The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.org/ny/nyfiles.htm *********************************************************************** Transcribed from SAMPUBCO copy by Linnea K Ista St Lawrence County, New York, Will Book Volume 32 p 57 Probate of the Last Will and Testament of Sophia Peck late of Gouverneur deceased Surrogates Court St Lawrence County Be it remembered that heretofore to wit on the 9th day of September Ad 1899 Russell Peck one of the executors named in the last will and testament of Sophia Peck late of Gouverneur in the County of St Lawrence, deceased applied to the Surrogate of Said County of St Lawrence to hear the said last will and testament which relates to both real and personal estate proved and recorded ; and on such application of the said surrogate did ascertain by satisfactory evidence who were the husband heirs at law and next of kin of said deceased testator and their respective places of residence viz: Calvin Peck,, Fred Peck, Nellie Peck, Minnie Conklin, Cora Conklin, Royal Peck all of Gouverneur NY and said Surrogate did thereupon issue a citation in due form of law directed to the husband heirs at law and next of kin by their respective names, stating their places of residence requiring them to appear before said Surrogate at his office in the Village of Gouverneur in said County on the 25th day of September, AD 1899 to attend probate of said Will and afterwards, to wit, on the 25th day of September AD 1899 at _____ aforesaid satisfactorily evidence having been presented to the surrogate of the service of the said citation in the mode prescribed by law on each of the above named persons and Chas M Dale Esq having been appointed special guardian for Nellie Bush, a minor, no one appearing to oppose the probate of said will herein set forth and did thereupon adjudge said Will to be a valid Will of real and personal estate and the proofs thereof to be sufficient and that the said Will and the proofs thereof to be recorded which said Last Will and Testament and the proofs taken therein are as follows that is to say: Will In the name of God Amen I Sophia Peck of the Town of Gouverneur in the County of St Lawrence and State of New York being of sound mind and memory do make publish and declare this my last will and testament in manner following that is to say: First I direct that my just debts and funeral expenses be paid. Second, After all my debts and funeral expenses are paid, I give, devise and bequeath to my sons Russel Peck and Royal Peck all of my personal and real property of every name and nature share and share alike subject to the following conditions Third: I direct my executors herein after named to pay out of my estate devised and bequeathed to my sons Russell and Royal Peck the following sums in the following manner: Two hundred dollars to my son Fred Peck Two hundred dollars to my daughter Minnie Conklin Two hundred dollars to my daughter Cora Conklin Two hundred dollars to by daughter Nellie Peck Fourth: O further direct my said sons Royal and Russel Peck shall furnish my beloved husband Calvin Peck with a home and give him such amount of money for clothing and necessary expenses as is consistent with a man of his station in like so long as he remain unmarried. And I further direct that my said estate be subject to his livelihood for my husband as long as he lives or remains unmarried. Lastly I hereby appoint Russell Peck and Royal Peck executors of this my Last Will and Testament hereby revoking all former wills by me made. In witness thereof, I have hereunto subscribed my name the 24th day of July in the Year of Our Lord One thousand eight hundred and ninety nine Sophia (x) Peck Surrogate Court In the matter of proving the Last Will and Testament of Sophia Peck Deceased St Lawrence County New York, ss, William Kinney and William F Morrison being first duly sworn in open court doth depose and say that they are subscribing witnesses to the Last Will and Testament of Sophia Peck late of Gouverneur in the County of St Lawrence and the State of New York, deceased, and deponents do further say that the said deceased, did, in the presence of each of deponent subscribe her name at the end of the instrument in writing which is now here shown and which purports to be the Last Will and Testament of the said deceased and which bears date the 8th day of July AD 1899. That the said deceased did at the time of so subscribing her name to the said instrument , declare the same to be her Last Will and Testament and deponents did thereupon subscribe their own respective named to said name as attesting witnesses to the execution thereof, each at the request of said deceased and in her presence and in the presence of each other: that the said deceased was at the time upwards of twenty-one years of age and was a citizen of the United State and a resident of the County of St Lawrence that she appeared to be and the deponent believe she was of sound mind, memory and understanding and not under any restraint; and as deponents verily believe in all respects competent to devise real estate. Subscribed to and sworn to before me this 25th day of September 1899 Aric R Harriman Sp& acting Surrogate Wm Kinney Wm Morrison St Lawrence County SS In appearing from the proofs duly taken in respect to the Last Will and Testament of Sophia Peck, late of Gouverneur in the County of St Lawrence and State of New York deceased; that the said Will was duly executed and that the said Sophia Peck at the time she executed the same was in all respects competent to devise real estate and not under restraint, the said Last Will and Testament and the proofs and examinations are hereby Recorded, Signed and Certified by me, pursuant to the provisions to the Code of Civil Procedure this 25th day of September AD 1899 Aric Harriman Sp.
