No. fifty East half in the Township No. six in the first range of Townships in the County containing one hundred and forty five acres to him his heirs and asigns forever. Item. I give and bequeath unto my daughter Eleanor four hundred dollars (including the forty dollars which I paid Joseph Baley for her) to her, her heirs and asigns. And whereas I conceive that I have done more for my son Joseph than for any of the rest of my children I hereby ordain in this my last will and testament that my son Joseph shall have no more of my Estate real or personal than he has already had – Now therefore for the payment of the aforesaid legacies, my Executors to this my last will and Testament will pay out of the monies due and to become due me on a Bond and Mortgage which I hold against my son Joseph which legacies are to be paid in manner and form following (viz.) to my daughter Rhoda her three hundred and eigthy four dollars out of the first payment due on said Bond and Mortgage – The remaining legacies to be paid off as the money shall become due on said Bond and Mortgage – And whereas I apprehend there will be an overplus of my Estate after the payment of the aforesaid legacies, of from ten to twelve hundred dollars if things remain as they are at present. But I amy have occasion to make use of a part of it – But it is to be understood that the farm before mentioned containing forty four acres, and on which my son William resides in the Town of Jerusalem is Estimated as a part of said overplus which farm is to be sold by my Executors, and the money for the same to divided between Abner, Samuel and James, three boys before mentioned and Hannah, Rhoda and Eleanor, three girls before mentioned (viz.) the boys to have thirty dollars each and girls twenty dollars each until the division is done. My household goods to be equally divided among the aforementioned three girls – and my carpenters tools to be equally divided between the above named three boys – And, whereas it is necessary that there should be some person or persons appointed to carry this my last will and testament into effect – I do therefore nominate and appoint my son Samuel and Elijah Kinne Junr my Executors to carry this my last will and testament into effect – N. B. the interlineations of the words (for one hundred and twelve dollars and sixty eight cents) in the nineteenth line from the top - and the words & thirty two cents) in the fifth line from the bottom was done before signing. Thompson Esq, Surrogate of said County, and being duly sworn, deposed and said, that they saw James Bayley in the annexed will named, Execute the same, and that at the doing thereof, he was of sound and disposing mind and memory, and under no restraint, and that the Deponesit saw each other subscribe the same, who severally attended and subscribed the same in the presence of the Testator.
