The last will & testament of Daniel McAlmont of the town of Hornellsville in the County of Steuben & State of New York I Daniel McAlmont - considering the uncertainty of this mortal life & being of sound mind & memory (blessed be almighty God for the same) do make & publish this my last will & testament in manner & form following that is to say - First = I give & bequeath unto my children John McAlmont Julian McAlmont Samuel McAlmont Corydon McAlmont Rosilie McAlmont & Myra McAlmont = (subject to the provisions hereinafter named in favour of my well beloved wife Semantha, all my personal estate goods & chattels, & chattels real & chosen in action to be equally & fairly divided among them. Item - I give and devise unto my aforesaid named children (subject to the foregoing provisions hereinafter named in favour of my aforesaid wife & in all cases subject to her right of dower in my estate) - all my real & landed estate to be equally & fairly divided among them. And lastly, I make the following provisions in favour of my aforesaid wife & in addition to her right of dower, that she may have the sole & exclusive use of all my real & personal estate of whatever name or nature (and bequeathed & devised as aforesaid) until all of my aforesaid children shall have become of age or until the youngest living child shall have become of age, and I do hereby appoint Jesse Eddy of the town, County & State aforesaid sole executor of this my last will & testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand this nineteenth day of December in the year of our Lord one thousand eight hundred & thirty eight. Daniel McAlmont the name of Samuel McAlmont on the 13th & 14th lines from the top erased before signing The above intrument of one sheet was now here subscribed by Daniel McAlmont this testator in the presence of each of us & was at the same time declared by him to be his last will & testament & we at his request sign our names hereto as attesting witnesses. Elisha Wilbur} Residing in Hornellsville in the Thomas Major } County of Steuben State of New York } Steuben County } Surrogate Court } I Robert Campbell Jr Surrogate of said county do hereby certify that in pursuance of the statutes of this state upon proof & examinations in the county aforesaid on the 24 day of July 1839 by the oaths of Elisha Wilbur & Thomas Major the subscribing witnesses to the foregoing will, that the said will was duly executed that the testator at the time of executing said will was in all respects to devise real estate & not under restraint & I the surrogate aforesaid do further certify that said will is recorded in my office in Book of wills testaments & codicils proved before me at page 155 & the proof thereof in Book of minutes orders & decrees at page 415 In witness whereof I the said surrogate have hereunto affixed my hand & seal of office this 24 day of July 1839.
