The Will of Roswell P. Wilson of Lawrence, St. Lawrence Co., NY Transcribed from the original Surrogate's Court document, preserving original spelling, punctuation, & syntax, by Janette Wilson Ramos, 8/24/97 Record of the Last Will and Testament of Roswell P. Wilson late of Lawrence with the proof thereof. Surrogate's Court, St. Lawrence County, Be it Remembered, That heretofore, to wit: on the 21st day of November A.D. 1862 Lemuel P. Ferris one of the Executors named in the last Will B. and Testament, of Roswell P. Wilson late of Lawrence in the County of C. St. Lawrence deceased, applied to the Surrogate of the county of St. Lawrence, to have the said Last Will and Testament, which relates to both real and personal estate, proved and recorded: and on such application the said Surrogate did ascertain by satisfactory evidence, who were the Widow heirs at law and next of kin to said deceased testator, and their respective residences, Viz, Jane E. Wilson of Lawrence aforesaid widow of deceased. Henry E. Wilson of Napierville Canada East - Harriett Maria Wilson in Massachusetts, place unknown, Amelia Wilson a Minor, residing in Champlain Clinton Co. N. Y. for whom E. H. Niary Esq. of Gouverneur in said County was duly appointed Special Guardian. and said Surrogate did thereupon issue a citation in due form of law, dircted to the heirs at law and next of kin and Special Guardian by their respective names, stating their places of residence, requiring them to appear before the said Surrogate at his office in the Village of Gouverneur in said County, on the 13th day of January A. D., 1863 to attend the probate of said Will and afterwards, to wit: on the 13th day of January A. D., 1863 at Gouverneur aforesaid, satisfactory evidence having been presented to the said Surrogate of the service of the said citation in the mode prescribed by law personally on all the said Widows & heirs residing in the State of New York who were of lawful age & on E. Niary Esq. Special Guardian & on all others by due ?_____ in State ?_______ no one appearing to oppose the probate of said Will, the said Surrogate took the proofs of said Will _____________ ________- - herinafter set forth, and did thereupon adjudge said Will to be a valid Will of real and personal estate, and the proofs thereof to be sufficient; which said Last Will and Testament, and the proofs taken thereon are as follows, that is to say: WILL (page 2) In the Name of God Amen I Roswell P. Wilson of the town of Lawrence, in the County of St. Lawrence, and State of New York of the age of thirty two years, and being of sound mind & memory, do make, publish and declare this my Last Will and Testament, in the manner following, that is to say: first I give & bequeath to my Brother Henry E. Wilson of Napierville Canada East all my wearing apparel of every kind excepting a hirt wore by me, Thereby request my Executors to send the same to him without paying freight second I give & bequeath to my Niece, Harriet Maria Wilson, who for weeks resided in Champlain, New York now residing in Massachusetts, the musical instrument now in my possession, formerly owned by my brother William. I request & direct my Executors to send the same to her, the said Harriet Maria Wilson shenever called for by her, and paying the freight thereon as far as Rouses Point. third I give & bequeath to my wife Jane E. G. Wilson, all the rest & residue of my property of every name and nature whatsoever, intending to include all interest there in real estate as well as personal property fourth I hereby constitute and appoint my wife Jane E. G. Wilson Executrix, and Lemuel P. Ferris of the town of Lawrence Executor of this my last will and testament. In witness whereof I have hereunto set my hand and seal, this sixth day of November in the year of our Lord one thousand eight-hundred & sixty-two. Roswell P. In the Matter of proving the Last WILL and Testament of Roswell P. Wilson DECEASED. St. Lawrence County, ss. H. Ferris & Wm C. Blish, both of the town of Lawrence, in the County of St. Lawrence, N.Y. being first duy sworn in open court, upon their several corporal oaths, each for himsilf, doth depose and say, that they are subscribing witnesses to the Last Will and Testament, of Roswell P. Wilson late of Lawrence in the County of St. Lawrence and State of New York deceased. And these deponents do further say, that the said Roswell P. Wilson deceased, did, in the presence of each of these deponents, subscribe his name at the end of the instrument in writing, which is now here shown, and which bears date the 6th day of November A. D., 1862. That the said deceased did, at the time of so subscribing his name to said instrument, declare the same to be his Last Will and Testament; and these deponents did thereupon subscribe their own respective names to said instrument, as attesting witnesses to the Execution thereof, each at the request of the said deceased, and in his presence, and in the presence of each other; that the said deceased, was at the time, upwards of twenty-one years of age, and was a citizen of the United States, and a resident of the County of St. Lawrence; that he appeared to be, and deponents believe he was of sound mind, memory and understanding, and not under any restraint: and as deponents verily believe, in all respects competent to devise real estate. In appearing from the proofs duly taken, in respect to the Last Will and Testament, of Roswell P. Wilson at the time he executed the same, was in all respects competent to devise real estate, and not under restraint, the said Last Will and Testament, and the proofs and Examinations are hereby Recorded, signed, and Certified by me, pursuant to the provisions of the eRevised Statutes, this 13th day of January A.
