LAWRENCE COUNTY. Be it Remembered, That heretofore, to wit on the 25th day of May A.D. 1882 Julia A. Cadwell executrix named in the Last Will and Testament, of Rowland P. Cadwell late of Rossie in the County of St. Lawrence, deased, applied to the Surrogate of the County of St. Lawrence to have the said Last Will and Testament, which relates to both real and personal estate, proved and recorded, and on such application the said Surrogate did ascertain, by satisfactory evidence, who were the heirs of law and next of kin of said deceased testator, and their respective residences, James Cadwell of Watertown NY, Holcomb Cadwell of Alexandria Bay NY, John R. Cadwell, Alexander E. Cadwell and Anice Jones of Buffalo NY, Evaline Lee and Samuel A. Lee of Elgin Illinois. George Cadwell of Morenci Mich, Mary C. Davis and Evaline Sutherland of Roberts Wisconsin. Jane Langdon of Newington Ontario, James D. Cadwell of Hammond Wisconsin. Charles W. Cadwell of South Hadley Mass, Austin Cadwell of Michigan whose residence is unknown and to the husband of Anice Cadwell a niece of Rowland P. Cadwell deceased whose home and place of residence is unknown, and said Surrogate did thereupon issue a citation in due form of law, directed to the heirs at law and next of kin by their respective names, stating their places of residence requiring them to appear before the said Surrogate at his office in the village of Gouverneur aforesaid, satisfactory evidence having been presented to the said Surrogate and the service of the said citation in the mode prescribed by law in said heirs at law and next of kin, no one appearing to oppose the probate of said Will, the said Surrogate took the proofs of said Will hereinafter set forth, and did thereupon adjudge said Will to be a valid Will of real and personal estate and the proofs thereof to be sufficient, and that the said Will and the proofs thereof be recorded, which said Last Will and Testament, and the proofs taken thereon are as follows, that is to say. Know all men by these presents that I Rowland P. Cadwell of Alexandria in the County of Jefferson and State of New York, Gentlemen being in good health and of sound mind and memory do make and publish this my last will and testament. First - I hereby constitute and appoint my wife Julia A. Cadwell to be sole executrix of this my last will, directing my said executrix to pay all my just debts and funeral expenses and the legacies hereinafter given out of my estate. Second - After the payment of my said debts and funeral expenses I give to the Methodist Episcopal Church the sum of five hundred dollars to be used for Missionary purposes. "Fourth" - I give to my said executrix all the rest of my property including personal and real estate to be hers forever. In testimony whereof I hereunto set my hand and seal and declare this to be my last Will and testament this twenty-third day of October in the year eighteen hundred and sixty one. Rowland P. Cadwell {L.S.} The above instrument of one sheet was at the date thereof declared to us by the testator Rowland P. Cadwell to be his last will and testament, and he then acknowledged to each of us that he had subscribed the same and we at his request sign our names hereto as attesting witnesses. Alfred A. Avery {signature} Daniel Howe {signature} Residing in the town of Alexandria County of Jefferson State of N.Y. SURROGATE'S COURT In the matter of proving the LAST WILL and TESTAMENT of Rowland P. Cadwell DECEASED St. Lawrence County, ss. Alfred A. Avery being first duly sworn in open court, upon their several corporal oaths, each for himself, doth depose and say that they are subscribing witnesses to the Last Will and Testament of Rowland P. Cadwell late of Rossie in the County of St. Lawrence and State of New York, deceased. And these deponents do further say that the said deceased, did in the presence of each of these deponents, subscribe his name at the end of the instrument in writing, which is now here shown, and which purports to be the Last Will and Testament of the said deceased, and which bears date the 20th day of October A.D. 1861. That the said deceased did at the time of so subscribing his name to said instrument declare the same to be his Last Will and Testament; and these deponents did thereupon subscribe their own respective names to said instrument as attesting witnesses to the Execution thereof, each at the request of the said deceased and in h__ presence, and in the presence of each other, that the said deceased was at the time upwards of twenty-one years of age, and was a citizen of the United States, and a resident of the County of St. Lawrence, that he appeared to be, and deponents believe he was of sound mind, memory and understanding, and not under any restraint, and as deponents verily believe, in all respects competent to devise real estate. Gillette being duly sworn says that she knew the subscribing witness Daniel Howe and knows his handwriting and believes the signature to said will to be genuine. That said witness is now dead. L. It appearing from the proofs duly taken, in respect to the Last Will and Testament of Rowland P. Cadwell late of Rossie in the County of St. Lawrence and State of New York, deceased; that the said Will was duly executed and that the said Rowland P. Cadwell at the time he executed the same, was in all respects competent to devise real estate, and not under restraint, the said Last Will and Testament and the proofs and examinations are hereby Recorded, Signed and Certified by me, pursuant to the provisions of the Revised Statutes, this 21st day of August A.
