Be it remembered , That heretofore, to wit, in the 21st day of December A.D., 1909 Minnie Gotham executrix named in the Last Will and testament, of Levi Stockwell late of Russell in the County of St. Lawrence, deceased, applied to the Surrogate of the County of St. lawrence to have the said Last Will and Testament which related to both real and personal estate, proved and recorded, and upon such application the said Surrogate did ascertain by satisfactory evidence, who were the heirs at law and next of kin if said deceased testator, and their respective residences, viz: Maria Miles of Potsdam N.Y. Margaret Eggleston of DeGrasse, N.Y. Emeline Carr of Fort Shaw, Montana Louisa Clintsman of Grand Forks N.D. Benjamin Stockwell and William Stockwell of Russell, N.Y. Alonzo Stockwell of Cantin, N.Y. Charles Stockwell of Newton falls, N.Y. Leona Wilcox of Sutten, Alberta, Canada Earl Colton, Roland Colton, William Colton of Lisbon, N.Y. and said Surrogate did thereupon issue a citation in due form of law, directed to the heirs at law and next of kin by their repective names, stating their places or residence requiring them to appear before said Surrogate at his office in the village of Canton in said county, on the 21st day of February A.D. 1910 to attend the probate of said Will and objections thereto having been filed by William Stockwell and said matter adjourned and afterwards to wit: on the 21st day of March A.D. 1910 at Canton aforesaid, satisfactory evidence having been presented to the said Surrogate of the service of said citation in the mode prescribed by law on all said above named persons and the objections heretofore filed having been withdrawn and Joseph F. Brown, Esq. having been appointed special guardian for Earl Colton, Roland Colton and William Colton, no one appearing to oppose the probate of said Will the said Surrogate took the proofs of said Will herin set forth, and did thereupon adjudge said Will to be a valid Will of real and personal estate, and the proofs thereof to be sufficient, and that the said Will and the proofs thereof be recorded; which said Last Will and Testament and the proofs taken thereon are as follows, that is to say WILL. I, Levi Stockwell of Russell, New York, do hereby make this my last Will and Testament in manner following: I direct my executrix hereinafter named to pay all my just debts and funeral expenses. I give, devise and bequeath all my property real, personal or mixed, wherever situate, to Minnie Gotham, with whom I am now staying. I nominate and appoint the said Minnie Gotham to be the executrix of this, my last Will and I hereby revoke all former Wills made by me. The foregoing instrument was signed, sealed, published and declared by the said levi Stockwell to be his last Will and Testament, inour presence, and we, at his request, and in his presence and in presence of each other, believing him to be of sound and disposing mind and memory, have hereunto set our hands as witnesses the day and year last above written. Geo. H. Bowers, residing at Canton, N.Y. Chas. I. Baily, Canton, N.Y. Surrogates Court. In the Matter of Proving the Last Will and Testament of Levi Stockwell Deaceased. St Lwrence County, ss. Charles I. Bailey and George H. Bowers being first duly sworn in open court, doth depose and say that they are subscribing witnesses to the Last Will and Testament of Levi Stockwell late of Russell in the County of St. Lawrence and State of New York, deceased. And deponents do further say that the said Levi Stockwell deceased, did, in the presence of each of the deponents subscribe his name at the end of the instrument in writing, which is now here shown, and which purports to be the Last Will and Testament of the said deceased, and which bears date the 4th day of November A.D., 1909. That the said deceased did at the time of so subscribing his name to said instrument, declare the same to be his last Will and Testament and deponent did thereupon subscribe their own respective names to said instrument, as attesting witnesses to the execution thereof, each at the request of said deceased, and in his presence, and in the presence of each other , that the deceased was at the time, upwards of twenty-one years of age, and was a citizen of the United States, and a resident of the County of St. Lawrence; that he appeared to be, and deponents believe he was of sound mind, memory and understanding, and not under any restraint; and as deponents verily believe, in all respects competent to devise real estate. It appearing from the proofs duly taken, in respect to the Last Will and Testament of Levi Stockwell late of Russell in the County of St. Lawrence abd State of New York, deceased, that, the said will was duly executed and that the said Levi Stockwell at the time he executed the smae, was in all repsects competent to devise real estate, and not under any restraint, the said Last Will and Testament and the proofs and examinations are hereby Recorded, Signed, and Certified by me, pursuant to the provisions of the Code of Civil Procedure, this 21st day of March A.D. 1910.
