Pinney late of Edwards deceased Surrogates Court, St. Lawrence County, Be it Remembered, That heretofore, to wit: on the 10th day of February A.D. 1916 Forrest A. Pinney one of the legatees named in the Last Will and Testament of Roswell L. Pinney late of Edwards in the County of St. Lawrence, deceased, applied to the Surrogate of the County of St. Lawrence to have the said Last Will and Testament which relates to both real and personal estate, proved and recorded; and upon such application the said Surrogate did ascertain by satisfactory evidence, who were the heirs at law and next of kin of said deceased testator, and their respective residences, vis: Forrest R. Pinney, son, Edwards, NY petitioner, Spencer Harris, grandson, Fine, NY and said Surrogate did thereupon issue a citation in due form of law, directed to the heirs at law and next of kin by their respective names, stating their places of residence requiring them to appear before said Surrogate at his office in the village of Gouverneur in said County, on the 28th day of February A.D., 1916 to attend the probate of said Will and afterwards to wit: on the 28th day of February A.D., 1916 at Gouverneur in said County, satisfactory evidence having been presented to the said surrogate of the service of said Citation in the mode prescribed by law on said Spencer Harris; and C. Arthur Parker, attorney of Gouverneur, NY having been duly appointed and appearing as Special Guardian for Spencer Harris a minor no one appearing to oppose the probate of said Will the proofs of said Will were duly taken as herein set forth, and the said Surrogate did thereupon adjudge said Will to be a valid Will of real and personal estate, and the proofs thereof to be sufficient, and that the said Will and the proofs thereof be recorded; which said Last Will and Testament and the proofs taken thereon are as follows, that is to say WILL. Last Will and Testament. I, Roswell L. Pinney of the town of Edwards, County of St. Lawrence and State of New York, do make, ordain, publish and declare this my last Will and Testament, in manner and form following, that is to say; First, I direct the payment of my just debts, if any, and my funeral expenses. Second, I give and devise all the real property of what nature or kind soever, of which I may die "Seised" to my wife Martha M. Pinney, to be used and enjoyed by her during the term of her natural life, and from and immediately after her death, I give and devise the same to my son Forest R. Pinney, and to his heirs and assigns forever. Third, I give and bequeath all the personal property of whatever kind or description of which I may die possessed to my wife Martha M. Pinney, to be used and enjoyed by her during her natural life; and from and immediately after her death, I give, devise and bequeath the same to my son Forest R. Pinney, and to his assigns forever. Likewise, I make constitute and appoint my said wife Martha M. Pinney to be sole executrix of this my last Will and Testament, hereby revoking all former Wills by me made. Pinney" which is subscribed as that of testator to the instrument in writing now produced and shown to deponent purporting to be his last Will and Testament of said deceased, bearing date the 26th day of May, 1897, is the proper signature and handwriting of said Roswell L.
