Hakins late of Lawrence deceased. Surrogate’s Court, St. Lawrence County Be it Remembered, That heretofore, to wit: on the 21st day of June A. D. 1899 Ellen E. Hakins, executrix named in the Last Will and Testament, of Albert B. Hakins late of Laurence in the County of St. Lawrence, deceased, applied to the Surrogate of the County of St. Lawrence to have the said Last Will and Testament, which relates to both real and personal estate, proved and recorded, and on such applications the said Surrogate did ascertain, by satisfactory evidence, who were the widow heirs at law and next of kin of said deceased testator, and their respective residences, viz, John D. Hakins Guy R. Hakins of North Laurence N.Y., Jane Baker of Winthrop N. Y., Margery Winslow of Chicago Ills.. Jennie Gibbs of Bancock Wis. Mina Steenbarge, Emma Mott of Bangor, N.Y. Julia Shirley, Sarah Egglston, whose residences are unknown and cannot after due diligence be ascertained. The children of George Hakins, deceased, whose names or residences are unknown and cannot after due diligence be ascertained, Ellen E. Hakins of Lawrence, N.Y. and said Surrogate did thereupon issue a citation in due form of law, directed to the widow heirs at law and next of kin by their respective names, stating their places of residence requiring them to appear before said Surrogate at his office in the village of Potsdam in said County, on the 4th day of September A.D. 1899, to attend the probate of said Will and said matter not being called until September 5th 1899. and afterwards, to wit: on the 5th day of September A.D. 1899 at Potsdam aforesaid, satisfactory evidence having been presented to the said Surrogate of the service of the said citation in the mode prescribed by law on each of the above named persons. no one appearing to oppose the probate of said Will the said Surrogate took the proofs of said Will herein set forth, and did thereupon adjudge said Will to be a valid Will of real and personal estate, and the proofs thereof to be sufficient, and that the said Will and the proofs thereof be recorded, which said Last Will and Testament and the proofs taken thereon are as follows, that is to say WILL. In the name of God, Amen. I, Albert B. Hakins of the town of Laurence in the County of St. Lawrence and State of New York, being of sound mind and memory do make, publish and declare this my Last Will and Testament in manner following, that is to say: First: I direct that all my just debts and funeral expenses be paid. Second: I give and bequeath to my wife Ellen E. Hakins all of the rest, residue, and remainder of all the estate and property of whatsoever kind or nature or wheresoever situated of which I shall die seized or possessed. Third: I hereby direct authorize and empower my executrix hereon after named to sell whenever she shall deem it best so to do all or any part of the real estate of which I shall die seized or possessed, and upon such sale or sales to make, execute and deliver all necessary contracts, deeds and other paper writings to carry out this power. Lastly: I hereby appoint my said wife Ellen E. Hakins as sole executrix of this, my Last Will and Testament, hereby evoking all former will by me made. In Witness whereof I have hereunto subscribed my name the tenth day of May in the year of Our Lord, one thousand eight hundred and ninety-eight: Albert. B. Hakins We, whose names are hereto subscribed do certify that Albert B. Hakins, the testator, subscribed his name to this instrument in our presence and in the presence of each of us, and at the same time, in our presence and hearing declared the same to be his Last Will and Testament, and requested us, and each of us to sign our names thereto as witnesses to the execution thereof, which we hereby do in the presence of the testator and of each other on the day of the date of the said Will and write opposite our names our respective places of residence.
