I Martha Halsey of the Town of Southampton County of Suffolk and Province of New York being indisposed in Body but of sound and perfect mind and memory thanks be to God therefor but calling to mind the mortality of my body and knowing that it is appointed for all men once to dye do make and ordain this my last will and testament in name and form following that is to say principally and first of all I give and Recommend my Soul into the hands of God that gave it and my body I commit to the Earth to be decently interred at the discretion of my Executors hereafter named nothing doubting but at the General Resurrection I shall receive the same again by the mighty power of God, and as touching my Temporal Estate and such goods and Chattels as it hath pleased God to bestow upon me, I give devise and bestow in the following way and manner. First I Will that all my just debts be paid or ordained to be paid within convenient time after my decease by my Executors hereafter named Imprimis I give unto my Grandson Joshua Sayre two thousand of Shingles. Secondly, I give unto my Grandaughter Abigail Halsey my Negro Girl Hannah and also two Silver Spoons. Thirdly, I give to my Grandaughter Eunice Harris two Silver Spoons. Fourthly, I give unto Hannah Bishop the sum of twenty shillings by way of legacy. And all the rest of my Estate both real and personal Lands and Testaments Goods and chattels I give and bequeath unto my five daughters namely Ireny Abigail Experience Mary and Prudence to be equally divided amongst them and it shall be to them their heirs and assigns forevever. Lastly I hereby ordain constitute and appoint John Post and Nathaniel Halsey my only sole and joint Executors to this my last Will and Testament and do hereby disanul disallow and revoke all and every other Will Testament Legacy or bequest by me at any time heretofore willed bequeathed or made ratifying and confirming this and none other to be my last Will and Testament. In Witness whereof I have hereunto set my hand and Seal in Southampton this fifteenth day of November and in the year of Our Lord Christ 1753 and in the twenty seventh year of the Reign of our Sovereign Lord George the second over Great Britain etc. Martha her + mark Halsey (LS) Signed Sealed published and pronounced and declared by her the sd. Be it remembered that on The fifteenth day of January One thousand seven hundred and fifty four personally came and appeared before me Maltby Gelston Surrogate of the said County Temperance Halsey of said County in Southampton and being duly sworn on her oath declared that she did see Martha Halsey sign and seal the within Written Instrument purporting to be the Will of the said Martha Halsey bearing date the fifteenth day of November 1753 and heard her publish and declare the same to be and contain her last Will and Testament. That at the time thereof she the said Martha Halsey was of sound disposing mind and memory to the best of the knowledge and belief of she the Deponent and that her name subscribed to the said Will is of her proper hand writing which she subscribed as a witness to said will in the Testators presence and that she the Deponent saw John Chatfield and Abigail Cooper the other Witnesses to the said Will subscribe their names as Witnesses thereto in the Testators presence. Maltby Gelston Surrogate James De Lancey Esqr his Majesty’s Lieutenant Governor and Commander in Chief in and over the Province of New York, and the Territories depending thereon in America. To all to whom these presents shall come or may concern Greeting Know Ye that at Suffolk County on the fifteenth day of January last before Maltby Gelston Esqr. being thereunto delegated and appointed the last Will and testament of Martha Halsey deceased, a copy whereof is hereunto annexed was proved and now approved and allowed of by me. The said deceased having whilst she lived, and at the time of her death, Goods Chattels and Credits within this province, by means whereof the proving and Registering the said Will and the Granting Administration of all and singular the said Goods Chattels and Credits, and also the auditing allowing and final discharging the account thereof doth belong unto me: And that Administration of all and singular the goods chattels and credits of the said deceased, and any way concerning her Will was Granted unto John Post and Nathaniel Halsey the Executors in the said Will named, being first sworn well and faithfully to Administer the same and to make and exhibit a true and perfect Inventory of all and singular the said Goods Chattels and credits and also to render a just and true account thereof when thereunto lawfully required. In Testimony whereof I have caused the Prerogation Seal of the Province of New York to be hereunto Affixed this fourteenth day of March One thousand seven hundred and fifty four.
