Robinson, deceased. On the fifth day of September 1857, William D. Terbill & Charles H. Thomson, Executors named in a certain instrument in writing purporting to be the last Will and Testament of William W. Robinson late of Corning in said County, deceased applied in this Court to have the said instrument, which relates to personal estate proved as the last Will and Testament of the said deceased: and thereupon the surrogates of said County did ascertain, by satisfactory evidence, the facts required by law; they did issue a Citation in due form of law, directed to the proper persons, by their respective names, and stating their places of residence, requiring them to appear before him at the court house in the town of Bath in said County, on the 22nd day of September 1857, to attend the probabe of the said instrument. And afterwards, to wit, on the day and at the place last aforesaid, due proof by affidavit was produced and filed in said Court of the service of the said Citation, in the mode prescribed by law; and the said applications appeared in person and no other parties or persons appearing, such proceedings were thereupon afterwards had, on the said 22nd day of September 1857 that the said surrogate took the proof of support in the matter approving the last Will and Testament of William W. Robinson, decd. Steuben County, ss. Seymore F. Denton and Henry E. McIntire of Corning in said County witnessed produced in this matter, being duly sworn and examined before David McMaster Surrogate of said County, depose and say that they were acquainted with William W. Robinson late of Corning in said County, now deceased, and that they are subscribing witnesses to the last Will and Testament of said deceased. And deponents further say that the said testator did, in the presence of these deponents and each of them subscribe his name at the end of the instrument which is now here exhibited to deponents, and which purports to be the last Will and Testament of the said William W. Robinson and which bears date on the 22nd day of April in the year of our Lord one thousand eight hundred and fifty seven and Deponents further say that the said testator did, at the time of his subscribing his name as aforeaid, at the end of said Will, declare the same to be his last Will and Testament; and deponents are 2 each of them did thereupon subscribe their names at the end of said Will, as attesting witnesses thereto, in the presence and at the request of said testator and deponents further say that at the time the said testator so subscribed his name to the last Will as aforesaid, and at the time of the deponents so subscribing their names as attesting witnesses thereto, said testator was of sound mind and memory, of full age to execute a Will, and not under any restraint. And that said Will now appears in all respects as when so executed, without any alteration whatsoever. s/ Seymore F. Denton s/ Henry E. McIntire Subscribed and Sworn this 22nd day of September 1857, before me, D. McMaster, Surrogate. The foregoing proofs and examinations were taken before the surrogate aforesaid, on the 22 day of September 1857, and the deposition of the respective witnesses were by them severally subscribed, after having been carefully read over to them. And the said Surrogate being satisfied upon the proof taken, that the Will is genuine and valid, and was duly executed; and that the said testator, at the time of executing the same was in all respects competent to devise real estate, and not under restraint, doth therefore allow the said Will, proofs and examinations to be recorded. Witness: David McMaster, Surrogate of the County of Steuben, at Bath in the said County, the 22nd day of September 1857. s/ D.McMaster, Surrogate In the name of God Amen. I William W. Robinson of the town of Corning in the County of Steuben and State of New York of the age of twenty four years, and being of sound mind & memory do make publish and declare this my last will and testament in manner following that is to say. First: I give and bequeath to my wife Jane E. Robinson the sum of five hundred dollars to be paid to her by my executors herein after named as soon as practicable after my decease, and to be accepted and received by her in lieu of dower. Second. I give and bequeath and devise all the residue and remainder of all my real and personal estate in whatever nature or kind so ever to William D. Terbell and Charles H. Thomson the executors of this my last Will and Testament herein after nominated and appointed the ______ for the payment of all my just and legal debts, and after such payment for the use of my said wife, Jane E. Robinson, during her natural life unless she should marry during the life of my daughter Julia M. Robinson, and in that case for the use of my said daughter, Julia M. Robinson till she shall arrive at the age of twenty one years and my said executors are authorized in their discretion to sell and dispose of my property and invest the proceeds thereof or to continue and carry on my business as a merchant in their own names or otherwise as they may deem best, and most for the advantage of the property and the interest of the moneys so invested or the profits of the said business they shall pay to my said wife Jane R. Robinson during the term of her natural life provided she shall remain unmarried for the use of herself and of my said child Julia M.Robinson and in the case of the death or marriage of my said wife, the same shall be paid for the care and support of my said child, and in case my said child Julia M. Robinson shall survive her said mother Jane E. Robinson, and shall arrive at the age of twenty one years, the whole amount of said property shall be paid by my said executors to my said child. It being my will and desire that in case my said wife shall intermarry no part of said property or the interest or income thereof shall thereafter be paid to her or for her use or benefit. And in case of the death or marriage of my said wife and the death of my said child before she shall reach the age of twenty one years, then I authorize and direct my said executors in the way that may seem to them most fit and proper to invest any of my property then remaining in the establishment and carrying on of a public library in the village of Corning, there for the use of the inhabitants thereof on such conditions as my said executors shall seem proper. Third. And I do hereby dispose of and commit the tuition and custody of my said child, Julia M. Robinson for such time as she shall continue unmarried and under the age of twenty one years unto my wife Jane E. Robinson so long as she shall remain my widow, but if she should die or marry during the single life or non age of my said child, I hereby dispose of and commit her tuition and custody to my executors hereinafter nominated and appointed. Fourth. And Lastly I hereby nominate and appoint my friend William D. Tirbell and Charles H. Thomson both of Corning to be the Executors of this my last will and testament hereby revoking all former Wills by me made.
